SUBJECT: Consider a request for a specific use permit to allow a home health care agency in all
RCR (Residential Conservation and Revitalization) District.

The Planning Manager recommends approval of this request subject to providing an 8' tall
wood screening fence along the west property line running from the rear property line to the
front edge of the main structure.
Southeast Texas Professional Health Care, Inc., the applicant, is requesting a specific use
permit to allow the operation of a home health care agency at 2401 North Street.
SETX Professional Health Care, Inc. is a locally owned and operated home health agency.
They employ licensed staff which includes office staff, registered and licensed nurses, home
health aides, physical therapists, occupational therapists and social workers. The agency is a
non-profit organization with a CLIA waiver (no drugs or laboratory services are used in the
facility). The office hours are 8 am. to 5 p.m., Monday -Friday. Field staff work at the home
of the clients and traffic is kept to a minimum.

This letter is in reference to obtaining a Specific Use Permit for office use for the
property located at 2401 North, Beaumont, TX 77702.
SETX Professional Health Care, Inc. is a locally owned and operated home health
agency. We employ licensed staff, which includes, but is not limited to Office staff,
Registered and Licensed nurses, Home Health Aides, Physical Therapists, Occupational
Therapists, and Social Workers. The agency is a non-profit organization with a CLIA
waiver (no drugs or laboratory services are used in the facility). The office hours are
8:00 am to 5:00 pm Monday — Friday. Field staff work at the home of the clients and
traffic is kept to a minimum.
SETX Professional Health Care, Inc, will be compatible with and not injurious to the use
and enjoyment of other property, nor significantly diminish or impair property values
within the immediate vicinity. The agency will not interrupt the normal and orderly
development and improvement of surrounding vacant property. Adequate utilities,
access roads, drainage and other necessary supporting facilities have been or will be
provided. The design, location and arrangement of all driveways and parking spaces
provides safe and convenient movement of vehicular and pedestrian traffic without
adversely affecting the general public or adjacent development. Adequate nuisance
prevention measures have been or will be taken to prevent or control offensive odor,
fumes, dust, noise and vibration. If an additional lighting is required, SETX professional
Health Care will install directional lighting that will not disturb or adversely affect
neighboring properties; there are sufficient landscaping and screening to insure harmony
and compatibility with adjacent property; and the agency is in accordance with the
comprehensive plan,

SETX Professional Health Care, Inc. will comply with all of the conditions set by the City
Council in order to receive a specific use permit.
Please note that this property has been granted a Specific Use Permit in the past as
noted on the zoning ordinance maps.

This application is in conformance with seven of the eight conditions necessary for approval.
Comments on Conditions I and 7 follow:
1. The prior use was an office for a commercial establishment. There are other
commercial uses in the immediate vicinity. The proposed use will be compatible with
the surrounding neighborhood.
7. No fence exists between the subject property and the residential property to the west.
A chain link fence and heavy foliage exist along the south property line. The property
to the south is commercial. The parking lot is existing. The Planning Manager is
recommending an 8' tall wood screening fence along the west property line running
from the rear property line to the front edge of the main structure.
