BACKGROUND The SCBA will be purchased from Municipal Emergency Services, Inc., of Houston, in the amount of$113,492.62. The Fire Department has determined that twelve(12) complete SCBA units,twenty-five(25)45-minute cylinders,twelve (12) SCBA flow test and forty(40) face masks require replacement this year. The Fire Department must periodically replace old and/or defective SCBA units and related equipment. The units provide breathing air to firefighters while engaged in firefighting activities. Pricing for the equipment was obtained through the Houston-Galveston Area Council (H-GAC) purchasing cooperative, which provides cities and political subdivisions with the means to purchase specialized equipment at volume pricing. H-GAC complies with State of Texas procurement statues. FUNDING SOURCE Capital Reserve Fund. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BACKGROUND The City of Beaumont and DD6 are working together to make improvements to the City's drainage infrastructure in the area of Washington Boulevard and 80 Street. The City will purchase and supply pipe and appurtenances for the utility adjustments and installations, and supply manpower to make tie-ins and lay water and sewer lines. DD6 will be installing the culverts under 8`h Street new Washington Boulevard and make repairs to concrete and asphalt City roads damaged during the construction of the project. The estimated time for completion is seven(7) to eleven(11) weeks and shall not exceed fifteen(15) weeks weather permitting. DD6 received a grant from FEMA that is being administered by the Texas Water Development Board. Asa part of the grant, DD6 agrees to reimburse the City for 100% of the costs, not to exceed $70,000.00, related to water and sewer line adjustments that will be performed to allow for the culvert installation. FUNDING SOURCE Capital Program—Water Utilities Fund. The estimated cost to be paid by the City is $70,000.00. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and he is hereby authorized to execute an Interlocal Agreement between the City of Beaumont and Jefferson County Drainage District No. 6 (DD6) for the Elinor Street Project. The Interlocal Agreement is substantially in the form attached hereto as Exhibit "A" and made a part hereof for all purposes. PROJECT UTILITIES ADJUSTMENTS Between JEFFERSON COUNTY DRAINAGE DISTRICT NO. 6 and THE CITY OF BEAUMONT SPATE OF T E X A S § COUNTY OF JEFFERSON § This Agreement between the Jefferson County Drainage District No.6,a special district of the State of Texas(hereinafter called"DISTRICT") and the City of Beaumont,a home rule city of the State of Texas (hereinafter called "CITY") under authority of the Interlocal Cooperation Act, Chapter 791 of the Texas Government Code. WHEREAS the DISTRICT and the CITY are working together to make improvements to the City's drainage infrastructure in Beaumont,Jefferson County,Texas, in the area of Washington Blvd. and 8`" Street under City streets; WHEREAS, the DISTRICT is installing culverts,under 8" Street near Washington Blvd; WHEREAS, the CITY owns and maintains the afore-mentioned streets, and the DISTRICT and the CITY are desirous of reciting in writing,certain duties and obligations between the parties hereto with regards to this Elinor Street project; THEREFORE,the DISTRICT and the CITY agree as follows: Page I EXHIBIT "A" WITNESSETH 1. The DISTRICT agrees to reimburse the CITY for one hundred (100%) of their costs, not to exceed $70,000.00, related to water and sewer line adjustments that will be performed to allow for the culvert installations; 2. The CITY will purchase and supply pipe and appurtenances for the utility adjustments and installations. The CITY will supply manpower to make tie-ins and lay water and sewer lines; 3. The DISTRICT will competitively procure materials,manpower,and equipment to make repairs to concrete and asphalt CITY roads damaged by the DISTRICT during the construction of the project(s). The estimated time frame for completion is seven (7)to eleven (11) weeks and shall not exceed fifteen (15) weeks weather permitting; and 4. On a monthly basis or greater, at its convenience, the CITY will invoice the DISTRICT for one hundred(100%)of the costs to date, up to $70,000.00 for utility adjustments. The invoice will include all back-up documentation thatjustifies the invoice amount, such as material invoices, equipment use cost, labor cost, and contractor invoices. If a contractor is used, documentation must be provided to prove the contractor was hired using a fair method to solicit the bid(s) and the lowest bidder or bidder to the best interest of the DISTRICT was hired. All contractors must be checked for disbarment and proof of the verification must be provided. The DISTRICT will then reimburse the CITY for one hundred (100%) of the total costs invoiced. All documentation for expenses must be in a format accepted by the Texas Water Development Board (TWDB) as the administrator of this grant for TEMA. 5. The DISTRICT shall reimburse the CITY within thirty(30)days of the date of the invoice. If an invoice is in dispute and cannot be resolved among the parties; the issue shall be mediated by a mutual approved mediator.The cost for mediation shall be divided evenly between the parties. 6. BACKGROUND On March 19, 2019, by Resolution 19-064, City Council awarded a contract to Chief Solutions, Inc., of Houston,for the Sewer Lift Station Wet Well Cleaning Contract Project in the amount of $390,000.00. Proposed Change Order No. 1, in the amount of$57.72, is required to adjust the estimated quantities in the contract to reflect the actual quantities used in the completion of the project. If approved, the final contract amount will be$390,057.72. The project has been inspected by Water Utilities and found to be complete in accordance with the provisions and terms set out in the contract. Acceptance of Change Order No. 1, maintenance, and final payment in the amount of$19,502.89 is recommended. FUNDING SOURCE Capital Program. RECOMMENDATION Approval of the resolution. BACKGROUND On January 12,2021, City Council approved Resolution No. 21-002 granting ExxonMobil Oil Corporation a fifty foot(50') wide pipeline easement and a thirty foot(30') wide temporary work space easement to transport liquid hydrocarbons. ExxonMobil Oil Corporation is requesting additional work space for the project. ExxonMobil Oil Corporation has agreed to pay$1,400 to the City of Beaumont for the temporary use of city-owned property. The temporary access road is described as being a ten foot (10')wide temporary access road having a total length of 111 feet situated in the C. Hillebrandt Survey, Abstract No. 28. