Proclamations, Presentation, Recognitions None Public Comment: Persons may speak on scheduled agenda items 1-4/Consent Agenda None CONSENT AGENDA Approval of minutes — February 23, 2021 Confirmation of board and commission member appointments — None A) Authorize the City Manager to execute Change Order No. 2, accept maintenance, and authorize final payment to T Construction, LLC - Resolution 21-045 Minutes —March 9, 2021 B) Authorize the Chief Financial Officer to execute all documents necessary to accept funding from the Texas Department of State Health Services (DSHS) awarded to the Beaumont Public Health Department - Resolution 21-046 C) Approve a contract for the purchase of liquid chlorine for use in the Water Utilities Department - Resolution 21-047 D) Approve a proposal submitted by Associated Mechanical Services, Inc. to replace the air- cooled chiller unit at the Sterling Pruitt Activity Center - Resolution 21-048 E) Approve the purchase of two defibrillators with accessories for use in the Fire Department - Resolution 21-049 F) Authorize the City Managerto apply for and receive funding through the U. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider amending Section 2.03.074 of the Code of Ordinances to add nine Grade I Firefighter positions. Minutes — March 9, 2021 The EMS Division, formerly a part of the Public Health Department, was moved into the Fire Department in early January of this year. The Administration is proposing to staff one ambulance, at this time, with firefighters, which will require hiring nine additional employees. The Code of Ordinances would be amended to increase the number of Grade I Firefighter positions from 100-109. The Administration plans to staff City ambulances over time with firefighters who are also Paramedics, EMT -Intermediates or EMT -Basics. As firefighters are hired and the City can staff the desired number of ambulances each day, vacant civilian EMS positions will be eliminated. If the staffing of one ambulance with firefighters is successful and additional firefighter positions are added by the City Council in the future, the transition will likely take many years. The purpose of this plan is to have a more secure staffing plan due to the high turnover of civilian employees in the EMS Division. A firefighter assigned to an ambulance will eventually be able to bid out into another Fire Department function such as Suppression, Logistics or the Fire Marshal's Office if he/she desires to. Second, this transition plan is already proving to be beneficial as a result of having a streamlined chain of command under the Fire Chief. Fire trucks are often the first responders to a medical call since there are 12 fire stations. The estimated cost to hire nine additional firefighters for the first year is approximately $750,000 for base wages and benefits. It takes nine firefighters to staff an ambulance 24/7, while it takes seven civilians. The difference is because firefighters work a different schedule per their labor agreement. The net cost to the City of hiring nine new firefighters, versus seven civilian EMT -Intermediates, for the first five years, is an estimated 1,340,000 for base wages and benefits. Approval of this item. COuncllmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING SECTION 2.03.074 OF THE CODE OF ORDINANCES BY INCREASING THE NUMBER OF GRADE I FIREFIGHTER POSITIONS IN THE BEAUMONT FIRE DEPARTMENT FROM ONE HUNDRED (100) TO ONE HUNDRED NINE(109); PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. COuncllmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 21-009 2. Consider a resolution authorizing the City Manager to award a contract to Brystar Contracting, Inc. for rehabilitation work on 16 lift stations. The City of Beaumont currently operates and maintains 76 wastewater lift stations throughout the city. The Lift Station & WWTP Repairs Tropical Storm Harvey Group 4 Lift Stations Project will provide for the unique rehabilitation and improvements of 16 minor lift stations Minutes — March 9, 2021 following damages sustained during Tropical Storm Harvey. The project includes installing elevated platforms and replacing electrical controls and equipment. On February 25, 2021, four (4) bids were received for furnishing all