The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on May 25, 2021, at the City
Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following:

Pastor Tommy Williams with Trinity United Methodist Church gave the invocation. MayorAmes led

GENERAL BUSINESS
4. Consider an ordinance approving the rates proposed by Texas Gas Service Company.
On February 11, 2021, Texas Gas Service filed with the City of Beaumont an annual Gas
Reliability Infrastructure Program (GRIP) interim rate adjustment request to increase gas
rates in the Central -Gulf Service Area of the company. The Council, on March 23, 2021,
suspended the effective date of the proposed rate increase for a period of forty-five (45) days
in order to allow for the review of the company's filings for compliance with the Gas Utility
Regulatory Act. The review has been completed and it has been determined that the
company's filings comply with the GRIP statute.

5. Consider a request for a Specific Use Permit to allow a boat and RV storage facility in a GC -
MD (General Commercial -Multiple -Family Dwelling) District located at 8200 Phelan
Boulevard.
Will, Jake and Elaine Henderson - partners, are requesting permission to allow a boat and
RV storage facility at 8200 Phelan Boulevard. The property will also be used as an indoor
baseball training facility as well, but only the storage facility, consisting of fifty-five (55)
storage units, required a Specific Use Permit.
This property is adjacent to a residential neighborhood to the north. In order to minimize the
impact of a commercial use next door, directional lighting will be required. Adequate
landscaping has been proposed along those property lines shared with residential properties
and along the front of parking areas. In addition, a five (5) foot wide sidewalk will be required
and is shown on the proposed plan.
At a Joint Public Hearing held on May 17, 2021, the Planning Commission recommended 5:0
to approve the request for a Specific Use Permit to allow a boat and RV storage facility in a
GC -MD (General Commercial -Multiple -Family Dwelling) Districtwith thefollowing conditions:
1. All exterior lighting will be directional and shielded away from neighboring properties.
2. Landscaping shall be provided as required by Ordinance.

Ordinance — 21-031
6, Consider a request for a Specific Use Permit to allow a mortuary in an RCR (Residential
Conservation Revitalization) District located at 3510 Sarah Street.
Comeaux Community Mortuary & Crematory, L.L.C., is requesting permission to allow a
mortuary at 3510 Sarah Street. The project includes a 13,612 square foot structure and one
hundred ten (110) parking spaces.
This property is located less than a quarter (0.25) of a'mile from at least three (3) churches
and would be easily accessible for services,
The applicant states there will be ample landscaping and screening for the property, yet none
is shown on the site plan. Per ordinance, an eight (8) foot wood or masonry fence, and a ten
(10) foot wide landscaped border with trees will be required along the north and west
property lines. In addition, a six (6) foot wide landscaped buffer containing shrubs will be
required along both Sarah and Fatima Streets for the entire length of the parking area. Plans
show eight landscaped islands and eleven will be required.
At a Joint Public Hearing held on May 17, 2021, the Planning Commission recommended 5:0
to approve the request for a Specific Use Permit to allow a mortuary in an RCR (Residential
Conservation Revitalization) District with the following conditions:
1. Final plans will need to meet all requirements of the city F.O.G. backflow program
(Water Utilities).

Ordinance 21-032
7. Consider a request for a Specific Use Permit to allow a bar/poker room in an GC -MD
(General Commercial -Multiple -Family Dwelling) District located at 7211 Eastex Freeway,
Larry Bibbs is requesting permission to allow a bar/poker room at 7211 Eastex Freeway. A
poker room could be approved by right in the current zoning, but a bar requires a Specific
Use Permit. Admission to the poker room will be by membership only. Time slots will be
purchased by members for the desired play time. Plans are to open with a beer and wine
license then progress to a full bar. Food will not be prepared onsite. The existing shopping
center has adequate parking to accommodate the requested use.
The requested location is in the existing Market Basket shopping center located at the
intersection of Eastex Freeway and Highway 105. The proposed use would be compatible
with surrounding uses such as a liquor store and a smoke shop.

to approve the request for a Specific Use Permit to allow a barlpoker room in a GC -MD
(General Commercial — Multiple --Family Dwelling) District.

