Richardson, Planning Manager SUBJECT: Consider a request for a 12 month extension for 1726-P FILE: Extension - 1726-P 61M—" The Planning Manager recommends approval of this request. On July 27, 2004, the City Council granted Mr. Jack Brooks a specific use permit to allow a financial advisor's office at 2175 Dowlen Road. Dr. Terry Syler is tinder contract with Jack Brooks to purchase the subject property. It is Dr. Syler's desire to construct a 2,500 sq. ft. orthodontist office at this location. Section 30-26 of the Zoning Ordinance states that unless construction is commenced and substantially underway within a two year period, the specific use permit becomes null and void. Dr. Syler is therefore asking for an extension to allow him time to construct his building. Section 30-26 also allows for a change from one use to another if the new use is not substantially different. The proposed orthodontist office building will be smaller than the previously approved building. As we discussed, Dr. Syler is under contract with Jack Brooks to purchase his approximate 13,700 square foot tract of land on Dowlen Road that has been approved by ordinance number 04-055 for a specific use permit allowing a 3900 square foot financial advisor office. Dr. Syler is purchasing the property to construct a -2500 square foot or less orthodontist office and is requesting that the ordinance be extended for a period of 12 months from the expiration date of July 27, 2006. This would allow Dr. Syler to submit his site plan to the city and allow your department to amend the ordinance rather than submitting a new specific use permit application.
