Commissioner Hernandez seconded the motion. Motion to approve carried 5:0. Planning Commission June 18, 2001 REGULAR MEETING 1) ReWat-Wescalder Fig Acres Addition: Consider the replat of Lot 1, Block 12, Wescalder Fig Acres Addition into Lots IA, 1B, IC and ID, Block 12, said addition. Location: Southwest comer of Baker Road and Wescalder Road Applicant: Wortech Land Surveyors, Inc. Mr. Richardson stated that this item is a replat of 4A acres into 4 lots. No new street rights -of -way or new easements are being dedicated. The property is zoned RS. The lots will far exceed the minimum lot size requirements. Since this replat will be increasing the number of lots, a public hearing will be required. This replat was sent to all interested parties and no objections were received. The replat is in conformance with the Subdivision Ordinance, the Zoning Ordinance and the Comprehensive Plan. Therefore I recommend approval. Fifteen notices were mailed to properties within 200 feet of the subject property. No responses in favor or in opposition were received. Chairman Leister opened the public hearing. The applicant was present but made no comment. No comments were made in favor or in opposition. Chairman Leister closed the public hearing. Commissioner Hallmark made a motion to approve the Replat of Lot 1, Block 12, Wescalder Fig Acres Addition into Lots IA, IB, 1C and ID as requested. Commissioner Lucas seconded the motion. Motion to approve carried 5:0. 2) Variance Request - Christina Court Addition, Second Phase: Consider a variance of Article 11,Section 24-8 (c), concerning the approval period of the Preliminary Plat of Christina Court Addition, Second Phase. Applicant: Bill Little, Litwood, Inc. Mr. Richardson stated that this item is a variance request of Article 11, Section 24-8 (c), concerning the approval period of the Preliminary Plat of Christina Court Addition, Phase 11. 19 Planning Commission June 18, 2001 The preliminary plat for Christina Court was approved by the Planning Commission on June 19, 1999 and the construction plans for the entire subdivision were approved in August, 1999. Phase I was completed and accepted by the City, Bill Little, the developer, is considering amending the plat for Phase 11 to provide larger lots by combining some of the planned lots and making fewer lots. This will not affect any drainage or engineering, only interior lot lines. He is currently studying the feasibility of this. Mr. Little is requesting a variance to the requirement that a final plat for Phase II be recorded within 24 months from the date of preliminary plat approval. He is requesting an extension of 24 months, Mr. Richardson recommended approval of the request. Chairman Leister asked for the applicant's comments. Bill Little, the applicant, was present but did not comment. Commissioner Lucas made a motion to approve the variance request to the requirement that a final plat for Phase 11 of Christina Court Addition be recorded within 24 months of the date of the preliminary plat approval and approving an extension of 24 months as requested by the applicant. Commissioner Hernandez seconded the motion. Motion to approve carried 5:0. Mayor Pro -Tern Goodson called the Joint Public Hearings of June 18, 2001 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. 1) File 1553-Z: Hollywood Avenue Area Rezoning Study - to change zoning from HI (Heavy Industrial) and GC -MD (General Commercial -Multiple Family Dwelling) to HI, LI (Light Industrial), GC -MD and RCR (Residential Conservation and Revitalization) District. Applicant: City of Beaumont Mr. Richardson stated that the request for rezoning portions of the 165 acres delineated in the Hollywood Area Rezoning Study. The study was done as the first step in a revitalization effort for the area. The study area extends from, the Southern Pacific Railroad tracks to the north, Fourth Street to the east, Fannin Street to the south and Tenth Street to the west. Currently, all the land within the study area is zoned Heavy Industrial except for Q Planning Commission June f8,2001 properties owned by Bethel Baptist Church and Girls Haven. Those properties are zoned GC -MD. The area is a mixture of industrial, commercial, medical, public/semi-public and residential uses. There is a rather large residential neighborhood within the study area. Because of the Heavy Industrial zoning, no homes can be built there except for the replacement of grandfathered homes. Staff recommended that those properties along the north side of Fannin be rezoned