Richardson, Planning Manager SUBJECT: Request to allow a public hearing on File 1667-Z/P prior to the end of the 12 month period as per Article V, Section 8(2) of the Planning Commission Bylaws. FILE: 1667-Z/P STAFF REPORT In May, 2003, Modern, Inc. was denied a zone change to LI (Light Industrial) District and a specific use permit to allow a farm equipment and machinery manufacturing facility on Irving. Cory Crenshaw, with Modem Inc., is requesting the opportunity to re -appear before the Planning Commission prior to the end of the 12 month waiting period as mandated by the Planning Commission Bylaws. Article V, Section 8 (2) of the Planning Commission Bylaws allows the Planning Commission to grant an exception to that rule upon written request by the applicant. On July 3, 2003, Mr. Crenshaw submitted a letter requesting such an exception. Exhibit is attached. Modern strongly believes reconsideration by the committee is warranted for the following reasons: • We have corrected and made changes to loading areas inside of our facility and in lot 22. • We have rerouted incoming traffic related to our operations. • We have significantly reduced traffic on McGovern, Tilson and Schwarner by using lot 22 from Irving Street. • The recent decision by city council to disallow the approval of the rezoning of our property will not only severely hamper our company's ability to function, but more importantly, may force us to close the plant permanently. • We have had a resurgence in community support for our company's existence in the Charlton -Pollard area. Modern has been diligently working with the Charlton -Pollard neighborhood to resolve all issues that previously caused some concerns in the area. Modern has a strong commitment to Beaumont and to the community that has never wavered in the half century we leave been in business.
