ARegular Meeting and Joint Public Hearings of the Planning Commission and City Council
were held on November 28, 2005 with the following members present:

APPROVAL OF THE MINUTES
Commissioner Craig made a motion to approve the minutes of the Regular Meeting and
Joint Public Hearings held September 19,2005. Commissioner Kyles seconded the motion.
Motion to approve carried 6:0.

REGULAR MEETING
Replat-Beaumont Orange and Fig Addition: Request for the replat of Block 12 into
Blocks 12A and 12B, Beaumont Orange and Fig Addition.
Location: 9000 block of Phelan Boulevard
Applicant: Fittz & Shipman, Inc.
Mr- Richardson presented the staff report. The subject property is located at 8955
Phelan.
The property owner would like to subdivide her lot into two lots that both exceed
one acre in size. The replat meets all of the lot dimension requirements.
The request was sent to all interested parties. No negative responses were received.
Mr. Richardson recommended approval of the request.
Three notices were mailed to property owners within 200 feet. No responses in
favor or in opposition were returned.
Chairman Bodwin opened the public hearing and asked for the applicant's
comments.
John Holm of Fittz & Shipman, Inc. addressed the Commission,
Chairman Bodwin asked for comments in favor or in opposition. No comments
were made. The public hearing was closed.
Commissioner Hurley made a motion to approve the replat of Block 12 into Blocks
12A and -12B, Beaumont Orange and Fig Addition as requested. Commissioner
Craig seconded the motion. Motion to approve carried 6:0.
2) Vacation -Cottontail Trail Addition: Request for the vacation of Cottontail Trail
Addition.
Location: Lots 1-4, Cottontail Trail Addition
Applicant: Mark Whiteley & Associates, Inc.
Mr, Richardson presented the staffreport. Ina related item, the property owners are
requesting a replat of this subdivision. Because the restrictive covenants will be
amended, the recorded plat of the Cottontail Trail Addition must be vacated.
Mr. Richardson recommended approval of the request.
Chairman Bodwin asked for the applicant's comments.

Commissioner Leister made a motion to approve the vacation of Cottontail Trail
Addition as requested. Commissioner Hurley seconded the motion. Motion to
approve carried 6:0.
3) Rolat-Lots IA-3A. Geneva Estates Addition: Request for the replat of Lots 1-4,
Cottontail Trail Addition into Lots I A-3A, Geneva Estates Addition.
Location: 1, 2 and 3 Geneva Estates
Applicant: Mark Whiteley & Associates, Inc.
Mr, Richardson presented the staff report. The purpose of the replat is to rename
the subdivision and the street, decrease the number of lots from 4 to 3, and to amend
the -restrictive covenants. The street will remain private.
The request was sent to all interested parties. No negative responses were received.
Mr. Richardson recommended approval of the request.
Two notices were mailed to property owners within 200 feet. No comments in
favor or in opposition were returned.
Chairman Bodwin opehed the public hearing and asked for the applicant's
comments.

were made. The public hearing. was closed.
Commissioner Craig made a motion to approve the replat of Lots 1-4, Cottontail
Trail Addition into Lots IA-3A, Geneva Estates Addition as requested.
Commissioner Leister seconded the motion. Motion to approve carried 6:0.
4) Final Plat - Washington Village Parkway: Request for the final plat of Washington
Village Parkway.
Location: North side of Washington between 23' and Chamberlin
'Applicant: Faust Engineering and Surveying, Inc.
Mr. Richardson presented the staff report. This item is a request for a final plat of
Tracts A-C for the purpqse of dedicating Washington Village Parkway to the City,
a 65'wide drainage casement k to DD#6 and a temporary drainage casement to be
maintained by the property owner.

In 1995, a preliminary plat of Washington Village, Section One was approved.
Washington Village Parkway was part of that plat. The street was constructed but
was not accepted for maintenance and no final plat was recorded. In 1998, the City
inspected the street and public utilities and found them to be acceptable. At that
time, the water and sanitary sewer improvements were accepted by the City.
A final plat for the purpose of dedicating Washington Village Parkway is now being
submitted for the Planning Commission's approval. The difference between the
original plat and the one before the Planning Commission today is the addition of
Parcel "C" which is a drainage easement that will provide drainage for Washington
Village Parkway and is to be maintained by the property owner.
The request was sent to all interested parties. No negative responses were received.
Mr. Richardson recommended approval of the request.
Chairman Bodwin asked for the applicant's comments. The applicant was not
present.
Commissioner Hurley made a motion to approve Final Plat of Washington Village
Parkway located on the -north side of Washington between 23' and Chamberlin as
requested. Comn-dssioner Kyles seconded the motion. Motion to approve carried

Mayor Goodson called the Joint Public Hearings of November 28, 2005 to order and
explained the purpose of the joint hearing process and then turned the meeting over to
Chain-nanBodwin. She explained the policies and procedures' for the hearing process.
1) File 180 1 -Z: Request for a zone change from RM-H (Residential Multiple Family
Dwelling -Highest Density) to RS (Residential Single Family Dwelling) District or
more restrictive district.
Location: 7475-7655 Westhaven, 3840-4095 Cheryl, 4015-4090 Neumann, 4015-
4095 Blackwell
Applicant: City of Beaumont Planning Division
Mr. Richardson presented the staff report. In October, the majority of the property
owners within the Westhaven Terrace Addition came to CityCouncil to request that
the City initiates zone change for their subdivision. The subdivision consistsof 46
lots and is currently zoned RM-H. All of the developed lots are occupied by single
family homes.
Mr. Richardson recommend approval of the request.