labor, materials, equipment, and supplies for the project. A total of 180 calendar days are allocated for the completion of this project. Funds will come from the Harvey Fund in the amount of $1,188,000.00 and Federal Emergency Management Agency (FEMA) in the amount of $132,000.00. Approval of the resolution. AYES: MAYOR AMES, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE ABSTAINED: MAYOR PRO TEM FELDSCHAU MOTION PASSED Resolution 21-056 Consider a resolution requiring that face coverings be worn by the public in all City -owned facilities operated by the City. Governor Abbott's new order will lift the mask mandate effective Wednesday, March 10, 2021, Mayor Ames has placed this item on the Council agenda for the Council's consideration. The resolution would require the wearing of masks or other face coverings in all City -owned facilities operated by the City until rescinded. COuncllmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY ADOPTS AND DECLARES THAT THE WEARING OF FACE MASKS OR OTHER FACE COVERINGS IN ALL CITY -OWNED FACILITIES OPERATED BY THE CITY OF BEAUMONT WILL BE REQUIRED. COuncllmember Samuel seconded the motion. Minutes - March 9, 2021 AYES: MAYOR AMES, COUNCILMEMBERS SAMUEL AND MOUTON NAYS: MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS GETZ, NEILD AND PATE MOTION FAILED COuncllmember Nelld moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY ADOPTS AND DECLARES THAT THE WEARING OF FACE MASKS OR OTHER FACE COVERINGS IN ALL CITY -OWNED FACILITIES OPERATED BY THE CITY OF BEAUMONT WILL BE HIGHLY RECOMMENDED. AYES: MAYORAMES, MAYOR PROTEM FELDSCHAU, COUNCILMEMBERS NEILD, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 21-057 DISCUSSION ITEMS Review and discuss the seating at the Civic Center — This Item was deferred for two weeks Review and discuss the lighting at Complex 4 at the Athletic Complex Keith Folsom, Building Services Director reviewed and discussed the lighting at Complex 4 Athletic Complex. There was a handout given to Council, Mr. Folsom stated that his department received a phone call that there was a light pole that had fallen, once staff inspected the pole it was determined that the bottom of the pole had rusted out which caused it to fail and fall to the ground. The other eleven (11) poles are not safe to be near as they are experiencing the same issues as the fallen pole. Mr. Folsom stated that he received proposed numbers from an electrical contractor, to demolish the poles would cost approximately $83,000.00, that includes site prep, demolition and haul off. The fields are used at night, if the poles were removed and not replaced then the field would not be able to be used after dark. The cost to replace the twelve (12) poles would be approximately $750,000.00, engineering costwould be approximately $45,000.00 to put the project together and oversee it. The total price would be $878,000.00. The field lighting at the other three (3) complexes were replaced in 2006, there was hurricane damage done to all three. Council gave approval to remove the twelve (12) light poles as soon as possible. Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. COMMENTS Public Comments (Persons are limited to three minutes) Minutes —March 9, 2021 Harry Jackson 5860 Falcon Ln. Beaumont TX Thanked the Streets and Drainage workers on a great job they did repairing a culvert that was damaged as well as replacing the concrete and repairing unleveled concrete Meadowview and Lawrence Drive, spoke regarding his sewer line as well as his neighbors, stated they both had to eventually get plumbers to come out, thanked Councilmember Neild for coming out to address his issue, stated that it's his feeling that the city should have some type of preventative maintenance for sewer lines, if a citizens home was built before a cleanout system was installed they shouldn't be punished for that, there's conversations on Council regarding dog parks when there are citizens that have feces coming into their homes which is what happened to him due to there being no preventative maintenance forthe sewer system, for a city of this size it's just not appropriate Brian Nepveaux 6955 Shanahan Beaumont TX Read a statement that was requested by Chris Catalina, Human Resources Director, in reference