A Regular Meeting and Joint Public Hearings of the Planning Commission and City Council
were held on January 23, 2006 with the following members present:

Commissioner Hallmark made a motion to approve the minutes of the Regular Meeting and
Joint Public Hearings held December 19, 2005. Commissioner Johnson seconded the
motion. Motion to approve carried 6:0.

REGULAR MEETING
1) Preliminary Plat-Westchase Village: Consider the Preliminary Plat of Westchase
Village, Section Six, Lots 14-25, Block 2 and Amended Plat of Lots 28-29i Block
2, Section Five,
Applicant: Fittz and Shipman, Inc.
Mr. Richardson presented the staff report. The subject property will be accessed
by an extension of Deer Chase Drive. All public improvements will be constructed
to city standards.
The plat was sent to all interested parties. No negative responses were received,
Mr. Richardson recommended approval of the ,preliminary plat subject to the
developer providing the specific type of piping and manholes as required by
Engineering.
The applicant was present at the meeting.
Commissioner Johnson made a motion to approve the Preliminary Plat of
Westchase Village, Section Six, Lots 14-25, Block 2 and Amended Plat of Lots 28-
29, Block 2, Section Five as requested subject to the developer providing the
specific- type of piping and manholes as required by Engineering. Coinmissidner
Nejad seconded the motion. Motion to approve carried 6:0.
Councilperson Ames called the Joint Public Hearings of January 23, 2006 to order and
explained the purpose of the joint hearing process and then turned the meeting over to
Commissioner Dykeman. He explained the policies and procedures for the hearing process.
1) File 1802-Z: Request for a zone change from RS (Residential Single Family.
Dwelling) to GC -MD (General Commercial -Multiple Family Dwelling) District or
more restrictive district.
Location: 2748-2750 E. Lucas
Applicant: Thomas Cantue
(Commissioner Nejad abstained from File 1802-Z.)
Mr. Richardson presented the staff report. The subject request was tabled atthe
November meeting to allow the applicant to provide additional information on the
proposed meeting hall.

Thomas Cantue is requesting a zone change for the rear 267'of his property at 2748-
2750 E. Lucas. The front 150' of his property is zoned GC -MD.
In November, Mr. Cantue came to the Planning Commission and stated that he
wanted to build a meeting hall on the front part of his property and apartments on
the remainder. At the meeting, there was some discussion on how much of his
property would be needed for the meeting hall, Mr. Cantue did not have a site plan
at that time so the item was tabled.
Mr. Cantue now has a site plan of the meeting hall. As proposed, the facility.will
require the use of his entire property. He is therefore requesting a zone change for
the entire tract.
Mr. Richardson stated that he thought that GC-MD-2 and a specific use permit
would provide the Planning Commission and City Council the opportunity to place
reasonable conditions upon the property. Mr. Richardson had spoken with Mr.
Cantue about this option.
(Mayor Pro -Tern Samuel arrived.)
Mr. Richardson recommended GC-MD-2 zoning. A specific use permit would be
required at a later date.
Twenty-three notices were mailed to property owners within 200' of the subject
property. No responses in favor or in opposition were returned.
Commissioner Dykeman, acting as Chairman, opened the public hearing and asked
for the applicant's comments.
Thomas Cantue, the applicant, addressed the Commission.
Commissioner Dykeman asked for comments in favor or in opposition. No
comments were made. The public hearing was closed.
Commissioner Moor made a motion to approve a zone change from RS to GC-MD-
2 District for the property at 2748-2750 E. Lucas as requested in File 1802-Z.
Conitnissioner Hallmark seconded the motion. Motion to approve carried 5:0:1
(Nejad).
2) File 1807-P: Request for a specific use permit to allow an insurance office in an
RCR (Residential ConservatioA and Revitalization) District.
Location: 2633 North
Applicant: Ruben D. Lozoya