SPECIFIC USE PERMIT TO ALLOW A BARIPOKER ROOM IN A GC -MD (GENERAL COMMERCIAL -MULTIPLE
FAMILY DWELLING) DISTRICT FOR PROPERTY LOCATED AT 7211 EASTEX FREEWAY IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Turner seconded the motion.

Ordinance 21-033
8. Consider a request for an Amended Specific Use Permit to allow a training facility for Entergy
in an RCR (Residential Conservation Revitalization) District located at 4950 Plant Road.
Michelle Hawkins, of Entergy Texas, Inc., has submitted an application requesting addition
and expansion of a training facility at the Entergy Helbig Substation at 4950 Plant Road. A
Specific Use Permit (SUP) for a temporary training facility was approved in 1981 and
extended to allow for extra classrooms and parking in 1994. A SUP was approved in 2019
for expansion of the substation. Plans at this point are to construct a new state-of-the-art
permanent training facility. This location will serve the entire Entergy service area including
Texas, Louisiana, Arkansas and Mississippi. The property may also serve as a storm staging
area if needed.

The applicant states that the existing tree canopy will be preserved along the north and west
sides of the property. Although it is stated that formal landscaping will be completed in
accordance with City Ordinances, none is shown on the submitted site plan. As the parking
will be more than doubled, all parking will be required to be brought into compliance with the
City Landscaping Ordinance. Thirteen (13) landscaped islands will be required with existing
and proposed parking areas and a six (6) foot wide landscaped buffer containing shrubs will
be required along the property line between parking areas and Plant Road. In addition, a five
(5) foot wide sidewalk will be required along Plant Road for the width of the property.
At a ,Joint Public Hearing held on May 17, 2021, the Planning Commission recommended 5:0
to approve the request for an Amended Specific Use Permit to allow a training facility for
Entergy in an RCR (Residential Conservation Revitalization) District with the following
conditions:

EXPANSION OF THE ENTERGY HELBIG STATION IN AN RCR (RESIDENTIAL CONSERVATION
REVITALIZATION) DISTRICT LOCATED AT 4950 PLANT ROAD, WITH THE CONDITIONS, IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Durio seconded the motion.

Ordinance 21-034
9. Consider a resolution authorizing and confirming that the City Manager or his designee has
approval to receive funds from the Coronavirus State and Local Fiscal Recovery Funds
through the U.S. Department of Treasury.
The Coronavirus State and Local Fiscal Recovery Funds were established within the
American Rescue Plan Act. Over $350 billion from the total allocation is being provided to
State, Local, Territorial, and Tribal Governments to respond to the COVID-19 Emergency.
These funds will cover expenditures incurred between March 3, 2021 through December 31,
2024. Eligible uses of the funds include the following:
- Support public health expenditures and address negative economic impacts
- Replace lost public sector revenue
- Provide premium pay for essential workers

Invest in water, sewer, and broadband infrastructure
The total amount of funds expected to be allocated to the City is $33,084,864. The City
accepted and received $16,542,432 on May 19, 2021 and we expect to receive the
remaining amount in FY 2022.

Mayor Pro Tern Feldschau moved to APPROVE A RESOLUTION THAT THE CITY MANAGER, OR HIS
DESIGNEE, BE AND THEY ARE HEREBY AUTHORIZED TO ACCEPT CORONAVIRUS STATE AND LOCAL
FISCAL RECOVERY FUNDS THROUGH THE UNITED STATES. Councilmember Neild seconded the
motion.

