PUBLIC HEARING
BOARD OF ADJUSTMENT
July 2, 1987
CITY COUNCIL CHAMBERS
CITY HALL, BEAUMONT, TEXAS
2:00 P.M.
A meeting of the Board of Adjustment was held on July 2, 1987 with the following
members present:
Chairman Milton Bell
Commissioner Preston Shaw
Commissioner Charles Thompson
Commissioner Gerald Farha
Commissioner Bettye R. Smith
Commissioners absent: Whit Outlaw and Ron Lanier.
Also present: Kirt Anderson, Senior Planner/Landscape Architect, Tyrone Cooper
Assistant City Attorney and Walterine Brown, Recording Secretary.
Vice Chairman Charles Thompson called the meeting to order.

APPROVAL OF MINUTES
Commissioner Shaw made a motion to approve the minutes of June 4, 1987.
Seconded by Commissioner Smith.
Vote carried 4-0.
Chairman Milton Bell entered at this time.
FILE 324 BA. Request for a special exception at 1327 Victoria Street from the
front yard requirements where the actual front setback of an abutting lot that
does not meet the front yard requirement of the Zoning Ordinance.
Staff recommended approval based on the special exception complies with
condition 30-37E (2) (b) (1) of the Zoning Ordinance which allows a structure on
the abutting lot does not comply with the required setback, will not adversely
affect the value use of the adjacent properties and will not be contrary to the
best public interest. The applicant has sold the hack portion of the property
to the State of Texas as part of the Martin Luther King, Jr., Parkway
development for Right -of -Way.

r Motion was made by Commissioner Fraha to accept the special exception based on
staff's recommendations.
Seconded by Chairman Bell.
Vote was 3 for and 2 against.
Commissioners Shaw and Smith abstained.
Motion failed. (Board needs four (4) to approve a special exception).
With any purchase of the adjacent property the .applicant may return for a new
hearing.
File 325 BA. Request for a special exception to reduce the required rear yard
to 7.5-ft. for a corner lot at 98 Orgain and Bayou Road.
The staff recommended denial of the request based on the special exception
adversely affecting the value use of the adjourning properties and not within
the interest of the public.

Commissioner Shaw made a motion to approve the special exception based on the
three criteria's being met: Section 30-37E.2 and will not adversely affect or
reduce the value of the property and will not be in contrary to public interest.
Commissioner Thompson added that the visual character be maintained, the
neighborhood support and there is no hazard.
Seconded by Commmissioner Thomspon.
Vote carried 5-0.
PROPOSED AMENDMENTS TO TEiE BYLAWS.
Discussion was held with the Commissioners.
Commissioner Shaw moved that the Bylaws were read and discussed and that they be
placed on the agenda for the next meeting for voting.
Seconded by Commissioner Smith.
Vote carried 5-0.
ADJOURNMENT.
