The Planning Manager recommends approval of this request,
Bob Morgan, President of Pecan Place Townhomes, Section Three, is requesting the
abandonment of a 3.83' x 600' portion of the Delaware St. Extension right-of-way for the
building of a masonry fence to separate the driveways and Delaware Street.
Mr. Morgan states that the abandonment is necessary in order to provide clearance between the
fence and the existing driveway and allow for the foundation.
This item was sent to all interested parties. The Fire Marshall recommended denial of this
request. He stated that the plans show a I O'wide driveway and the inclusion of a fence would
restrict access to fire department equipment. There is a 16' wide easement at the rear of the
property.

LEGAL DESCRIPTION FOR ORDINANCES PURPOSES
That certain 0.0528 acre tract out of the Hezekiah Williams Survey, Abstract 56, Jefferson
County, Texas, said 0.0528 acres being more particularly described by metes and bounds
as follows:
Basis of Bearings is along the east line of Pecan Place Townhomes, Section Three,
ree, plats
recorded in Volume 16, Pages 85 and 95 of the Map Records of Jefferson County, Texas
and the westerly right-of-way line of Delaware Street (1 00-foot wide right-of-way having
been called North 25058'14" East 897.48 feet.
COMMENCING at a 5/8" iron rod found in the westerly right-of-way line of Delaware
Street (100-foot wide right-of-way) for the southeast comer of Pecan Place Townhomes,
Section Three, (Lots I through 6-Volume 16, Page 85, M.R.J.C.);
THENCE North 25058'14" East along the east line of said Pecan Place Townhomes,
Section Three (Lots I through 6) and the said westerly right-of-way line of Delaware
Street (100-foot wide right-of-way) a distance of 80.00 feet (called North 25058'14" East)
to a point for the southwest comer of the said 0.0528 acre tract and the POINT OF
BEGINNING;

THENCE North 25*58'14" East continuing along the said east line of Pecan Place
Townhomes, Section Three (Lots 1 through 6), the east line of Pecan Place Townhomes,
Section Three (Lots 7 through 14-Volume J6, Page 95, M.R.J.C.), and said westerly right-
of-way line of Delaware Street (100-foot wide right-of-way) a distance of 600.00 feet
(called North 25*28'14m East) to a point for the northwest comer of the said 0.0528 acre
tract from which a 5/8' iron rod found for an exterior comer of said Pecan Place
Townhomes, Section Three (Lots 7 through 14) bears North 25058'14' East 217.61 feet
(called North 25058'14m East);
THENCE South 64001'46" East a distance of 3.83 feet to a point for the northeast comer
of the said 0.0528 acre tract;
THENCE South 25*58'14" West a distance of 600.00 feet to a point for the southeast
comer of the said 0.0528 acre tract
THENCE North 64*01'46" West a distance of 3.83 to the POINT OF BEGINNING and
containing 0.0528 acres of land, more or less.

Dear Sirs or Madams,
This application for right-of-way abandonment is requested to allow for building a
masonry fence to separate the driveways from exposure to Delaware Street, now tinder
construction.
To provide clearance from the existing driveway and allow for the foundation necessary,
this abandonment is necessary.
As the Public Works Department has approved the request, we ask the Planning
Department approve this as required.