Resolution 21-130
DISCUSSION ITEMS
Review and discuss the seating at the Civic Center
Emily Wheeler, Events Facility Director and Keith Folsom, Building Services Director,
reviewed and discussed the seating at the Civic Center. Ms. Wheeler stated that there has
been ongoing issues with the retractable seating at the Civic Center, she had a consultant
come out and perform an inspection on the seating, the consultant noted several failures on
the inspection and recommended that the staff not use the retractable seating. Mr. Folsom
proposed two options for the City Council to consider, he stated that once an option is agreed
upon, he will seek the services of an Architect to prepare the drawings and specifications for
the bid process, which will take approximately (3) three months. Mr. Folsom also stated that
the estimated costs are budgetary and will most likely change once the scope of work is
defined. The two options for Council to consider are listed below:
Option #1
A. Replace upper seating on the east, west, and south sides
B. Modify the balcony railing on the east, west, and south sides
C. Demo all the lower telescopic seating and utilize space for floor seating
D. Demo the north side upper seating and not replace
E. This option will add approximately 3,630 square feet of useable floor space
F. Estimated cost for Option #1 - $716,000
G. This option would allow for a seating capacity of 1,874 plus floor space for an
additional 1,000 seats (total seats 2,874)
H. This option does not prevent the city from installing the telescopic seating in the future

There was discussion and questions by Council, a directive was given to staff to move
forward with Option #1.
Review and discuss the lighting at Complex 4 located at the Athletic Complex
Keith Folsom, Building Services Director reviewed and discussed the lighting at
Complex 4 Athletic Complex, he stated that the facility was built in 1999. In the
early part of March there was one of twelve light poles that fell to the ground. After
investigating the issue, it was determined that the pole was rusted at the base with
severe oxidation at the ground level which weakened the pole. All other poles on
the field were checked, it was determined that all the poles were experiencing
severe oxidation, all poles have been removed. Council gave the directive to have
an Engineer take a look at the site and give some options as to whether the poles
could be saved. Dr. Sina Nejad, with Sigma Engineers spoke regarding the scope
of work, architectural and structural cost. The City Manager stated that they will
enter into a contract with Sigma Engineers with a, projected cost of about
$42,000.00, the firm will study the poles and come back to Council with a
recommendation.

Spoke to Council regarding his support and concern for the Municipal Transit employees,
stated that he supports the employees because he knows most of them, his concern is that
the union has been negotiating with First Transit for seven months to no avail, Council has
been told by the City Attorney and the City Manager to not get involved, he's not asking them
to sit at the table and negotiate the contract but he is asking that Council be concerned about
the citizens and the workers, Council should take into consideration the $24,000 that the
workers lost due to the winter storm, someone is trying to frame this as a contract negotiation
issue when it's not, this is an issue of fairness, the rest of the city employees that lost the
three days due to the winter storm received payment for those days, stated that a contract
isn't needed to pay the transit workers for the three days of lost wages, sounds like the transit
employees are being punished because they are a union organization, asked that Council

find out why there is still a deadlock on this contract, the vast majority of the transit workers
are citizens of Beaumont and support this community

