SUBJECT: Consider a request to allow a hearing on File 1661 -P prior to the end of the 12 month
period as per Article V, Section 8 (2) of the Planning Commission Bylaws.
STAFF REPORT
Toni Sibley, the applicant, is requesting that the Planning Commission allow a joint public
hearing to occur May 19, 2003 on File 166 1 -P.
File 166 1 -P is a request for a specific use permit to allow the expansion of the Correctional
Systems, Inc. facility at 2495 Gulf. On June 17, 2002, the Planning Commission and City
Council held a public hearing on a specific use permit request that would allow the expansion
of the facility into a vacant church building on an adjacent property. The building was to be
used for office space and a dining area. The Planning Commission approved the request. On
June 25, 2002, the City Council denied the request.
In February, 2003, Mr, Sibley made an application for the same expansion of the facility into
the aforementioned church building and to also allow the rehabilitation of the facility's former
office building into additional dormitory space. This new request included the entire facility
located at 2495 Gulf. The item was to be scheduled for the March, 2003 Planning Commission
meeting.
On March 7, Mr. Sibley requested a postponement of the hearing on the specific use permit
until the May 17 Planning Commission/City Council Joint Hearing.
Article V, Section 8 of the Planning Commission Bylaws states that a request that has been
considered on the same parcel of land during the past twelve calendar months shall not be
rescheduled until the end of the twelve month period except as follows:
1. Upon request or referral back from the City Council
2. On written request by the applicant with pertinent facts which the City Planning
Commission deemed sufficient to warrant a new hearing.
Mr. Sibley has submitted a request for the new hearing.

Reference is made to the Application of Correctional Systems, Inc. for a Specific Use Pernlit
for the property located at 2495 Gulf Street, Beaumont, Texas.
I represent th,e, applicant Correctional Systems, the purpose 0f this letter is to request that this
permit be considered by the planning and Zoning Commission at its May 19 meeting.
My letter of FCbruary 13, 2003 to you pointed out that in accordance with Section 8 of the
Planning and Zoning Code this application is being brought prior to the expiration or 12 months
from the previous application (May 2002). However, applicant is in compliance with Sub Section
2 of Section 8 of the Planning, and Zoning code, for the reason that this application for a Specific Use
Permit is for the entire property that applicant purchased from the church (Lot 9, Block 33,
McFaddin Hcights, Beaumont, Texas.)
Please let me know if anything further is required in connection with this application.

Section 6. In all public hearings, the Commission may ask for each
delegation to appoint a speaker or speakers to represent the
delegation in order to conserve time. If a petition or petitions
are to be presented, the caption only shall be read and said
petition or petitions filed with the Secretary for the record and
later reviewed by Commission members unless specific
approval is requested and granted by the Chairman for a
complete reading of the signature on said petition.
Section 7. All applications for amendments to the Zoning Ordinance
and/or maps shall be filed with the Secretary on a form
approved by the Commission.
> Section 8. All applications for amendment to the Zoning Ordinance shall
be scheduled for the next reasonable hearing date available by
the Planning Division staff. However, if a request has been
considered on the same parcel of land during the past twelve
calendar months, said request will not be rescheduled until the
end of the twelve (12) month period except as follows: ,
(1) Upon request of or referral back from the City
Council
(2) On written requests by the applicant with
pertinent facts which the City Planning
Commission deemed sufficient to warrant a
new hearing, such request shall not be set for
public hearings unless approved by a majority
vote of the Commission. If a hearing is
granted by the Commission upon request of
the applicant, the procedure will be the same
as that given original application for a zoning
change.
Section 9. Written notice to property owners as requircd'by law before
a hearing of the Commission shall be sent to all owners of
property affected by the proposed change in zoning, or to
persons rendering the same for City Taxes, provided, however,
that the staff of the City Planning Division may, but shall not
be required to, resort to checking the deed records of
Jefferson County, Texas, so that the current ownership may be
ascertained insofar as possible, and notice given to them.
Section 10. Withdrawals, postponements, fees form same.
(1) Withdrawals
a. Written request of the applicant to withdraw his
petition for zoning change prior to mailing hearing
notices shall be honored.
b. A written request for withdrawal made after mailing
hearing notices, but not less than five (5) days
(excluding Saturday and Sunday) before date of