to a visit that was made to the Sterling Pruitt Center, stated that he and Councilmember Getz were doing some volunteer work, at about 4:30 p.m., in the afternoon they passed by the Sterling Pruitt Recreation Center, Mr. Nepveaux stated that he commented to Mr. Getz how nice the facility was compared to Rogers Park, Mr. Getz asked if he would like to see the inside, he stated yes, once inside the center they noticed campaign cards for two candidates, Mr. Getz asked the lady at the front desk if she knew that it was against city policy to have campaign cards in a city facility, the lady didn't question it and promptly took the cards off the desk and put them under the counter, Mr. Getz continued to show him around and noticed more cards on a table nearthe basketball gym, Mr. Getz called the cards to the ladies attention, she didn't say much and put them behind the counter as well, he and Mr. Getz were on their way out and the lady looked irritated and confused as to why the cards couldn't be out, Mr. Getz asked very politely if she had a problem with him calling out city policy to her attention, the lady said no, they said good afternoon and left, at no time did Mr. Getz tell her what to do with the prohibited material, he only mentioned the city campaign rules to her, Mr. Getz didn't raise his voice or say anything inappropriate to anyone there, there was no bullying or intimidation by Mr. Getz, if any investigation needs to be done it needs to be done to see who allowed the cards to be placed in the building and who placed them there, did the contenders putthem there and did they have permission from the building management to advertise them or hand them out in violation of city campaign election rules, it's his understanding that cameras were there and if they were able to view Mr. Getz then they should be able to view and back track to see who put them campaign information on the desk, failure to adhere to city rules should fall on the building managerand staff not Mr. Getz Jonathan Pressey 2304 Wilson Beaumont TX Addressed an issue regarding a tag that was left on the door of his mother's home, stated that the door tag stated that the city line was open and they didn't see any standing sewage water, when the city came out he showed staff a flood erupting underneath the house after the freeze where all the sewage water had flowed onto the brand new lawn, asked city staff if they would send someone out to treat the lawn, to this day the city still hasn't treated it, also commented on removing the light poles from Complex 4 Minutes —March 9, 2021 Robert Pate 6315 RFD Beaumont TX Spoke to Council regarding Complex 4 and the tax revenue that it brings, asked everyone to think about how many people play and attend softball tournaments and afterwards go to a local restaurants etc., and spend money, calculated that they may spend about $5,000.00 a night, that money goes into our local businesses, asked that Council please consider the revenue not only for the city but for the local businesses Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER GETZ - STATED THAT "IF YOU SEE SOMETHING SAY SOMETHING" ON FEBRUARY 22, 2021, HE SAW ON SOCIAL MEDIA THAT THERE WAS A CITIZEN THAT LIVED IN THE NORTH END OF BEAUMONT WHO WAS A VICTIM OF THE RECENT ICE STORM AND WAS WITHOUT ELECTRICITY, FOOD, OR WATER, HE KNEW THAT THE CAJUN NAVY WAS IN TOWN AND OFFERED TO BRING THE ELDERLY HANDICAPPED CITIZEN FOOD AND WATER, STATED THAT BRIAN NEPVEAUX WAS HELPING THE CAJUN NAVY AND ASKED IF HE COULD ACCOMPANY HIM AND HE SAID YES, AFTER LEAVING THE ELDERLY PERSONS HOME THEY PASSED BY THE STERLING PRUITT RECREATION CENTER ON GULF STREET, MR. GETZ LISTED THREE LAWYERS IN HIS EMAIL, IN THE FOUR PAGE EMAIL HE MAKES REFERENCES TO VIOLATIONS OF HIS CONSTITUTIONAL, STATUTORY AND INHERENT RIGHTS ETC., MR. GETZ CONCLUDES HIS EMAIL BY SAYING "CONTINUED REFUSAL OF THIS REQUEST VIOLATES MY RIGHTS TO DUE PROCESS UNDER THE CONSTITUTION AND MAY REQUIRE ME TAKING FURTHER STEPS TO MAKE SURE THAT MY LEGAL RIGHTS AREN'T INFRINGED UPON", MR. GETZ IS CONCERNED, MR. COOPER STATED THAT AS THE LAWYER FOR THE CITY OF BEAUMONT HE WOULD BE IRRESPONSIBLE IN HIS DUTY AS CITY ATTORNEY NOT TO BRING THIS TO THE COUNCILS ATTENTION, THERE'S A POSSIBILITY THAT MR.
