STAFF REPORT
The Planning Manager recommends approval subject to the following conditions and with a
variance to the rear building setback requirement for Buildings 16, 17 and 18:
1. Show the necessary utility easements (Entergy)
2. Put a Note 4 that reads, "Property shall be graded to drain to streets or
underground storm sewer system and shall not drain onto adjacent properties
before and after structures are built, (Engineering)
3. Provide a Fire Marshall's approved plan for fire protection to Lots 9 and 12.
(Fire)
4. Complete all easement documents to allow water main connection at Eagle's
Landing. (Water Utilities)
Arceneaux & Gates, Consulting Engineers, Inc., is requesting a preliminary plat of a
subdivision consisting of 18 lots and 2 reserves. This property is located east of Major and
north of Folsom Extension. In May, 2003, the City Council granted a specific use permit for
apartments for approximately the front half of the subject property. The property is about
evenly split between GC-MD-2 and RM-H zoning.
The property is to be developed as an apartment complex where each building is sold to
investors. Each building will contain 8 dwelling units. The areas not designated as lots or
reserves will be dedicated as common areas that will be maintained by the apartment
association.
A I O'water utility easement and a I O'general utility easement are being dedicated to serve the
development. A private driveway and the required number of parking spaces will be provided
for the use of the tenants.
A variance is being requested for the rear yard building setback requirement of 25'. Buildings
16, 17 and 18 have been located on the property in such a manner so as to avoid constructing
a structural building slab over a former drainage channel. The proposed setbacks for Buildings

16, 17 and 18 are 24.12', 13.04'and 19.41, respectively. The property backs up to a 100'wide
DD#6 drainage easement,
This plat was sent to all interested parties. The Fire Marshall expressed concern over the lack
of accessibility to Lots 9 and 12 in case of a fire. Staff spoke with the applicant and discussed
this item with him. Several options had been discussed with the Fire Marshall. The applicant
was instructed to talk with the Fire Marshall and satisfy his concerns.
Subject to approval of the plat, corrected copies will need to be submitted to the Planning
Division.

Enclosed for your consideration are 30 copies of the Preliminary Plat for "QUAIL, RUN" subdivision, 18
h)ls and 2 reserves will be created with this subdivision. The developer will be constructing a building
within each lot, with each building containing 8 dwelling units. The area of land not designated as a lot or
reserve will be dedicated as a common area. The total combined area of the lots and the common areas
shown on the Preliminary Plat exceed the minimum amount of 1500 square feet per dwelling vinit that is
required by the subdivision ordinance.
Also included with this submittal are 4 copies of the proposed utilities that will be serving this subdivision.
This utility exhibit includes the necessary drainage calculations. Although a copy of the proposed deed
restrictions and covenants are not included, they will be submitted with the Final Plat,
In addition, we also request a minor variance regarding the rear yard setback of 25 feet for RM-H zoned
property. Building Nos. 16, 17 & 18, have been located on the property in such a manner so as to avoid

The property immediately to the East and adjacent to the botiridary for which we are requesting a variance
has been conveyed, in fee, to the Jefferson County Drainage District No, 6 for the extension of a drainage
channel that will serve this and the other surrounding property. Therefore, there will be no buildings or
structures located on the District's property within 100 feet of the Easterly property line of Quail Run.
