NOTE: This item was denied at the April 4,2002 Board of Adjustment meeting. The
Board has allowed her to come back this month with additional information.
STAFF REPORT
Lynda Makin, owner of the property, states that the building located at 1900 Broadway is used
primarily as a law office. In this building, she currently has four attorneys that rent space as
well as her own office. The terms of the rental contract that she has with each tenant states that
she will provide a sign for each business,
Ms. Makin has removed one existing sign. At the street comer, there are two signs at
approximately ninety degrees to each other. She would like put these two signs back-to-back
and then re -orient the double -sided sign to sit on the corner at an angle. The proposed sign
would be 29 sq. ft. in area. The Zoning Ordinance allows a maximum area of 12 sq. ft.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary
for a variance have been met.

My name is Lynda Kay Makin, owner, of the building located at 1900 Broadway @ 3rd
Street in Beaumont, which is used primarily as a law office. I currently have four
attorneys that rent office space from me and my office, LK Makin Inc, is also located in
this building. The terms of the contract with each renter states that I will provide a sign
for each business so that their clients can find the office and help advertise on their
behalf.
With the large number of attorneys in Beaumont, advertising is crucial and as a results of
these signs, these four attorneys have received "walk in" business and other referrals.
Our office is located on the comer of two busy streets and the current size of the signs (I I
x 33) is an adequate size so that the names can be read while driving. I have taken
several pictures from both sides of the street to better show the sign location and size.

According to Condition B of the Code section 30-37, 1 believe that an "Unnecessary
hardship" would be placed on not only myself financially, but that of my renters. To place
five individual's names, along with their title on a sign that is 3 x 4, would no longer
allow the names to be read while driving on either of the two main streets. This could
result in a reduction in their income and listing all of the attorney's names on one sign
could also be construed as the attorneys being in a firm and not four solo practitioners.
I am working with Glen Wise Sign Company, who originally put up all of our signs in
order to meet all of your requirements, those of my renters and stay within a reasonable
cost of doing business. I have priced the removal of two signs, creating one new sign
designating the parking area and have discussed other options on how to meet your
requirements for one sign with five individual's names and titles on it.

As a prudent business woman, I do not want to jeporadize my renters confidence in my
prior commitments and risk them leaving when their contract expires. Therefore, in an
effort to meet your requirements, I would like to request a meeting with the Board to
present another option to my special situation. Thank you in advance for your
consideration on this matter and I look forward to our meeting.
