Richardson, Planning Manager SUBJECT: Requests for abandonment of a 430' section of Burt Street, abandonment of a general utility easement in Block F, Oakwood Addition and re -dedication of a 50' section of Fulton Avenue. • STAFF REPORT The Planning Manager recommends approval of these requests for the abandonments and re- dedication. As part of its continuing redevelopment of this several block area of the Charlton -Pollard Neighborhood, ExxonMobil is requesting an abandonment of a 430' section of Burt Street, abandonment of a general utility easement in Block F, Oakwood Addition and rededication of a 50' section of Fulton Avenue. ExxonMobil owns all the property on either side of that 430' section of Burt Street. The general utility easement in Block F of the Oakwood Addition was put in place when the 20' wide alley was abandoned in 1932. ExxonMobil owns all the property on both sides of the utility easement. The 50' section of Fulton Avenue that is to be rededicated was abandoned in June, 2003 as pail of a larger abandonment request. At the time, it was thought that an individual lived in a house located on Lot 14, Block 16. However, it has since been discovered that the individual lives on Lot 13, thus necessitating the need to rededicate the 50' section of Fulton to provide access to that property. LEGAL DESCRIPTION FOR ORDINANCES PURPOSES Burt Street - That certain portion of Burt Street, 0,5911 acre tract situated in the David Brown Survey, Abstract 5, Jefferson County, Texas, also being out of and a part of Oakwood Addition, a plat recorded in Volume 4 Page 67, of the Map Records of Jefferson County, Texas, said 0.5911 acre tract being more particularly described by metes and bounds as follows: Note: The Basis of Bearings is along south right-of-way line of Van Buren Avenue between Holly and Grove Streets, having been called North 89*59'00" East in Clerk's File No. 9842565 of the Official Public Records of Jefferson County, Texas. STAFF REPORT continued BEGINNING at a 3/4" iron pipe found in the south right-of-way line of Burt Street for the northwest comer of Lot 13, Block 4 of said Oakwood Addition and the southwest comer of the said 0.5911 acre tract from which a Y2" iron rod found for the southwest comer of said Lot 13 bears South 00002'19" W 139.72 feet (called 140.00 feet); THENCE North 00*02'19" East a distance of 60.31 feet to a point in the north right-of-way line of said Burt Street and the south line of Lot 19, Block 2 of Hillside Addition, a plat of record in Volume 4, Page 182 of the Map Records of Jefferson County, Texas for the northwest corner of the said 0.5911 acre tract; THENCE North 89*58'15" East along the said north right -of --way line of said Burt Street and the south line of Block 2 of said Hillside Addition and Block B of said Oakwood Addition a distance of 430.36 feet to a point in the south line of Lot 3, Block B of Oakwood Addition for the northeast comer of the said 0.5911 acre tract; THENCE South 00*01'45" East a distance of 59.77 feet to a point in the said south right-of-way line of Burt Street and the north line of Lot 14, Block 5 of said Oakwood Addition for the southeast comer of the said 0.5911 acre tract; THENCE North 89058'08" West along the said south right-of-way line of Burt Street and the north line of Block 5 of said Oakwood Addition a distance of 122.85 feet to a 1" iron pipe found for the northwest corner of Lot 16, Block 5 of said Oakwood Addition and the northeast corner of Holly Street abandoned by Ordinance 03-047 dated June 24, 2003; THENCE North 89*58'43" West continuing along the said south right-of-way line of Burt Street a distance of 59.90 feet to a I" iron pipe found for the northeast comer of Lot 9, Block 4 of said Oakwood Addition and the northwest corner of said abandoned Holly Street; THENCE South 89048'13" West continuing along the said south right-of-way line of Burt Street and the north line of said Block 4 of Oakwood Addition a distance of 247.69 feet to the POINT OF BEGINNING and containing 0.5911 acres (25,748.32 sq. ft.) of land, more or less. The request for abandonment's are consistent with previous street and alley closure approvals for other Exxon -Mobil properties. Exxon -Mobil is developing an electrical sub -station (existing) and a cogeneration plant to more efficiently operate the refinery. Also, our previously abandonment application for Fulton Avenue should have stopped at 12 of Block 16, not Lot 13. Therefore we wish to rededicate that portion of Fulton Avenue fronting Lot 13. Legal descriptions are attached for the Burt Street abandonment and Fulton Avenue re -dedication. We would like to appear before the Planning Commission on October 20, 2003.