REPLACE THE CURRENT GREEN AND WHITE SIGNS AT
LIBRARIES, CITY PARKS ETC, AS NEEDED, READ SEVERAL
EMAILS BETWEEN HIMSELF AND THE CITY MANAGER, ALSO
COMMENTED ON A SURVEY THAT HE POSTED ON HIS
FACEBOOK PAGE ASKING THE CITIZENS WHICH STYLE OF SIGN
THEY LIKED, STATED THAT HE RECEIVED OVER500 COMMENTS
REGARDING THIS MATTER, OVERWHELMINGLY THE CITIZENS
WERE IN FAVOR OF KEEPING THE GREEN AND WHITE SIGNS,
THEY ARE MORE VISIBLE AND WOULD LIKE TO SEE THEM
REFURBISHED INSTEAD OF REPLACED, THANKED
COUNCILMEMBERS NEILD AND TURNER FOR MEETING WITH
THE CITY MANAGER, THANKED THE CITY MANAGER FOR
AGREEING TO MAKE ANY FUTURE SIGNS THAT WILL BE
REPLACED TO BE MORE VISIBLE
COUNCILMEMBER TURNER - STATED THAT BEING AN AT -LARGE COUNCILMEMBER HE FELT
THAT IT WAS HIS DUTY TO LOOK INTO THE SIGN MATTER, HE
MET WITH THE CITY MANAGER ALONG WITH COUNCILMEMBER
NEILD, HE DISCOVERED THAT OVER THE LAST FIVE YEARS
WHICH IS ROUGHLY 1,825 DAYS, THERE'S BEEN ABOUT TEN
SIGNS THAT HAVE BEEN REPLACED, STATED THAT HE ALWAYS
WANTS TO DO RESEARCH FOR HIMSELF AND TO MAKE SURE HE
BRINGS FACTS TO THE TABLE, HE HAD A CONCERN WHEN
COUNCILMEMBER GETZ PUT THE STATUS OUT, HE SPOKE TO
COUNCILMEMBER GETZ TO DETERMINE WHAT WAS ONE OF THE
THINGS HE SAW THAT WAS THE BIGGEST ISSUE WITH THE
SIGNS, VISIBILITY WAS ONE OF THE BIGGEST ISSUES, STATED
THAT EVERY COUNCILMEMBER RECEIVED AN EMAIL ON LAST
WEEK STATING THAT MOVING FORWARD IF SIGNS WERE
CHANGED THEY WOULD BE VISIBLE AND THE SAME SIZE AS THE
GREEN AND WHITE SIGNS THAT WOULD BE REPLACED, WHAT
HE'S ASKING FOR AS A NEW COUNCILMEMBER IS FOR
EVERYONE ON THE COUNCIL TO WORK TOGETHER IN UNISON
AND TRY TO GET THE CITY OF BEAUMONT A CHAMPIONSHIP,
THE CITY OF BEAUMONT TRULY DESERVES A CHAMPIONSHIP,
BEAUMONT CITIZENS DESERVE BETTER ROADS,
INFRASTRUCTURE, ECONOMIC DEVELOPMENT, AS WELL AS
DOWNTOWN DEVELOPMENT, ASKED THATTHE COUNCIL WORK
IN UNISON TO GET THE CHAMPIONSHIP AND FOCUS ON THE
BIGGER ISSUES, THINKS THAT IF THEY ALL WORK TOGETHER
THEY CAN DO SO

REQUESTED ACTION: Council consider a resolution approving a contract with Tri-Can of
Beaumont to supply fuel for non -automated fuel sites.
BACKGROUND
The City maintains 15 non -automated fuel sites on City property, Bids were solicited for a
three-year contract to supply gasoline and diesel fuel, delivered to these sites. There is an option to
renew for two additional one-year renewals. Pricing is based on the Oil Price Information Service
(OPIS) published rates for Beaumont, Tx.
Bids were solicited fiom nine vendors. The sole response was received from Tri-Con Inc. who is
the current provider of this service. The price per gallon above the OPIS rate for unleaded and
diesel is $0.119. The delivery cost for diesel is $.059 per gallon. The price per gallon above the
OPIS rate in the previous contract was $0,1399 with the delivery cost for diesel being $.0289 per
gallon. The City's expenditure for the previous year was $316,932,43, The bid tab is attached.

BACKGROUND
The Texas Department of State Health Services (DSHS) has awarded the Beaumont Public Health
Department funding in the amount of $52,986.81 for the Hurricane Recovery Crisis Agreement
(Crisis CoAg). This onetime funding will assist the Health Department with a project to enhance
vector/mosquito control and surveillance in Jefferson County. The contract will be effective
upon date of execution and end on June 30, 2021.

