Richardson, Planning Manager SUBJECT: Request for an abandonment of a 600' undeveloped portion of Birmingham Street between Taylor and Fillmore. FILE: 665-OB The Planning Manager recommends approval of this request Subject to maintaining the abandoned right-of-way as a drainage/utility easement. Roy Gorman, the applicant, is requesting the abandonment of a 600' undeveloped portion of Birmingham Street located between Taylor and Fillmore. Mr. Gorman states that the reason for the request is that lie lives adjacent to the right-of-way and has problems with undesirable persons using this right-of-way. Mr. Gorman would like to place a six foot fence, running east and west, in the middle of the right-of-way between Taylor and Wilson to eliminate egress. This item was sent to all interested parties. No objections have been received, However, DD#6 and a number of utility companies wished to maintain easements. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCES PURPOSES Being a 60' x 300' portion of Birmingham Avenue between the south right-of-way line of Taylor Street and the north right-of-way line of Wilson Street and a 60' x 300' portion of Birmingham Avenue between the south right-of-way line of Wilson Street and the north right- of-way line of Fillmore Street, City of Beaumont, Jefferson County, containing 0.82 acres, more or less. REASONS FOR ABANDONMENT The area surrounding the R.O.W. has, according to Detective Boaz, one of the highest and most persistent crack dealing problems in the City of Beaumont. I live adjacent to -the R.O.W. and know of many an instance of dealing or of persons evading the police. The R.O.W. is a corridor for undesirable persons especially at night. Due to a deep ditch at the North side of Wilson St. which crosses the R.O.W., every person trespasses on my property (2350 Wilson). I wish to place a six foot fence centered on the easement (midway between Taylor & Wilson & parallel to them) to eliminate egress. I asked for permission to put in the fence but was told to pursue this process to be proper. The City would also benefit by an increase in their annual revenue. Thank You, �Roy Gorman 1, Roy A.
