Commissioner Craig seconded the motion. Motion to approve carried 7:0. Planning Commission June 20, 2005 REGULAR MEETING 1) File 683-OB: Request for the abandonment of a portion of Pennsylvania Avenue right-of-way. Location: Pennsylvania and Emmett Avenue Applicant: Port of Beaumont Mr. Richardson presented the staff report. The Port of Beaumont is requesting this sliver of property that was acquired by the City as part of the Pennsylvania Avenue street improvements. The Port has acquired a lot adjacent to the subject property. The abandonment of the subject property would ensure unimpeded access to the Port's property. Mr. Richardson recommended approval. Chairman Bodwin asked for the applicant's comments. There were no comments. Commissioner Craig made a motion to approve the abandonment of a portion of Pennsylvania Avenue right-of-way as requested in File 683-OB. Commissioner LaBiche seconded the motion. Motion to approve carried 7:0. JOINT PUBLIC HEARINGS Mayor Goodson called the Joint Public Hearings of June 20, 2005 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Bodwin. He explained the policies and procedures for the hearing process. 1) File 1777-P: Request for a specific use permit to allow a recreational vehicle park in a C-M (Commercial -Manufacturing) District. Location: Intersection of Highway 69 and Highway 347 Applicant: Tri City Property Investments, L. P. File 1777-P was withdrawn by the applicant. 2) File 1784-P: Request for a specific use permit to allow an auto repair shop and car wash in an NC (Neighborhood Commercial) District. Location: 2795 Eastex Freeway Applicant: Caley's Automotive and Wash Works Mr. Richardson presented the staff report. Bruce Caley, the property owner, states that the subject property was originally developed as a service station in the 1980's. Gasoline sales ceased in the 1990's. Mr. Caley states that car repairs continued after PA Planning Commission June 20,2005 the cessation of gasoline sales. He would also like to wash cars by hand at this location. In March, 2005, the City Council denied a request to rezone this property to GC - MD. The intended use of the property, at that time, was to operate a used car sales lot. Mr. Richardson recommended approval of the request. Ten notices were mailed to property owners within 200 feet. One response in favor and two responses in opposition were received. Chairman Bodwin opened the public hearing and asked for the applicant's comments. Bruce Caley, the applicant, addressed the Commission. Chairman Bodwin asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Hurley made a motion to approve a specific use permit to allow an auto repair shop and car wash in an NC District at 2795 Eastex Freeway as requested in File 1784-P subject to the following conditions: Modification to the landscaping/screening requirement along the west property line. (8'tall wood screening fence and 10'wide landscape strip not required.) Adherence to the City of Beaumont stormwater standards. Commissioner Hallmark seconded the motion. Motion to approve carried 7:0. 3) File 1785-P: Request for a specific use permit to allow a residential care facility in an RM-H (Residential Multiple Family Dwelling -Highest Density) District. Location: 2390 Cartwright Applicant: New Beginning Adult Care. Mr. Richardson presented the staffreport. The subject property is located at the site of the old Sprott Hospital at 2390 Cartwright. Delisa Williams, the applicant, states that the facility will provide 24 hour care for up to 10 elderly and disabled persons. In addition, the facility will provide an activities program for its residents. Mr. Richardson recommended approval of the request. Planning Commission June 20,2005 Eighteen notices were mailed to property owners within 200 feet, One response in favor and one in opposition were returned. Slides of the subject property were shown. Chairman Bodwin opened the public hearing and asked for the applicant's comments. Delisa Williams, the applicant, addressed the Commission. Chairman Bodwin asked for the comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Craig made a motion to approve a specific use permit to allow a residential care facility in an RM-H District at 2390 Cartwright as requested in File 1785-P. Commissioner Kyles seconded the motion. Motion to approve carried 7:0. 4) File 1786-P: Request for a specific use permit to allow a duplex in an RS (Residential Single Family Dwelling) District. Location: 4625 and 4635 Corley Applicant: Sybil Comeaux, Mr. Richardson presented the staff report. Sybil Comeaux, the applicant, is requesting this specific use permit to allow her to build an enclosed breezeway between her home and her mother's house which is under construction next door. The addition between the two houses will include a sunroom, entry hallway and closet totaling 233 square feet. Ms. Comeaux states that her elderly mother is visually impaired. Connecting the homes would enable her mother safe access between the two houses. Mr. Richardson recommended approval of the request. Seventeen notices were mailed to property owners within 200 feet. One response in favor and one in opposition were received. Slides of the subject property were shown. Chairman Bodwin opened the public hearing and asked for the applicant's comments. Sybil Comeaux, the applicant, addressed the Commission and answered questions. Chairman Bodwin asked for comments in favor or in opposition. 2 Planning Commission June 20, 2005 David Mayer, owner of Champion Construction, addressed the Commission. Mr. Mayer is the builder of the proposed breezeway. Richard Price, 4725 Corley, addressed the Commission in opposition. He presented a petition with 12 signatures in opposition to the request. Cleveland Nisby, 4520 Corley, addressed the Commission in opposition to the request. Dora Nisby, 4520 Corley, addressed the Commission in opposition to the request. Mrs. Nisby read a letter from Theresa Tate, 4325 Cartwright, in opposition to the request. Byron Lewis, President of the 23' Street Neighborhood Association, addressed the Commission. Mr. Lewis presented a petition with 65 signatures in opposition to the request. Rebuttal by Mrs. Comeaux. The public hearing was closed. Commissioner Leister made a motion to deny a specific use permit to allow a duplex in an RS District at 4625 and 4635 Corley as requested in File 1786-P. Commissioner Hurley seconded the motion. Motion to deny carried 7:0. 