Mr, Richardson presented the staff report. In February, 2004, City Council
approved a specific use permit for the subject property to allow an ultrasound
imaging studio. That business has since closed.
The applicant, Ruben Lozoya, would like a specific use permit to allow his Farmers
Insurance office in the building. He is a licensed insurance and financial
representative with Farmers. Hours of operation will be 9 a.m. to 5 p.m., Monday -
Friday and on Saturdays by appointment.
Mr. Richardson recommended approval of the request.
Twenty-five notices were mailed to property owners within 200 feet of the subject
property. No responses in favor or in opposition were returned.
Commissioner Dykeman opened the public bearing and asked for the applicant's
comments.
Ruben Lozoya, the applicant, addressed the Commission.
Commissioner Dykeman asked for comments in favor or in opposition. No
comments were made.The public hearing was closed,
Commissioner Hallmark made a motion to approve a specific Use permit to allow
an insurance office in an RCR District at 2633 North as requested in File 1807-P.
Commissioner Kyles seconded the motion. Motion to approve carried 6:0,
3) File 1808-P: Request for a specific use permit to allow a business supplies and
engraving office in an RCR (Residential Conservation and Revitalization) District.
Location: 2628 McFaddin
Applicant: Christopher Santerre
Mr. Richardson presented the staff report. BizKit Business Supplies is requesting
a specific use permit to allow a business supplies and engraving business at 2628
McFaddin. This business would occupy one of two lease spaces in a structure that
currently houses an insurance office.
BizKit Business Supplies is moving from Orange to Beaumont. The firm provides
various blank legal documents (such as stock certificates) for corporate use,
embossers and engraving services.
Eighteen notices were mailed to property owners within 20Q feet of the subject
property. One response in favor and none in opposition were returned.
Mr. Richardson recommended approval subject to the following condition:

A modification to the landscaping/screening requirements along the east side
of the subject property (a 6' tall wood screening fence and no landscape, strip
along the east side).
Commissioner Dykeman opened the public hearing and asked for the applicant's
comments.
Christopher Kelly, 3434 West Martin, Pinehurst, addressed the Commission.
Commissioner Dykeman asked for comments in favor or in opposition. No
comments were made. The public hearing was closed.
Commissioner Nej ad made a motion to approve a specific use permit to allow a
business supplies and engraving office in an RCR District at 2628 McFaddin as
requested in File 1808-P, subject to the following condition:
A modification to the landscaping/screening requirements along the east side

Commissioner Johnson seconded the motion. Motion to approve carried 6:0.
4)* File 1809-Z: Request'for a zone change from RM-H (Residential Multiple Family
Dwelling -Highest Density) to GC -MD, (General Commercial -Multiple Family
Dwelling) District or more restrictive district,
Location: On the north side of Highway 105, approximately 800' west of the
intersection of Major Drive and Highway 105.
Applicant: Windemere Development Company
Mr. Richardson presented the staff report. This item is a request for zone change
from RM-H to GC -MD or more restrictive district for in 8.77 acre tract of land
located on Highway 105, west of Major Drive.
Wi-ndemere Development Company is requesting this zone change to allow it to
develop a retail facility on the property.
The Development Strategies Diagram designates this area as a "District Center".
A district center includes neighborhood shopping centers, professional offices and
a number of other higher density uses. All four comers of this intersection have
been developed with commercial uses. Development of this intersection will
provide much needed commercial facilities that will serve this rapidly growingpart
of the city.
Nine notices were mailed to property owners within 200 feet of the subject
property. No responses in favor or in opposition were returned.

John Johnson addressed the Commission on behalf of Windemere Development
Company.
Commissioner Dykeman asked for comments in favor or in opposition. No
comments were made. The public hearing was closed,
Commissioner Moor made a motion to approve a zone change from RM-H to GC -
MD District for property located on the north side of Highway 105, approximately
800'west of the intersection of Major Drive and Highway-105 as requested in File
1809-Z. Commissioner Johnson seconded the motion. Motion to approve carried
6:0.
