PUBLIC HEARING
BOARD OF ADJUSTMENT
May 7, 1987
CITY COUNCIL CHAMBERS
CITY HALL, BEAUMONT, TEXAS
2:00 p.m.
A meeting of the Board of Adjustment was held on May 7, 1987 with the following
members present:
Chairman Milton Bell
Commissioner Whit Outlaw
Commissioner Preston Shaw
Commissioner Bettye Smith
Commissioners absent: Ron Lanier, Charles Thompson and Gerald Farha.
Also present: Kirt Anderson, Senior Planner/Landscape Architect, Norman
Whitaker, Planning Director; Tyrone Cooper Assistant City Attorney; Walterine
Brown, Recording Secretary.
APPROVAL OF MINUTES
The minutes for April 2, 1987 were presented.
Commissioner Smith made a motion to approve the minutes.
Seconded by Commissioner Outlaw.
Vote carried 4-0.
FILE 320-BA. An appeal to the Board of Adjustment to decide if a specific
use permit is required by ordinance to allow a drinking place to be opened
at 2405 Hegele at Usan on property described as tract 45, City Plat B-10,
J. W. Bullock Survey, Beaumont, Jefferson County, Texas.
The applicant of this case has requested to re -schedule his appeal until
there are more Commissioners present to hear his case.
Motion was made by Commissioner Smith to re -schedule case 320-BA until May
15, 1987 at 1:00 p.m.
Seconded by Commissioner Outlaw.
Vote carried 4-0.
FILE 321--BA. Request for a special exception to reduce the required exterior
side yard setback from ten (10) feet to five (5) feet for a building at 5085
College Street.
Mr. Anderson: The staff is recommending approval based on the following:
the applicant is in compliance with condition (b) (6) which allows a yard
exception for side lot lines; the adjacent and neighboring properties will
not be adversely affected; and the exception will not be contrary to the
public interest.
SPEAKING IN FAVOR OF THIS REQUEST

Commissioner Shaw made a motion to approve the special exception based on
the three criteria being met.
Seconded by Commissioner Outlaw.
Vote carried 4-0.