The Department of State Health Services (DSHS) and City of Beaumont Public Health Department
(Grantee), Parties to that certain grant contract providing funding to the Hurricane Harvey Crises
Project, denominated DSHS Contract No. HHS000371500004 (the "Contract"), now want to
farther amend the Contract.
Whereas, the Hurricane Harvey Crises Project includes the Healthcare Infections Control
as a project component;
Whereas, the Parties want to reduce the funding amount allocated to the Healthcare
Infections Control; and
Whereas, the Parties want to amend Attachment B, Budget, and Attachment B-1,
Individual Project Budget(s), to reflect the decreased funding.
The Parties agree as follows;
1. Article IV of the Contract, Budget, is hereby amended by decreasing the funding amount
for the Healthcare Infections Control from $19,615,00 to $2,986.81, Therefore, the total
not to exceed Contract Budget is decreased from $69,615.00 to $52,986,81.
2. Attachment B —Budget, and Attachment B-1 — Individual Project Budget(s), of the
Contract are hereby amended as Attachment B -- Revised Budget v2, and Attachment
B-1 — Revised Individual Project Budget(s) v2.
3, This Amendment shall be effective as of the date last signed below.
d. Except as modified by this Amendment, all terms and conditions of the Contract remain
in effect.

THIS INTERLOCAL AGREEMENT Is executed this
day of
, 2021, by and between the COUNTY OF JEFFERSON,
STATE OF TEXAS, hereinafter referred to as "County," acting by and through its duly
elected and qualified County ,fudge, and the CITY OF BEAUMONT, TEXAS, a home -rule
city of Jefferson County, Texas, hereinafter referred to as "City," under the terms,
authority and provisions of the Interlocal Cooperation Act, Chapter 791 of the Texas
Government Code as follows:
WHEREAS, the Parties are each independently authorized, pursuant to Texas
Government Code Sec, 791,001 to enter into a joint agreement to provide a governmental
function or service which each party to the agreement is authorized to perform individually
for public health and welfare purposes pursuant to Texas Government Code 791.003
(3D), 791.013 (c); and,
WHEREAS, each party finds: 1) that the subject of this agreement is necessary for
the benefit of the public; and 2) that it has the legal authority to perform and to provide ,
the government function or service which is the subject matter of this agreement; and,
EXHIBIT "A"
WHEREAS, the City of Beaumont does not have the training or equipment suited
for such service; and,
WHEREAS, each governing body finds that the performance of this Agreement is
in the best interest of all Parties, that the undertaking will benefit the public; and,
WHEREAS, the total funding allocation is $60,382.81; and the City of Beaumont,
Texas Health Department agree to provide Jefferson County, Texas $50,382.81 from the
Hurricane Crisis Cooperative Agreement Projects Grant; and
NOW, THEREFORE, in consideration of the covenants, conditions and
undertakings hereinafter described, it is agreed:
1. Jefferson County shall furnish labor, equipment and chemical to provide
Aerial and Ground Adulticiding when and as determined at the discretion of the
Director for Jefferson County Mosquito Control District subject to the requirements
of Sea 791.003 of the Texas Government Code.
2. The City of Beaumont agrees to use the funding for the purchase of Fyfanon
Insecticide from Veserls,
3. The City of Beaumont agrees to act as buyer or purchasing agent of product
and will arrange for delivery to Jefferson County, Texas Mosquito Control District,
4. Each party to this agreement will be responsible for its own actions in
providing services under this agreement and shall not be liable for any civil liability
that may arise from the furnishing of the services by the other party.
5, The Parties further agree, pursuant to Sec, 791,015, Texas Government
Code, that any dispute regarding the terms of this agreement will be submitted to
an agreed upon mediator for resolution.

