Jose' Pastrana, Jefferson County Engineer, is requesting a variance to the maximum height
allowed for an owner identification sign from 50'to 57'. The sign is to be constructed at the
Southeast Texas Entertainment Complex at 5115 IH-10 South.
Mr. Pastrana states that the County looked at possible ways ofliowtomeet the 50'requirernent.
However, the County feels that the 57' height is needed if they are to achieve the advertising
and visibility that their experts recommend.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary
for a variance have been met.

SUBJECT: Variance Request for Height of Marquee at the Southeast Texas
Entertainment Complex (SETEC)

As we discussed a couple of weeks ago, we have a need to install a marquee at the
SETEC. That sign, as designed for optimum viewing effectiveness and advertising
potential, is 57 feet high. It has come to our attention that city ordinance limits the height
of the marquee to 50 ft. We have looked at possible ways of how we might meet the 50
ft. requirement, but we feel that the 57 fti size is needed if we are to achieve the
advertising and visibility that the experts recommend. We, therefore, request a variance
to the height requirement (variance supplemental form is attached).
We feel that the granting of this variance will not be contrary to the public interest and
that the spirit of the ordinance will be maintained as the sign is very attractive and stands
alone; so it would be extremely difficult for someone to establish its height by just
looking at it. Additionally, we feel that reducing the height would result in unnecessary
hardship due the potential losses in advertising and sales.