to GC -MD. Two areas on the south side of Hollywood were proposed for Light Industrial. - The residential neighborhood was proposed to be rezoned RCR. The remainder of the study area was recommended to stay Heavy Industrial. A task force consisting of concerned citizens was formed to review staff's recommendation and made the following recommendations: Of that most westerly area proposed as LI in the staff recommendation, "Tract 52", owned by American Valve and Hydrant, is recommended to remain HI. "Tract 55" is recommended to be rezoned LI. Recommend that an area abutting the east side of Sixth Street be rezoned LI. Two property owners own this property. One tract, an abandoned wholesale petroleum products dealership, is for sale. The remainder of the property is storage area for Red Man Pipe and Supply Company. Both of the existing uses are permitted uses in the LI District. After further consideration, -staff concurs with the Task Force recommendation. 339 notices were mailed to property owners within the study area and within 200 feet of the area. Five responses in favor and in one in opposition were returned. Slides of the subject area were shown. Chairman Leister opened the public hearing and asked for comments in favor or in opposition. Fred Alexander, 3117 Brenham, spoke to the Commission in favor of the request. Mr. Alexander is the spokesperson for the homeowners in the subject area. Ken LaFleur with American Valve and Hydrant addressed the Commission in favor. Jerrie Drew, 3066 W. Crockett, addressed the Commission in favor of the request. 4 Planning Commission June 18, 2001 Winnie Simon Leday, 2380 S. 8', addressed the Commission in favor on behalf of her mother, Ella Simon who lives at 3069 Brenham. Jan Haynes, 9255 Lombard, addressed the Commission in favor on behalf of her mother, Helen Simmons, 3027 Brenham. Lee Brittain of Brittain Properties addressed the Commission. Red Man Pipe and Supply Co. leases their property from Brittain Properties. Gaile Henry, 6385 Gladys, addressed the Commission. The public hearing was closed. Comments from the Commission and Council followed. Commissioner Lucas made a motion to approve the zone change from HI (Heavy Industrial) and GC -MD (General Commercial -Multiple Family Dwelling) to HI, LI (Light Industrial), GC -MD and RCR (Residential Conservation and Revitalization) District as requested for the Hollywood Avenue Area in File 1553-Z. Commissioner Hernandez seconded the motion. Motion to approve carried 5:0. 2) File 1556-Z/P: Request for a zone change from RM-H (Residential Multiple Family Dwelling -Highest Density) to RCR (Residential Conservation and Revitalization) District and a specific use permit application to allow a coffeehouse/Internet caf6. Location: Northwest comer of Alabama and University Drive Applicant: David Thomas Breaux Mr. Richardson stated that the applicant wants to open a coffee house/Internet cafe' on a vacant lot at the northwest comer of Alabama and University. Coffee, tea and snacks will be served and personal computers will be made available to students. No alcohol will be served. With the mixed uses in the area, this use will fit into the neighborhood with minimum adverse effect. Mr. Richardson recommended approval of the 'request. Thirty-eight notices were mailed to property owners within 200 feet. No responses in favor and three in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Planning Commission June 18, 2001 Tom Sibley, attorney representing the applicant, David Breaux, addressed the Commission. Chairman Leister asked for comments, in favor or in opposition. No comments were made. The public hearing was closed. Comments from the Commission and Council followed. Commissioner Hallmark made a motion to approve a zone change from RM-H to RCR District and a specific use permit application to allow a coffeehouse(Internet caf6 at the northwest comer of Alabama and University Drive as requested in File 1556-Z/P. Commissioner Hernandez seconded the motion. Motion to approve carried 5:0. 