Special Exceptions may be granted in the following situations:

To reconstruct, extend or enlarge a building occupied by a nonconforming
use on the lot or tract occupied by such building, provided that the
reconstruction, extension, or enlargement does not prevent the return of
the property to a conforming use.
b) To deviate yard requirements in the following circumstances:
1) An exception from the front yard requirements where the actual
front yard setback of an abutting lot does not meet the front
yard requirement or a rear yard exception where the actual rear
yard setback of any four (4) or more lots in the same block do
not meet the rear yard requirements of these regulations.
3) An exception where the cAsting front yard setbacks of the
various lots in the same block are not uniform, so that any one
of the existing front yard setbacks shall, for a building hereafter
constructed or extended, be the required minimum front yard
depth.
4) An exception from the minimum front yard requirements for
owner identification signs where a structure existing at the
effective date of this Chapter precludes locating a sign in
compliance with the setback regulation.
5) An exception from a minimum interior side yard setback
requirement for owner identification signs far existing businesses
which were developed prior to April 1, 1981, where there is no
safe place to erect a sign in compliance with the minimum
setback requirements. A condition for granting of the exception
is that the applicant must demonstrate that the sign shall not
screen or obstruct the view of an existing sign, building, or
outdoor display area.
6) An exception from the minimum side yard setback requirement
where a nonconforming building was in existence at the time
of the passage of this ordinance.
C) To waive or reduce off-street parking and loading requirements when
the Board finds the same are unnecessary for the proposed use of the
building or structure for which the special exception request applies.

Dear Sirs,
A special exception is being requested for 1095 Sherman for a yard
exception on corner lot. A 91 building line is being requested at
the Poplar street corner.
The granting of this special exception by the Board of Adjustment
will not adversely affect the value and use of adjacent properties
or be contrary to the publics interest.
Construction of new homes in this area is a concentrated effort to
revitalize the neighborhood by supplying new homes for low to
moderate income families. Therefore, it can only increase the
value of existing properties and will have no affect on land use
of adjacent properties.
This non-profit, project has involved a great deal of public support
and interest in the neighborhood.

Dear Sirs,
Beaumont Housing Finance Corporation, owner of the above mentioned
property on which a new residence has been constructed for the
purpose of being sold to a low to moderate income family.
Prior to construction, a survey was done by city staff which
resulted in an error of one foot on the Poplar street corner
setback line. This resulted in the residence being constructed
over the 101 corner street setback line.
In asking the board for a special exception on the corner lot
setback it should be noted that the construction of this residence
is a non profit project.
Housing services has ordered a re -plat of the property by Mark
Whiteley, Associates & Incorporated, Consulting Engineers. The new
survey information has been included as follows,
1095 Sherman, lot 150 block 14 of the Herring Addition.
Dimensions: 68.331 by 1501
Beaumont Housing Finance corporation and Housing Services greatly
appreciate your cooperation in this matter.
