SUBJECT: Request for variances from the 20 foot front yard setback, the 20 side yard setback and
the 15 foot rear yard setback requirements of Chapter 30-25 (b) to allow a 15 foot front
yard, a I foot side yard and a 14.5 foot rear yard at 1205 Franklin,
STAFF REPORT
Maurine Gray, the applicant and Director of Library Services, is requesting these variances to
the setback requirements in order to place an antique railroad dining car next to the Literacy
Depot at 1205 Franklin,
The Literacy Depot is in the former KCS Depot and is a city facility. Due to the demand for
service, the Literacy Depot has run out of room and wishes to add additional space through the
use of the dining car. The Kansas City Southern Railroad has a dining car which they are
willing to donate and are willing to lay the tracks on which the dining car would sit. The car
would then be restored and used for classrooms.
The dining car would be placed on the east side of the building, 15 feet from the front property
line, I foot from the side property line and 14.5 feet from the rear property line.
This property has a historic overlay on it. The placement of the dining car was approved by the
Historic Landmark Commission in April, 2002.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary
for a variance have been net.
