MEETING DATE: April 6, 2021
REQUESTED ACTION: Council consider a resolution approving an annual towing contract
with TNT Wrecker Services for use by various City departments.
Vehicles to be towed include disabled city -owned vehicles for Fleet Management, impounded or
seized vehicles for the Police Department and inoperable, wrecked or junked vehicles for Code
Enforcement.
Bids were requested from four towing companies with only one response received. The towing
specifications include light, medium and heavy duty vehicles. Specifications allow for a one (1)
year contract with the option of two renewals of a one year contract. The estimated cost for one
year is $68,395, which is about a 10% increase over the prior contract. A copy of the bid tab is
attached.
FUNDING SOURCE
General Fund (84%) and Fleet Fund (16%).
RECOMMENDATION
Approval of the resolution.
RESOLUTION NO.
WHEREAS, bids were received for an annual contract, with an option to renew for
two (2) additional one (1) year contracts, for towing services of impounded, seized,
inoperable, wrecked or junked vehicles; and,
WHEREAS, TNT Wrecker Services, of Beaumont, Texas, submitted a bid for an
estimated total annual expenditure of $68,395.00 in the unit amounts shown on Exhibit
"A," attached hereto; and,
WHEREAS, the City Council is of the opinion that the bid submitted by TNT
Wrecker Services, of Beaumont, Texas, is the lowest responsible bidder providing the
best value to the City and should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT the bid submitted by TNT Wrecker Services, of Beaumont, Texas, for an
annual contract, with an option to renew for two (2) additional one (1) year contracts, for
towing services of impounded, seized, inoperable, wrecked or junked vehicles for an
estimated total annual expenditure of $68,395.00 in the unit amounts shown on Exhibit
"A" be accepted by the City of Beaumont; and,
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute a contract with TNT Wrecker Services, of Beaumont, Texas, for the
purposes described herein.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.

BACKGROUND
The Tax Office has accepted payments that were processed according to Sec. 33.011 of the State
Property Tax Code which reads as follows: "The governing body of a taxing unit may provide
for the waiver of penalties and interest on a delinquent tax if an act or omission of an officer,
employee, or agent of the taxing unit caused the taxpayer's failure to pay the tax before the
delinquency and if the tax was paid within 21 days after the taxpayer knows or should know of
the delinquency."
The Commissioner's Court met on March 23, 2021 and approved waiver of penalty and interest
for Del Rio Properties LLC ($494.32) & Amacate Tortilla Bar ($153.08).
The correspondence from the Tax Office relating to this action is attached for your review.

The Citywide Pavement Markings — Phase I project consists of the installation of pavement
markings on the following streets: Buford Street, Carroll Street, College Street, Gladys Avenue,
Phelan Boulevard, and Sycamore Street (including a portion of Madison Avenue).
On March 18, 2021, one (1) bid was received for furnishing all labor, materials, and equipment

Unlimited, of Lubbock, Texas, is the lowest responsible bidder providing services at the
best value to the City and should be accepted;

REQUESTED ACTION: Council consider a resolution approving a payment for repairs
made to a heavy haul dump truck used at the Landfill.
BACKGROUND
On November 24, 2020, City Council had a work session concerning the repairs of three dump
trucks. The first unit has been completed, with the following payment now due.
Unit 5093 is a 2005 Caterpillar 725 Articulating Heavy Haul Dump Truck, with 9097 hours prior
to repairs. Repairs consisting of a total re -hose and re -harness, were completed by Mustang Cat
of Houston in the amount of $106,056.67. A new truck would cost approximately $365,000. This
work came with a 36 month/2000 hour warranty. The unit is used at the landfill to haul dirt and
continually cover debris, in order to comply with TCEQ regulations.
Mustang Cat is a Sole Source Vendor.

RESOLUTION NO.
WHEREAS, the City of Beaumont solicited bids for furnishing all labor, materials,
and equipment for the Tyrrell Park Loop Drainage Project; and,
WHEREAS, Texas Drainage, Inc., of Waller, Texas, submitted a bid in the amount
of $69,415.76; and,
WHEREAS, the City Council is of the opinion that the bid submitted by Texas
Drainage, Inc., of Waller, Texas, is the lowest responsible bidder providing services at the
best value to the City and should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT the City Council hereby approves the award of a contract to Texas Drainage,
Inc., of Waller, Texas, in the amount of $69,415.76, for the Tyrrell Park Loop Drainage
Project; and,
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute a contract with Texas Drainage, Inc., of Waller, Texas, for the
purposes described herein.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
