BOARD OF ADJUSTMENT
November 6, 2003
City Council Chambers
A meeting of the Board of Adjustment was held on November 6, 2003 and called to order at 3:00
p.m. with the following members present:
Chairman Bob Harris
Board Member Pat Avery
Board Member Dana Timaeus
Alternate Member Gladys Allen
Board Members absent: Board Member Joey Hilliard
Board Member Mary Jowers
Alternate Member Sam Pullig
Alternate Member Justin Howard
Also present: Stephen Richardson, Planning Manager; Tyrone Cooper, First
Assistant City Attorney; Jill Cole, Recording Secretary; Adina
Abshire, Planner
APPROVAL OF MINUTES
Alternate Member Allen made a motion to approve the minutes of the October 2, 2003 Meeting.
Board Member Timaeus seconded the motion. Motion to approve carried 4:0.
SWEARING IN OF WITNESSES
PUBLIC HEARING
File 509-BA: A request for a variance to the minimum allowable side yard setback from
101 to 3'6".
Location: 2348 Rusk Street
Applicant: Alice Ashy

Mr. Richardson stated that the request to the exterior side yard setback is for a new carport
and covered walkway.
Alice Ashy, the property owner, went before the Historic Landmark Commission to get
approval of a certificate of appropriateness for the design of the carport and covered
walkway. The carport will be located behind the house and entered off of Minor. The
covered walkway will connect the carport to a deck on the west side of the house. Ms.
Ashy intends to re -orient the stairs so that they face north, toward the carport.
In order to line up the carport and covered walkway with the existing house and deck, the
3' 6" side yard is required. The existing porch is approximately 4' 6" from the property
line.
The applicant shall have the burden of proof to demonstrate that all three conditions
necessary for a variance have been met.
Twenty-four notices were mailed to property owners within 200 feet. Two responses in
favor and none in opposition were returned to staff.
Slides of the subject property were shown.
Discussion followed between Mr. Richardson and the Board.
Chairman Harris opened the public hearing and asked for the applicant's comments.
Jack Seeley, contractor for Mrs. Ashy, addressed the Board. Mr. Seeley stated that the
carport will be 24' wide and 30' deep and the last 10' will be enclosed for storage. The
structure and exterior trim will be hardi-plank and will be painted the same as the house.
Chairman Harris asked for comments in favor or in opposition. No comments were made.
The public hearing was closed.
Discussion followed between Board members.
Board Member Timaeus made a motion to approve a request for a variance to the minimum
allowable side yard setback from 10' to 3' 6" for the property at 2348 Rusk Street as
requested in File 509-BA. Board Member Avery seconded the motion.
The vote on the motion for File 509-BA follows:
