(Lots 9-11, Block "C", Mayfair IP 2nd Addition), *STAFF REPORT* \STAFF RECOMMENDATION 0 i a 'ITV i FILE #347-BA w"Q) J 11 )A' J \) -1 9 I -RE #347-BA Page 2 .. r �. • my Y-ILE 47-RA Page 3 FUE #347-BA COMMONS OF APPROVAL FOR SPECIAL EXCEMONS Special Exceptions may be granted in the following situations - Page 4 To reconstruct, extend or cniarge a building occupied by a nonconforming use on the lot or tract occupied by such building, provided that the reconstruction, extension, or enlargement does not prevent the return of the property to a conforming use. 0 1) An exception from the front yard requirements where the actual front yard setback of an abutting lot does not meet the front yard requirement or a rear yard exception where the actual rear yard setback of any four (4) or more lots in the same block do not meet the rear yard requirements of these regulations. 4) An exception from the minimum front yard requirements tor owner identification signs where a structure existing at the effective date of this Chapter precludes locating a sign in compliance with the setback regulation. 5) An exception from a minimum interior side yard setback requirement for owner identification signs for existing businesses which were developed prior to April 1, 1981, where there is no safe place to erect a sign in compliance with the minimum setback requirements. A condition for granting of the exception is that the applicant must demonstrate that the sign shall not screen or obstruct the view of an existing sign, building, or outdoor display area. 6) An exception from the minimum side yard setback requirement where a nonconforming building was in existence at the time of the passage of this ordinance. C) To waive or reduce off-street parking and loading requirements when the Board finds the same are unnecessary for the proposed use of the building or structure for which the special exception request applies. F" #347-BA ANALYSIS Page S Page 6 ME #347-BA PUBLItvNOTMCATION Page 7 Fur-- 3 4-1- SA May 2, 1991 Board of Adjustment City of Beaumont RE: Application For Special Exceptions Lots 9, 10 & 11, in Block "C", Mayfair 2nd Addition, Beaumont, Jefferson County, Texas, 1075 Amelia and two adjacent lots Dear Sirs: The subject property is zoned "Industrial", and it is directly across the street from residential zoned properties. The required city set back is 40, on the properties. All lots, 9, 10 and 11, are currently being considered for development as boat storage facilities, with access being from the interior lot. For proper development, it is necessary that the set back be changed to 51 for delivery purposes. The change will not enhance traffic on Amelia Avenue. All properties located in residential areas adjacent and across from the subject property are 201 feet set back. All owners will sign a consent for waiver. The schedule for development will be as follows: Lot 9 - immediately - for boat storage facility Lot 10 - scheduled for prior to the end of 1991, to include storage facility and an office. Lot 11 - last to be developed - no definite time scheduled, but as building program completes. The next lot used as industrial lot, Mallard & Mallard, has a pipe rack built immediately on the lot line. The use, of the property by your applicant will be uniform with other industrial usages in the area and will not be a detriment to public good and will not impair the general purpose and intent of the comprehensive plan as established.
