SUBJECT: Request for variances to the minimum side yard setback from 5' to 4' 6" and to the
minimum rear yard setback from 25'to 2' 10".

STAFF REPORT
The U. S. Department of Housing and Urban Development has been deeded this property at
5495 Greenbriar Lane as the result of a foreclosure by the lender. First Preston, the contractor
for HUD, has been engaged to secure, appraise and sell the property for HUD.
During its research to prepare the property for sale, First Preston discovered that the previous
owner had built some structures beyond the rear building setback line. In addition, the
northeast corner of the house is built 6" into the side building setback.
HUD is asking that the Board of Adjustment approve these building setback encroachments so
that the sale of the property can proceed.
The applicant shall have the burden of proof that all three conditions necessary for approval
have been met.

The above referenced property is a foreclosure where the lender has deeded the propertv
to the U, S. Department Of Urban Developinent (HUD). First Preston the contractor for
HUD has been engaged to secure, appraise, and sell the property for HUD, In our
research some to prepare the property for sale we have discovered h

Attached you will find a survey Of the property. HUD is requesting a variatice on the set
back because there are additions that have been built beyond the setback litre at the back
of the Property. The structures in question are noted in yellow, Enclosed you will also
find a COPY of a building permit that allowed for construction of a VX 24' concrete patio
or stab that exterids; past the set back line.
The approval of the requested variance will allow First Prestoli to list the property and
bopefully sell it quickly.
