SUBJECT: Request for a variance of the required 40' side yard setback.
STAFF REPORT
Doguet's Rice Milling Company, the property owner, is requesting a variance to the 40' side
yard setback requirement in order to expand a warehouse at 685 S. Major Drive. They would
like to build the structure to within 10' of the property line.
In October, 2002, the City Council approved the rezoning of this 75' wide lot to LI, Light
Industrial. Because the property across Morgan Lane is zoned RS, Residential Single Family,
the Zoning Ordinance requires a setback of 40'. The applicant states that because of the lot
width they would be unable to expand the warehouse, as desired, if they must adhere to the
required setback.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary
for a variance have been met.

We would like to reguest a variance to build our warehouse 10 feet off the North
property line, bordering Morgan Lane. We would like to build a 90 ft, x 60 ft. metal
building. We are needing to add as much warehouse space as we possibly can. The
warehouse will not have any loud equipment or anything that would be disturbing to the
one residential lot across Morgan Lane.

The property is narrow (75 it.) in widLb, if we have to follow the
ordinance of 40 it, off the property line, we would not be able to
