City Council Chambers
A meeting of the Board of Adjustment was held on August 2, 1990 with the
following members present:
Chairman Milton Bell
Board Member Jayne Eisen
Board Member Gerald Farha
Board Member Bettye Smith
Board Member Charles Thompson
Board Members absent: Ron Lanier (excused) and Whit Outlaw (excused).
Also present: Kirt Anderson, Planning Director; Murray Duren, Sr.
Planner; and Lane Nichols, City Attorney.
APPROVAL OF MINUTES
Board Member Smith made the motion to approve the minutes of the June
7, 1990 Public Hearing. Board Member Thompson seconded the motion.
The motion to approve carried 4:0.
PUBLIC HEARING
Planning Division File #345-BA: A request to vary the lot depth
requirements of Section 30-25 B.(1) of the Zoning Ordinance, as provided
for under Section 30-37 E.3, Zoning Ordinance. Property is zoned RM-H
(Residential Multiple -Family Dwelling -- Highest Density). The live
subdivision lots are located in the 8100 block of Westgate Drive, H. Williams
Survey. Applicant: Victor Marino, Marino Investments, Inc.
Staff recommended granting the variance to reduce the lot depths to an
average of 85 feet from the required 100 feet because: (a) A variance
would not be contrary to the public interest; (b) Literal enforcement of the
Ordinance would result in unnecessary hardship to the owner; (c) By

granting the variance, the spirit of the Ordinance would be observed and
justice would be done; and (d) This action would allow the Westgate
Place Addition, Lots 16-A through 16-E, to meet the requirements of the
Subdivision Ordinance.

Staff Analysis was presented by Murray Duren, Sr. Planner. Twenty-six
public notices were issued to surrounding property owners. One negative
response was received.

Board Member Eisen made the motion to grant the variance as
recommended by staff. The motion was seconded by Board Member
Thompson.
Motion to grant the variance carried 5:0.
There being no further business, the meeting was adjourned.
