Richardson, Planning Manager SUBJECT: Request for variances from the 10' rear yard setback requirement and the 5' side yard setback requirement to 7' and T, respectively, FILE: 481-BA VW W W t6i 01 Porter's Carpets, the applicant and property owner, is requesting variances to the I 0'rear yard setback requirement and the 5' side yard requirement so that a 25' x 70' addition can be constructed on the rear of the existing building at 7628 Eastex Freeway. Porter's Carpets wants to expand its business in order to stock more material for sale to the public, The applicant states that the piece of property on which he wishes to expand is of no value for other than the proposed use and is the only area on which to expand. Directly behind the property is an Entergy sub -station and to the side of the property is the Spell Cemetery. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for a variance have been met. Exhibits are attached. VARIANCE SUPPLEMENTAL APPLI IC ATION FORM BEAUMONT, TEXAS (CODES SECTION 30-37 E.3) The Board of Adjustment has the power to grant variances where the following listed conditions have been met. Indicate how your application meets each of these conditions in the space following each condition, (The applicant has the burden of proof to demonstrate that all three of the conditions necessary for a variance have been met). Except as otherwise prohibited, the Board is empowcred"to authorize a variance from a requirement of the Zoning Ordinance when the Board finds that all of the following conditions have been met: CONDITION A: That the granting of the variance will not be contrary to the public interest.
