City Council Chambers
A meeting of the Board of Adjustment was held on September. 6, 1990 with the
following members present:
Chairman Milton Bell
Board Member Jayne Eisen
Board Member Gerald Farha
Board Member Ron Lanier
Board Member Bill Lucas
Board Member Charles Thompson
Board Members absent: Whit Outlaw and Bettye Smith.
Also present: Murray Duren, Sr. Planner and Ilona Baker, Drafting
Technician.
APPROVAL OF MINUTES
Board Member Thompson made the motion to approve the minutes of the
August 2, 1990 Public Hearing. Board Member Eisen seconded the motion.
The motion to approve carried 5:0.
PUBLIC HEARING
Planning_ Division File #346-BA: A request to vary the interior side yard
building setback requirements of Section 30-25 B(1) of the Zoning
Ordinance to allow a 5.0 foot and a 6.0 foot setback in place of the required
7.5 foot. A variance request is permitted under Section 30-37 E.3.'
Applicant: Victor Marino, Marino Investments, Inc. Location: 8275
Westgate, Lot 16-C, Westgate Place.
Staff recommended granting the variance to reduce the required interior side
yards for a two-story house from 7.5 feet to 5.0 feet and 6.0 feet respectively
because: (a) A variance will not be contrary to the public interest; (b)

Public Hearing
Literal enforcement of the Ordinance will result in unnecessary hardship to
the owner; and (c) By granting the variance, the spirit of the Ordinance will
be observed and justice will be done.

Staff Analysis was presented by Murray Duren, Sr. Planner. Twenty-one
public notices were issued to surrounding property owners.
Board Member Thompson made the motion to grant the variance as
recommended by staff. The motion was seconded by Board Member Eisen.
Motion to grant the variance carried 5:0.
There being no further business, the meeting was adjourned.