Forty-nine notices were mailed to property owners within the subdivision and
within 200 feet. Twenty-seven responses in favor and one in opposition were
returned.
Chairman Bodwin opened the public hearing and asked for comments in favor or
in opposition.
Jackie Binks, 4295 Stephen Lane, addressed the Commission. Mr. Binks owns the
property directly adjacent to and north of the subject property. Mr. Binks asked for
clarification of the requested zone change.
JodieMarquardt, 4015 Neumann, addressed the Commission in favor ofthe request.
The public hearing'was closed.
Commissioner Leister made a motion to approve a zone change from RM-H to RS
District for the property at 7475-7655 Westhaven, 3840-4095 Cheryl, 4015-4090
Neumann, 4015-4095 Blackwell as requested in File 180 I-Z. Commissioner Craig
seconded the motion. Motion to approve carried 6:0.
2) File 1802-Z: Request for a zone change from RS (Residential Single Family
Dwelling) to GC -MD (General Commercial -Multiple Family Dwelling) District or
more re'strictive'district.
Location: 2748 and 2750 E. Lucas
Applicant: Thomas Cantue
Mr, Richardson presented the staff report. The property owner is requesting that
the north 267 feet of his property be rezoned to allow for the construction of
apartments. The south 150' of his property is zoned GC -MD. The property is
located at 2748 and 2750 E. Lucas.
Mr. Cantue states that he would like to develop his property with a meeting hall in
the GC -MD portion and the north part with apartments. Much of the surrounding
property is vacant or occupied with deteriorating houses.
While the nearest RM-H zoning on the north side of E. Lucas is approximately
2,900 feet to the east of the subject property, Mr. Richardson stated that it was his
opinion that RM-H zoning would be more appropriate than GC -MD, due to the
surrounding RS zoning.
Mr. RicAardson,recommended rezoning the subject property to RM-A.
Twenty-three notices were mailed to property owners within 200 feet. No
responses in favor and one in opposition were returned.

Chairman Bodwin opened the public hearing and asked for the applicant's
comments.
Thomas Caritue, the applicant, addressed the Commission and answered questions.
Discussion followed between Mr. Cantue, the Commission and staff regarding the
specifics of his request and possibly tabling his request.
Chairman Bodwin asked for comments in favor or in opposition.
Judy Leger, 827 Hillebrandt Acres Road, addressed the Commission, Ms. Leger
has rental property on Idy1wood and asked for clarification of the request.
Dixie Sorensen, 2590 E. Lucas, addressed the Commission and asked for
clarification of the request.
The public hearing was closed.
Commissioner Leister made a motion to table a request for a zone change from RS
to GC-IbM District at 2748 and 2750 E. Lucas as requested in File 1802-Z until the
January 23, 2006 Joint Public Hearing, Commissioner Hurley seconded the motion.
Motion to table carried 6:0..
3) File 1803-P: Request for an amended specific use permit to allow the replacement
of a screening fence. with a chain link fence for a landscape irrigation company in
a GC -MD (General Commercial -Multiple Family Dwelling) District.
Location: 950 Magnolia
Applicant: Mickey Phelan, III
Mr, Richardson presented the staff report. The present use of the subject property
is a landscape irrigation company.
The existing fence consists
sists of a chain link fence with plastic slats inserted. This
fence was required in 1998 when a pipe storage business received a specific use
permit.
Mickey Phelan, the property owner, states that over the past several years, the
plastic slats have resulted in the partial destruction of the fence on two occasions
and the total destruction of the fence during Hurricane Rita. To repair the fence
with the slats will exceed $24,000. The current tenant has agreed to stay in the
building, if Mr. Phelan will rebuild the fence, However, Mr. Phelan says that he
cannot justify the additional expense of the screening and the most assured
destruction of the fence during the next big wind because of the screening.
Mr. Richardson recommended approval of the request.

Commissioner Hurley made a motion to approve an amended specific use permit

4) File 1804-P: Request for a specific use pen -nit to allow a vocational training center
for people with disabilities in an RM-H District.
Location: 7650 Park North
Applicant: St. Giles Living Centers, Inc.
Mr. Richardson presented the staff report. St. Giles Living Centers, Inc. states that
the proposed facility will house a vocational assistance and training program for
persons with mental disabilities. Each morning, those individuals in need of
vocational training services will be dropped off at the facility. These persons will
receive instruction on various components of how to secure and retain employment
and related coaching and job training matters. St. Giles will provide the support and
management employees to work with the individuals in need of services.
Mr. Richardson recommended approval of the request.
Eighteen notices were mailed to property owners within 200 feet. No responses in
favor or in opposition were returned.

comments,
Jim Hazen, President of St. Giles Living Centers, Inc., addressed the Commission.
Chairman Bodwin asked for comments in favor or in opposition. No comments

Commissioner Craig made a motion to approve a specific use permit to allow a
vocational training center for people with disabilities in an RM-H District at 7650
Park North as requested in File 1804-P. Motion to approve carried 6:0.