3) File 1557-P: Request for a specific use permit to allow the expansion of the Greenlawn Cemetery located within an RM-H (Residential Multiple Family Dwelling -Highest Density) District and abutting the existing Greenlawn Cemetery. Location: Gill Street at Scranton Avenue Applicant: Community Cemeteries, Inc. Mr. Richardson stated that Community Cemeteries, Inc. has purchased 1.095 acres at Gill, Scranton and Johnstown with the intent ofexpanding Greenlawn Cemetery. Greenlawn and Simmons Cemeteries lie across the street from the subject property. The property will be surrounded by a 4' tall chain link fence. Mr. Richardson recommended approval of the request. Forty-one notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments, comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Bodwin made a motion to approve a specific use permit to allow the expansion of Greenlawn Cemetery located in an RM-H District at Gill Street at Scranton Avenue as requested in File 1557-P. Commissioner Lucas seconded the motion. Motion to approve carried 5:0. 4) File 1558-Z: Request for a zone change from RM-H (Residential Multiple Family Dwelling -Highest Density) to LI (Light Industrial) District. Location: Southeast comer of Lincoln and Hemlock Streets Applicant: Joseph Durousseau, et ux. R Planning Commission June 18, 2001 Mr. Richardson stated that the applicant has requested this zone change for the purpose of opening a welding shop on the subject property. The lot is surrounded by residential to the south, east and west. To the north is the site of the old Charlton -Pollard High School. The Charlton -Pollard Neighborhood Plan designates this area as low density residential. The proposed use is not in conformance with the Plan. Mr. Richardson recommended denial of the request. Twenty-six notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned. Slides of the subject area were shown. Chairman Leister opened the public hearing and asked for the applicant's comments.' Joseph Durousseau, the applicant, addressed the Commission and answered questions. Comments from the Commission and City Council followed. Chairman Leister asked Mayor Moore what action they should take. The public hearing was closed. Commissioner Lucas made a motion to defer the zone change request from R.M-H to LI District at the southeast comer of Lincoln and Hemlock Streets as requested in File 1558-Z. Commissioner Bodwin seconded the motion. The motion to defer carried 5:0. 5) File 1559-P: Request for a specific use permit to allow a massage therapy establishment in an RCR (Residential Conservation and Revitalization) District. Location: 2530 Laurel Street Applicant: he Chen Lee Mr. Richardson told the Commission and Council that the applicant wants to operate a massage facility in an existing 1,350 square foot residential structure. Parking will be at the rear of the building. There a number of other businesses in the immediate vicinity. The applicant is asking for amodification to the landscaping/screening requirement. He is going to build the 8 foot screening fence. However, there is not room on either side ' to install the 10' wide landscape strip. Therefore, the applicant is requesting a modification to that requirement. K Planning Commission June 18,2001 Mr. Richardson recommended approval of the request with a modification to the landscaping requirement. Twenty-seven notices were mailed to property owners within 200 feet. One notice in favor and none in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked fof the applicant's comments. A representative of Mrs. Lee, the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Hallmark made a motion to approve a specific use permit to allow a massage therapy establishment in an RCR District at 2530 Laurel Street with a modification to the landscaping requirements as requested in File 1559-P. Commissioner Bodwin seconded the motion. Motion to approve carried 5:0. 6) File 1560-Z- Request for a zone change from RM-H (Residential Multiple Family Dwelling -Highest Density) to GC -MD (General Commercial -Multiple Family Dwelling) District to expand an existing restaurant. Location: 2185 Washington Boulevard Applicant: Dale Poullard Mr. Richardson told the Commission and Council that the owner of Pappy's Creole Kitchen at 2197 Washington Boulevard wants to expand the business onto the subject property. Property to the west and north is zoned GC -MD. Mr. Richardson recommended approval of the request. Twenty-seven notices were mailed to property owners within 200 feet, None in opposition or in favor were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Benita Ned Poullard, the applicant, addressed the Commission. Planning Commission June 18,2001 Chairman Leister asked for comments in favor or in opposition. Audrey Simpson Thompson addressed the Commission in favor. The public hearing was closed. Commissioner Hallmark made a motion to approve a zone change from RM-H to GC -MD to expand an existing restaurant at 2185 Washington Boulevard as requested in File 1560-Z.
