Preliminary Plat - Highpoin: Consider the Preliminary Plat of Hiurlipolint
Subdivision. Lots 1-36. Block t and Lots 1-29., Block 2 out of the W. Dyches
Survey.
Applicant: Carroll and Blackman, Inc.
N11r. Richardson presented the staff report. The Preliminary Plat consists of'65
single family residential lots that will be served by a private street. The property
is located on JUD Road, northeast of the Meadowlands Addition. The subdivision
will be built in two phases with a typical lot size of 50'x 158'.
The Subdivision Regulations state that a single outlet residential street shall not
serve more than 32 dwelling units. 65 lots are planned. The regulations also state
that a cul-de-sac street shall not exceed 800' in length. To compensate for this,
Flighpoint Avenue will be constructed to minor collector width (32' vs. 27) and an
oversized cul-de-sac radius will be constructed at the end of the street in Phase Two
(38.5' vs. 33').
Mr. Richardson recommended approval subject to the following conditions:
The sanitary sewer and water lines must be In 10' wide exclusive

N/Ir. Richardson presented the staff report. The abandonment request Is fora portion
of an unimproved 60' street right-of-way. This property is located to the west of
Adam's Self Storage at 650 11-1-10 S. Mr. Bruce Craig states that lie Would like to

abandon the right-of-way so that lie can clean it Lip and expand his self storage
business.
During the review of this request, DD#6's Hillebrandt Bayou facility is in-anediately
to the west of this right-of-way. Initially, DD#6 recommended denial of the request
because of the possible need of this right-of-way for drainage purposes. However,
DD#6 and Mr. Craig were in negotiation to swap properties thereby allowing for the
abandonment.
Before the meeting, Mr. Richardson stated that he did receive notification from
DD#6 that they had come to a written agreement with N11'. Craig so they have
dropped their opposition to the request.
Mr. Richardson recommended approval of the request.
Chairman Leister asked for the applicant's comments.
Bruce Craig, the applicant, addressed the Commission.
Commissioner Craig made a motion to approve the request to abandon the 60'right-
of-way from Fannin Street Ditch to 3 11.42' south as requested in File 675-013.

Sidney'rheriot with L. A. Unwired, the applicant, addressed the Commission. 'IMr.
Theriot asked for additional time to present new information on concerns that City
Council had. There were questions about whether or not existing Sites Could be
modified and they have modified their existing sites. He stated that they Would also
like time to do an additional study or have a study done on the land Values in and
around cell sites.
Discussion between the Commission, Mr. Theriot and staff followed.
Commissioner Hui -ley made a motion to approve the request for a new hearing prior
to the expiration of the 12 month waiting period as per Article V, Section 8 (2) of
the Planning Commission Bylaws for the property at 415 1-65 Gladys.
Comi-nissioner Craig seconded the motion. Motion to approve carried 7:2 (Leister,
Hallmark).
JOINT PUBLIC HEARINGS
Mayor Lord called the Joint Public Hearings of December 20, 2004 to order and explained
the purpose of the joint hearing process and their turned the meeting over to Chairman
Leister. She explained the policies and procedures for the hearing process.
File 1753-Z/P: Request for a zone change from LI (Light Industrial) to GC -MD
(General Commercial -Multiple Family Dwelling) District or more restrictive district
and a specific use permit to allow a halfway house in a GC -MD District.
Location: 885 Crockett
Applicant: Merrick Brown, Sr.
N11r. Richardson presented the staff report. The applicant, TIVIerrick Brown., wants to
operate a halfway house for up to 50 non-violent ex -offenders in air existing three
story structure. The former commercial building will be remodeled to house the ex -
offenders.
Clients will stay for periods of up to one year. Mr. Brown states that (Ile facility
will have on -site Supervision 24 hours a day.
The request could be considered spot zoning. The property to the north is zoned Hl.
The properties to the east, west and south are zoned LI. The Comprehensive Plan
desianates this area for Conservation and Revitalization. It is questionable whether
the proposed use would encourage revitalization of the area.

Mr. Richardson presented the staff report. The applicant, Leslee Jordan, wants to
operate a photography studio and website development business. The photography
will be all digital. Pictures will be uploaded to a facility in Iowa forprocessing. In
addition, Ms. Jordan will act as a broker between website creators and those who
need websites, She will display the work of various website creators for clients to
peruse.
Mr. Richardson recommended approval subject to the two conditions listed in the
staff report and with a modification of the landscaping/screening, requirements.

Mr. Richardson presented the staff report. In August, Bruce Craig requested a
rezoning of the subject property from GC -MD to RS and a replat to allow the
construction of 16 single family residences. The zone change was approved but the
plat was denied. In September, Mr. Craig submitted a plat for 14 residences and
was denied.
In November, Mr. Craig requested a waiver of the 12 month waiting period to allow
him to come back and request a zone change back to GC -MD.
Mr. Richardson recommended approval of the request.

estate/general o ffices on the subject property. Since that time, a 4,000 sq. ft.
building has been constructed. The property owner would like to lease a space to
Ms. Tompkins.

Currently, the ordinance requires Class B trees when landscaping is located under
overhead lines. Class B trees are defined as those that are less than 30, tall when
Mature. Very often, lines may be as low as 18 1/2' above tile ground. It is being
observed that some varieties of Class B trees are frequently exceeding the 30' height
and interfering with the overhead lines. There is also the spread of the trees that
must be contended with. There are varieties of trees that are 15' or less in height,
but there is the enforcement problem of how to ensure that those specific varieties
are planted.
Mr. Richardson recommended Section 30-31 N 2 f. be amended to read as:
If overhead lines are present along the perimeter landscape edge, no trees
will be required in that perimeter landscape edge.
Discussion between the Commission members.

Chairman Leister suggested reassembling the landscape committee for further
discussion on the request.
Commissioner Hurley made a motion to table the request for an amendment to the
Zoning Ordinance, Section 30-31, Landscaping and Screening Reqnirements, to
provide a list of plants to be planted when utility lines are overhead as requested in
File 676-OB until the landscape committee has met (within the next 45 days) and
reviewed the request. Commissioner Moor seconded the motion. Motion to table
carried 9:0.
12) File 677-OB: Request for an amendment to the Zoning Ordinance, Section 30-24B,
Permitted Use Table, and Section 30-33, Special Conditions, to prohibit cellular
telephone transmission towers within 200'of residentially zoned property.
Applicant: City of Beaumont Planning Division
Mr. Richardson stated that the request., if approved, Would result in the permitted
use table being amended to add a Special Condition 24 for Radio, Television,
Microwave and Cell Tower category.
A Special Condition 24 would be added to the Special Condition section that would
prohibit cell towers within 200' of residentially zoned property and the method of
measuring that distance.
Mr. Richardson recommended approval of the request.

Electronic reader board signs
Mr. Richardson stated that he had researched on the Internet and found that the
majority of the cities that he looked at prohibit scrolling or flashing messages but
do allow that messages change not more than four times per hour.
Mr. Richardson stated that he thinks four times per hour is more than adequate. He
suggested that the Commission might want to have even longer periods between
changing messages. The majority of businesses that now use changeable reader
boards signs are advertising specials and currently leave the copy up for one day or
more at a time.
Most of the cities also control the size of the reader board to a specific square
footage or percentage of total sign area.
Approval of the 2005 Planning Commission calendar
Commissioner Craig made a motion to approve the 2005 Planning Commission
calendar. Commission Hurley seconded the motion. Motion to approve carried 9:0.
