A meeting of the Board of Adjustment was held on February 6, 1997 with the following members
present:
Board Member Glenn Bodwin
Board Member Bob Harris
Board Member Mary Jowers
Board Member Dohn LaBiche
Board Members Absent: Board Member Chuck Mason
Also present: Stephen Richardson, Planning Director; Murray Duren, Senior
Planner; Tyrone Cooper, First Assistant City Attorney; Maria Trapp,
Planning Technician and Jill Cole, Recording Secretary.
APPROVAL OF MINUTES
Board Member LaBiche made a motion to approve the minutes of the January 2, 1997 Board
of Adjustment Public Hearing. Board Member Bodwin seconded the motion. Motion to
approve carried 4:0.
SWEARING IN OF WITNESSES
PUBLIC HEARING
1) File 394-BA: A request for a variance from the ordinance to allow a new accessory structure
to be placed on the interior side property line of a residential lot.
Location: 86521st Street
Applicant: Roger Kelly Donaldson, et ux
Mt. Richardson told the Board that the request was for a variance of the side yard requirement
of 2.5 feet,
The applicants would like to build an enclosed garage to replace an existing carport that now
sits in front of the original garage. The existing garage has since been converted into a den and
game room. Part of the structure, is also used for the storage of several motorcycles. Both the
garage and existing carport were built approximately within one foot of the north property line.

The house and garage were built during the late 1930's before any setback requirements. The
carport was built by previous owners.
The Planning Director recommended approval of the request because the application meets
Conditions A, B and C.
Sixteen notices were sent to property owners within 200 feet of the subject property. No
responses in opposition or in favor were returned.
Board Member Harris, acting as Chairman, opened the public hearing and asked for the
applicant's comments.
Kelly Donaldson, the applicant, addressed the Board. He told the Board that he had talked to
his neighbors and they had no problems with the construction of the garage. He mentioned the
existing narrow concrete drive and the location of the mature oak tree south of and next to the
carport. The garage will be built out of the same pointed cinder block as the old garage. He said
that he had some long-range plans to add on to the house.
Board Member Harris asked for comments in favor or in opposition. No comments were made.
The public hearing was closed.
Board Member LaBiche made a motion to approve the variance as requested in File 394-BA.
Board Member Jowers seconded the motion. Motion to approve carried 4:0.
