Richardson, Planning Manager SUBJECT: Request for the abandonment of Vermont Avenue from a point approximately 125' west of M. L. King Parkway west to the Union Pacific Railroad right-of-way. FILE: 655-OB STAFF REPORT The Planning Manager recommends approval of this request. Mobil Pipeline Company wishes to abandon this portion of Vermont Avenue so that it may restrictpublic access to Mobil's existing pipelines and facilities. All lots adjoining this portion of Vermont are owned by Mobil Pipeline Company. The Water Utilities Division states that there is a 6" sanitary sewer line and a 1 1/4" water line in the right-of-way. However, the Water Utilities Division said that these lines would be capped and there is no need for an easement or relocation of lines in the subject right-of-way. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCES PURPOSES That certain tract, piece, or parcel of land containing 15,849 square feet (0.3638- acres) of land situated in the J. W. Bullock League, Abstract No. 7, in Jefferson County, Texas, and being out of a portion of that certain sixty (60') foot wide right-of-way for Vermont Avenue out of the Fourth Section of Lamar Addition to the City of Beaumont, conveyed to the City of Beaumont by plat dated October 17, 1939, recorded in Volume 6, Page 106 of the Map Records of Jefferson County, Texas. Said 15,849 square feet (0.3638-acres) tract of land being more particularly described by metes and bounds as follows: COMMENCING FOR REFERENCE at a 3/8-inch iron rod found marking the southeast corner of Lot 18, Block 40 of said Lamar Addition, out of a tract of land comprised of, Lots 18 and 19 conveyed unto Mobil PipeLine Company as recorded in Volume 1663, Page 11 of the Deed Records of Jefferson County, Texas, said corner also being the southwest corner of Lot 17, Block 40 of said LEGAL DESCRIPTION continued Lamar Addition out of a tract of land comprised of Lots 16 and 17 and the East Y2 of Lot 6 conveyed unto Clinton H. Richardson, AICP Planning Manager 801 Main Street, Suite 205 Beaumont, TX AUG 13 2003 Re: Application for Right -of -Way Abandonment Vermont Street, Lamar Addition Dear Mr. Richardson: Attached is an application from Mobil Pipe Line Company (Mobil) to abandon a portion of Vermont Avenue, an unpaved dedicated street, in Lamar Addition within the City of Beaumont. All lots adjoining this portion of Vermont Avenue are owned by Mobil Pipe Line Company. The Equipment Station Easement from Mobil Pipe Line Company to Southwestern Bell Telephone Company provides for the unimpaired access with the right of ingress and egress over existing roadways and such other routes as may be designated and approved by Mobil, therefore Mobil will not restrict Southwestern Bell's access upon abandonment of Vermont Avenue. There is no Union Pacific Railroad crossing at Vermont Avenue. The purpose of the abandonment is to restrict public access to Mobil's existing pipelines and facilities.
