STAFF REPORT
Faust Engineering & Surveying, Inc., the applicant, is requesting a variance to the front yard
building setback to allow the construction of a new residence at 4690 Glen Oaks Circle.
The Board of Adjustment granted this property a 15'front yard building setback in March, 2004.
However, the house layout as originally submitted for review by the Board of Adjustment had
a dimensional error. The error was not detected until after the foundation had been placed on the
lot. This request would adjust the building setback line to reflect the footprint of the building.
The applicant states that the reason for the encroachment is the shape of the lot. The lot is
basically triangular in shape. To be able to construct the proposed house on the property will
require the encroachment. The applicant states that the property owner attempted to design a
house that fits the lot but was unable to any satisfaction.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary
for the approval of a variance have been met.

Dear Sirs,
Please find an Application for Variance in reference to the property at 4690 Glen Oaks
Circle, Beaumont, Texas. The legal description of the property is Lot I of Glen Oaks
Addition. The request is for a reduction of the front building setback line from 15 feet to
the setback shown on the plat.
Attached is a completed Application and Letter addressing the three (3) conditions sited
on the Variance Supplemental Application Form and Exhibit illustrating the conditions.

Variance Supplemental Application Form
The granting of this variance will not be contrary to the public interest. The variance will
allow the property owner to construct a residence on the property which will insure that
the property does not become overgrown with underbrush and the residence will control
the drainage on the site. The residence will provide a much more attractive entrance into
the subdivision. The house layout as originally submitted for review by this board had a
dimensional error. The error was not detected until after the foundation had been placed
on the lot. This request would adjust the building setback line to reflect the footprint of
the building.

The property is an odd shaped lot (see attached sketch) and does not lend itself to a
conventional block style home. The owner has attempted to design a structure to fit the
lot; however, due to the shallowness of the property on its north line, the structure still
overlaps the originally platted front setback line. The typical lot in the subdivision is 120
feet in depth and 60 feet in width. The depth of this lot is 109 ft. The variance is
requested due to the narrowness of the property along the north line and the unusual
shape of the property.
CONDITION C
The City of Beaumont Zoning Ordinance has provisions for reducing the front building
line of residential lots in a cul-de-sac. This provision recognizes the challenges in
placing a structure on a lot having unusual dimensions and reduced lot depth. This
request is that this same consideration be granted to this property.