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. WHEREAS, on January 12, 2021, the City Council of the City of Beaumont, Texas, passed Resolution No. 21-002 authorizing the City Manager to execute a pipeline easement and temporary work space easement to ExxonMobil Oil Corporation for consideration of$482,409.00; and, WHEREAS, ExxonMobil Oil Corporation has requested the City to grant one (1) additional ten foot (10') wide temporary work space for an access road situated in the C. Hillebrandt Survey, Abstract No. 28, as described and shown in Exhibit "1," attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT- THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City Manager be and he is hereby authorized to execute the Temporary Workspace Agreement or Temporary Access Agreement as described above with ExxonMobil Oil Corporation for consideration of$1,400.00. Notification of Seizure -When contraband is seized pursuant to Chapter 59 of the Texas Code of Criminal Procedure by BPD, the seizing officers shall promptly notify the District Attorney of the seizure as follows: 1. The seizing officer shall notify the District Attorney in writing within seven days following the seizure, either in person or by facsimile addressed to Hams County District Attorney, 500 Jefferson Street, Suite 600, Houston, Texas 77002, Attention: Asset Forfeiture, facsimile # (713) 437-4967. This document shall be referred to as the "Notice of Seizure." The "Notice of Seizure" shall contain: A. The name and address, if known, of the person found in possession of the property, or if no person was found in possession of said property, the seizing officer shall so state. E. The name and address, if known, of the owner of the property seized, or if the name and address of the owner is unknown to the seizing officers and by the use of due diligence may not be reasonably ascertained, the seizing officer shall so state. F. The name and address, if known, of any person who claims a security interest in the property and the amount of such interest. G. Major Drive. BACKGROUND In January of 2016, Vera Bagneris received a Specific Use Permit to provide 24 hour care for twelve (12) elderly residents at 2990 S. Major Drive. Caretakers would be present 24 hours per day, but not living at the property. Some of the clients residing in this facility would require nursing and ambulatory care. Some residents may have limited mobility. Ms. Bagneris would like to expand and accommodate sixteen(16) clients. Property to the north was purchased and is currently zoned RS (Residential Single -Family Dwelling). In order to consider a Specific Use Permit on this additional land,it will need to be rezoned from RS to RM-H (Residential Multiple-Family Dwelling--- Highest Density) to match the existing assisted living facility. Ms. Vargas requested and was approved for a waiver to any additional landscaping in 2016. A four(4) foot chain link fence was located along the north and west property lines, with no existing landscaped buffers or fence along the south property line. As this request involves new construction and an increase of more than 25%, all landscaping requirements will need to be met including landscaped buffers along the west and north property lines and perimeter landscaping for parking areas. In addition, all new outdoor lighting must be shielded to protect neighboring properties. Beaumont Fire indicates that due to the expansion of the facility, additional water supply(fire hydrant)may be required depending on the installation of fire protection equipment per IFC (International Fire Code) requirements. At a Joint Public Hearing held on April 19, 2021,the Planning Commission recommended 5:0 to approve the request for a Revised Specific Use Permit and a Rezoning from RS (Residential Single-Family Dwelling)to RM-H (Residential Multiple-Family Dwelling—Highest Density) District for a portion of the property to allow the expansion of an assisted living center with the following conditions: 1. The price per transit bus is $519,497 with delivery to the City in approximately 12 months.The Federal Transportation Administration(FTA)requires that the new buses to be operated until they reach 350,000 miles or 10 years of age. The buses that we being retired had to be in service for twelve (12) years or exceed 500,000 miles. The City is replacing eight buses that were acquired in February 2009. All buses that are removed from service will be placed on auction or disposed of according to grant guidelines. City Council conducted a Work Session on January 28, 2020, authorizing staff to apply for a grant to replace three CNG buses, with a local match of$787,500. BACKGROUND In April 2020, soon after the onset of Covid-19 in Beaumont, City Council authorized the waiving of transit fares. The purpose was to allow for better social distancing between drivers and riders in order to reduce the spread of the virus. This combined with on-site testing of drivers and staff, limitation and spacing of passengers, provision of PPE and contracting for regular deep cleaning has helped to limit the impact of Covid through the transit system. As a result, the transit system never reduced service during the pandemic. Now that Covid-19 cases are declining and vaccinations have been offered to all transit drivers and staff, we believe that the collection of fares should be reinstated. A proposed date would be June 1, 2021. The collection of fares will not only resume much-needed revenue to the system but will also help to limit riders using the system for reasons other than transportation. It should be noted that wearing masks on transit vehicles will continue to be mandatory until the order is lifted by the Federal Transit Administration. The annual cost to operate the system is approximately $5,362,000. Of that amount, in atypical year, approximately $2,169,000 is funded by a grant from the Federal Transit Administration (FTA) and $511,000 from a Texas Department of Transportation(TXDOT) grant. Approximately $435,000 is funded through the charging of fares and the balance is paid from the General Fund. FUNDING SOURCE The transit system is funded through a combination of rider fares, monies from the General Fund as well as grants from the Texas Department of Transportation and the Federal Transit Administration. RECOMMENDATION Approval of the resolution. ORDINANCE NO.
