STAFF REPORT
Bill Neild, the applicant, is requesting a special exception to the minimum front yard setback
to allow for the construction of a new house at 110 Summerwood. The proposed front setback
would be 20' instead of the required 25'.
Summcrwood, Section 2 is a private street, zero lot line development that was platted in 1977.
The property was originally platted with a 20' front yard setback. However, the current Zoning
Ordinance requires that a 25' front yard setback be maintained. Mr. Neild states that all the
other homes in the subdivision were built with a 20' front yard setback.
There are a number of setback constraints on the subject lot. Because the lot is a corner lot,
there is a 10' setback requirement along the north property line. At the rear

be set back at least 10' along the south side. Mr. Neild states that because of the Various setback
constraints, he is losing 22 6 of available land for construction. According to \Mr. Neild, the
chairman of the subdivision's architectural committee has recommended approval ofthe special
exception to the setback.
The Zoning Ordinance allows a special exception to a setback requirement for yards on corner
lots.
