A meeting of the Board of Adjustment was held on April 2, 1998 with the following members present:

Board Member Joe Ashy
Also present: Stephen Richardson, Planning Director; Murray Duren, Senior
Planner; Tyrone Cooper, First Assistant City Attorney; Stanley
Hatcher, Planning Technician and Jill Cole, Recording Secretary.
APPROVAL OF MINUTES
Board Member Jowers made a motion to approve the minutes of the January 8, 1998 Board
of Adjustment Public Hearing. Board Member Roach seconded the motion. Motion to
approve carried 4!0.

PUBLIC HEARING
1) File 406-BA: A request for an area variance regarding a proposed owner identification sign
for a church in an RM-H (Residential Multiple Family Dwelling -Highest Density) District.
Location: 2955 S. Major Drive
Applicant: St. John Lutheran Church
Mr. Richardson told the Board that the request was for a variance from the maximum
allowable square footage of a sign proposed at 2955 S. Major Drive.
The property is zoned RM-H. The requested variance is from the required 20 square feet to
80.5 square feet.

St. John Lutheran Church is requesting the variance. In November 1997, the church asked
for and received a variance to the setback requirement for the proposed sign. At that time,
the church had also requested a variance to allow a 150 square foot sign. That variance was
denied.
The applicant has the burden of proving to the Board that the three conditions for granting a
variance have been met.
Twenty-six notices were mailed to property owners within 200 feet of the subject property.
One response in favor and none in opposition were returned to staff.
Board Member Harris, acting as Chairman, opened the public hearing and asked for the
applicant's comments.
Fred Heiner, Planning Committee Chairman for St. John Lutheran Church, addressed the
Board. He said the proposed sign is 10' 6" high, 7' 8" wide and approximately V 9" thick.
The sign has a 5' x 6' enclosed message board. The actual message board would be
approximately 30 square feet. The sign will be illuminated by lights placed to the top of the
sign and would be aimed down so they would not interfere with traffic or bother neighbors.
The church feels that the sign is only large enough to allow viewing from Major Drive. They
plan to landscape the sign the same way as the church and will be the same color brick. The
sign is large enough to post a short message and should eliminate the need for portable signs.
Mr. Heiner added that when the square footage of the sign was figured, they figured length
times height. When the square footage of the pyramid -shaped top is deducted, the total is
about 73.9', about six square feet less than the original figure.
Mr. Heiner answered questions from the Board. In response to Board Member Roach, Mr.
Heiner said they planned to build the sanctuary in the next 7-10 years.
Board Member Harris asked for comments in favor or in opposition.
Bob Mi1brath, President of the Church, spoke in favor of the request.
Board Member Harris closed the public hearing.
Discussion between Board members followed.
Board Member Roach made a motion to approve the variance request to allow an
approximately 80.5 square foot sign as requested in File 406-BA. Board Member Jowers
seconded the motion. Motion to approve carried 4:0.