REQUESTED ACTION: Council consider a request for the conveyance and dedication of
private streets and infrastructure located in Wood Hollow
Townhomes, Sections 1 & 2 to the City of Beaumont.
BACKGROUND
Alan Cramer, President of the Wood Hollow Town Homes Homeowners Association, has
requested that the City of Beaumont accept maintenance of the private street known as Wood
Hollow Town Homes Private Drive, and its infrastructure. The City recently adopted a process
for the conversion of private streets and other infrastructure to public ownership and
maintenance (see attached). Also attached is an analysis of the condition of the existing private
infrastructure, conducted by the Public Works Department.
An analysis of the request was considered with the following responses:
Public Works/Engincering -- reject the request because it is a parking lot.
Water Utilities — a review of the plat and construction plans shows the water lines are located
within a utility easement dedicated to the City of Beaumont. Therefore, the City currently
maintains the existing water lines. The sewer Iines are not marked on the plats or construction
plans. It is recommended to reject the request until the sewer lines are located and reviewed.
Fire Department — Fire Marshal Condina reviewed the site and stated the property is more of a
driveway and not a street... It is recommended to reject the request because it is a parking lot.
Solid Waste — Solid Waste will not be able to offer residential garbage/heavy trash pickup to
these units as there is no place for garbage cans.
At a Joint Public Hearing held on May 17, 2021, the Planning Commission recommended 5:0 to
deny the request for the conveyance and dedication of private streets and infrastructure to the City
of Beaumont.

Attached for your review are the Public Works/Engineering, Water Utilities, Fire Department

Public Works/Engineering — reject request because it is a parking lot.

1. To initiate the process for acceptance of a private street and infrastructure, a written letter
must be submitted to the City Manager for consideration. The letter shall be signed by the
representative of the property owners' association (the "Association") or the rightful
owner authorized to dedicate the streets and infrastructure for public use. The application
must include copies of the recorded plat of all streets to be dedicated, any applicable
easement documents, any records of constiuction and repair of the strcots and
ir&astructrarc and any and all deed restrictions and home owners association rules and
amendments thereto. Upon the City's initial review, additional information may be
requested, The City will consider requests received on a first -come, first served basis,
2. The Public Works Director (the "Director") will inspect each street and ir&-astructure to
determine the condition.
3. The City Manager and staff will review and prepare the request for consideration by the
Planning Commission and the City Council. The Planning Commission will review the
proposal and make a recommendation to the City Council. The City Council shall
thereafter determine acceptance or rejection of the street and infrastructure.
4. If the City Council accepts the street(s) and infiastructure, the Director shall notify the
applicant of same.
Additional Standards. For _Acceptance
1. Trees, boulders and other large obstacles (other than mailboxes) located within three (3)
feet of the pavement shall be removed by the applicant if determined by the Director to
be unsafe or a traffic hazard.
Other Conditions of Acceptance:_ Maintenance
1. The City will document by photographic evidence, engineering reports, plans and tests,
the condition, composition and configuration (including pavement thicimess and width)
of the street at the time of application, If accepted, the City will have no obligation to
improve the condition or configuration of the street and/or infastructure,
2. The Association shall maintain all entrance monuments to subdivisions, including
lighting, painting, repairs and maintenance, If in conflict with City standards,
monuments may need to be altered or removed at the expense of the Association or
owner,
3 , The City will remove all trees on the right-of-way that die after the streets have been
accepted. Replacement of trees will be within the sole discretion of the City, All other
landscaping will. be performed at the expense of the Association or owner,
4. Entrance gates that prevent public access to streets, speed bumps and any other traffic
obstructions or devices will not be allowed on city maintained streets and must be
removed at the Association's or owner's expense,
5. Acceptance by the City of the responsibility to maintain streets does not include the
responsibility for maintenance of landscaping within the street right-of-way, landscaped
portions of eul-de-sacs, common ground, streetlights, or mailboxes within the right -of-
way.
6, As a condition of acceptance by the City of any street pursuant to these guidelines, any
and all documents deemed necessary by the City for final acceptance shall be executed by
the Association or owner,

RESOLUTION NO.
WHEREAS, on May 17, 2021, the City of Beaumont Planning Commission
recommended the denial of a request for the conveyance and dedication of private streets
and infrastructure to the City of Beaumont for Wood Hollow Townhomes, Sections 1 & 2;
and,
WHEREAS, City Council finds that the request to convert the private streets and
other infrastructure to public ownership is not in the best interest of the City of Beaumont;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT City Council denies the request to convert the private streets and other
infrastructure for Wood Hollow Townhomes, Section 1 & 2 to public ownership.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
