Richardson, Planning Manager SUBJECT: Request for an abanddhment of a 3.83x 600'portion of Delaware Street right-of-way. FILE: 663-OB a ax-a-M The Planning Manager recommends approval of this request, Bob Morgan, President of Pecan Place Townhomes, Section Three, is requesting the abandonment of a 3.83' x 600' portion of the Delaware St. Extension right-of-way for the building of a masonry fence to separate the driveways and Delaware Street. Mr. Morgan states that the abandonment is necessary in order to provide clearance between the fence and the existing driveway and allow for the foundation. This item was sent to all interested parties. The Fire Marshall recommended denial of this request. He stated that the plans show a I O'wide driveway and the inclusion of a fence would restrict access to fire department equipment. There is a 16' wide easement at the rear of the property. Exhibits are attached, LEGAL DESCRIPTION FOR ORDINANCES PURPOSES That certain 0.0528 acre tract out of the Hezekiah Williams Survey, Abstract 56, Jefferson County, Texas, said 0.0528 acres being more particularly described by metes and bounds as follows: Basis of Bearings is along the east line of Pecan Place Townhomes, Section Three, ree, plats recorded in Volume 16, Pages 85 and 95 of the Map Records of Jefferson County, Texas and the westerly right-of-way line of Delaware Street (1 00-foot wide right-of-way having been called North 25058'14" East 897.48 feet. To provide clearance from the existing driveway and allow for the foundation necessary, this abandonment is necessary. As the Public Works Department has approved the request, we ask the Planning Department approve this as required.
