A meeting of the Board of Adjustment was held on March 20, 1987 with the following members present: Chairman Milton Bell Commissioner Whit outlaw Commissioner Ron Lanier Commissioner Charles Thompson Commissioner Gerald Farha Commissioner Bettye Smith Commissioner absent: Preston Shaw. Also present: Kirt Anderson, Senior Planner/Landscape Architect, Norman Whitaker, Planning Director; Tyrone Cooper, Assistant City Attorney; Walterine Brown, Recording Secretary. APPROVAL OF MINUTES The minutes for January 8, 1987 were approved. Commissioner Outlaw made a motion to approve the minutes. Seconded by Commissioners Lanier and Thompson. Vote carried 5-0. FILE 317—BA. Request for a variance to allow the area of a sign to be increased from 20 square feet to 36 square feet at the Bingman Elementary School described as part of tracts 17 and 19, plat B-21, J. Vetch Survey AB 1, Beaumont, Texas. The staff is recommending approval of the variance based on the following: 1) that it would be in the public interest 2) that the literal enforcement of the ordinance would result in unnecessary hardship due to the physical condition or situation on the property or related to the property 3) that it would be in the spirit of the ordinance. The applicant State Sign is representing the Bingman Elementary School PTA. The: PTA desires to install a sign essentially similar to the Amelia School District sign that was reviewed several months ago. The purpose is for a reader board to place messages such as PTA meeting tonight, etc. The sign would 15' high with a 25' setback both of which complies with the ordinance. MINUTES BOARD OF ADJUSTMENT 3-20-87 ) } PAGE 2 SPEAKING IN FAVOR OF THIS REQUEST Mike Mayfield 815 Boyd Commissioner Thompson made a motion to approve the variance. Seconded by Commissioner Smith. Vote carried 5-0. Commissioner Thompson withdrew due to a conflict of interest with File 318-BA. FILE 318-BA. Request for a variance from the required 10 foot side yard setback to a 62 foot setback for a sign at 6140 Eastex Freeway on property described as a part of tract 66-C, plat D-24, F. Bigner AB. 1. The staff is recommending denial based on the following: the literal enforcement of the ordinance will not result in an unnecessary hardship due to a unique physical condition or situation on the property or related to the property. 2) the granting would not be within the spirit of the ordinance. The applicant Roland Angelle is building a new automobile dealership at this location and he wishes to install a sign to be approximately 23.5' high to a 10, front yard setback both of which complies with the ordinance however, he also proposes a 62 foot side yard which does not comply with the ordinance which requries a 10 foot setback. The applicant has installed a concrete foundation for the sign without a building permit. The property is commercial. It is located in an regional activity center. SPEAKING IN FAVOR OF THIS REQUEST Vincent White, General Manager of Roland Angelle Port Neches, Texas Phil Roebuck, General Contractor Golden Triangle Constructors 1204 Ave. H Nederland, Texas REBUTTAL Vincent White Commissioner Outlaw made a motion to deny the variance because it does not meet the three requirements. Seconded by Commissioner Farha Vote carried 5-0. DISCUSSION OF NEW APPLICATION FORMS The staff has redone all the application forms not just for the Board of MINUTES BOARD OF ADJUSTM'ZNT 3-20-87 1 1 PAGE 3 Adjustment but for the Planning Commission and other forms that the staff processes. The Bylaws related to the Board of Adjustment as well as the Planning Cornaission require that the forms that the staff uses to take applications be approved or accepted by the Board. There are b different forms that are involved in conducting or administering the business of the Board of Adjustment. The forms are very similar to the existing forms. The staff repackaged them making them a little bit clearer and sequence the information. The only problem that the staff has had is that applicants are coming in with incomplete applications. They were scaled down to a single page rather than numerous pages. Commissioner Thompson made a motion to accept the application forms. Seconded by Commissioner Farha. Vote carried carried 5-0. AMENDMENTS TO THE FLOOD HAZARD AREAS ORDINANCE The Flood Hazard Areas Ordinance pertains to the board not as the Board of Adjustment but as the Flood Control Board. The Flood Control Board essentially oversees variances that pertain to the Flood Hazard Areas Ordinance. It's and ordinance that the City of Beaumont has adopted in order to participate in the national Flood Insurance Program, a program that is put together by FEMA (Federal Emergency Management Agency) under the direction of the Federal Government to address flood problems. The Flood Hazard Areas Ordinance is just for the Commissioners information. ADJOURN