5) File 1787-P: Request for a specific use permit to allow a drinking place in a GC -MD (General Commercial -Multiple Family Dwelling) District. Location: 1801 Washington Boulevard Applicant: Walter and Keith Broussard Mr, Richardson presented the staff report. Walter and Keith Broussard, the applicants, are requesting a specific use permit to allow a "Daiquiri King" on the subject property. The business would provide both seating for customers and a drive -through service. Beer, wine, daiquiris, snow cones and snacks would be served. Hours of operation will be 11 am to 10 pm, Monday through Thursday and 11 am to 11 pm, Friday through Sunday. Mr. Richardson recommended approval subject to the driveway onto Avenue E being 22'in width and moved a minimum of 10' away from the south property line and that an 8'tall wood screening fence and a 10' wide landscape strip be installed along the south property line of the subject property. 9 Planning Commission June 20,2005 Eighteen notices were mailed to property owners within 200 feet. Walter Broussard and Keith Broussard, the applicant's, addressed the Commission. Chairman Bodwin asked for comments in favor or in opposition. Vernia Jackson, 1850 Euclid, addressed the Commission in favor of the request. Terry Jackson, Associate Director of Land Manor, 1785 Washington Boulevard, spoke in opposition to the request. William James, 1785 Washington Boulevard, spoke in opposition to the request. Rebuttal by Walter Broussard and Keith Broussard. The public hearing was closed. Commissioner Leister made a motion to deny the specific use permit to allow a drinking place in a GC -MD District at 1801 Washington Boulevard as requested in File 1787-P. Chairman Bodwin seconded the motion. Motion to deny carried 4:3 (Hallmark, Kyles, Craig). 6) File 1788-Z/P: Request for a zone change from A-R (Agricultural -Residential) to GC-MD-2 (General Commercial -Multiple Family Dwelling-2) District or more restrictive district and a specific use permit to allow medical and professional offices and a daycare center. Location: East side of the Delaware, Extension, 106'northeast of Wilcox Lane Applicant: Beaumont Property Investments Mr. Richardson presented the staff report. Beaumont Property Investments, the applicant, would like to build offices for an optometrist and dentist as well as general professional offices. In addition, a children's day care center would be built. All ingress and egress will be offof Delaware. An 8'tall wood screening fence and 10'wide landscape strip will be installed along the south and cast property lines. The site plan shows monument signage in front of the three buildings. One multi - tenant detached owner identification sign will be required. .1 Planning Commission June 20, 2005 Mr. Richardson recommended approval subject to providing one detached multi - tenant owner identification sign. Forty-six notices were mailed to property owners within 200 feet. One response in favor and three in opposition were received. Slides of the subject property were shown. Chairman Bodwin opened the public hearing and asked for the applicant's comments. Dr. Peter Cass, the applicant, addressed the Commission. Dr. Cass is a partner in Beaumont Property Investments. Chairman Bodwin asked for comments- in favor or in opposition. Kimberly Traylor addressed the Commission in favor of the request. Mrs. Traylor is one of the owners of the daycare center that is proposed on the subject property. The public hearing was closed. Comments from the Commission followed. Commissioner Hurley made a motion to approve a zone change from A-R to GC- MD-2 District and a specific use permit to allow medical and professional offices and a dayeare center located on the east side of the Delaware Extension, 106' northeast of Wilcox Lane as requested in File 1788-Z/P, subject to the following conditions: • Provide one detached multi -tenant owner identification sign. • No exposed metal wall panels shall be allowed on the daycare building. Commissioner Leister seconded the motion. Motion to approve carried 7:0. 7) File 1789-Z: Request for a zone change from RS (Residential Single Family Dwelling) District to RM-H (Residential Multiple Family Dwelling -Highest Density) District or more restrictive district. Location: 1125 E. Lucas Drive Applicant: Statewide Consolidated CDC, Inc. Mr. Richardson presented the staff report. Rosetta Jones, Executive Director of Statewide CDC, is requesting this zone change so that they can build a 14 unit housing complex for persons with disabilities adjacent to the subject property. The zone change would enable that complex to be built without installing the required I O'wide landscape strip along the west property line. In April, 2004, City Council approved a zone change for property Statewide owns immediately to the east of the subject property. 0 Planning Commission June 20, 2005 At this time, Ms. Jones is requesting the zone change for the purpose of building the complex next door. However, eventual plans include a similar housing complex for the disabled on the subject property, as well, Sixteen notices were mailed to property owners within 200 feet. The applicant was not present. Chairman Bodwin asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Craig made a motion to approve a request for a zone change fromRS District to RM-H District at 1125 E. Lucas Drive as requested in File 1789-Z. Commissioner Kyles seconded the motion. Motion to approve carried 7:0. File 678-OB: Request for an amendment to the Zoning Ordinance, Section 30, to allow electronic reader board signs. Applicant: City of Beaumont Planning Division Mr. Richardson presented the staff report. At the May Joint Public Hearing, the Planning Commission instructed staff to bring to them some proposed regulations that would permit electronic reader board signs. Mr. Richardson stated that while he does not recommend such signs, he included in the staff report regulations that would allow detached electronic reader board signs in GC -MD and GC-MD-2 Districts only with a specific use pen -nit. The message copy would not change more than four times in a one hour period. Message copy would not include any flashing, flowing alternating or blinking lights or animation. Message copy would be limited to one color. For those areas of the city where sign faces can exceed 60 sq. ft., the portion of the sign that can be used for message copy cannot exceed 60 sq. ft. Chairman Bodwin opened the public hearing and asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Comments from the Commission members followed. M Planning Commission June 20, 2005 Commissioner LaBiche made a motion to deny a request for an amendment to the Zoning Ordinance, Section 30, to allow electronic reader board signs as requested in File 678-013.
