A meeting of the Board of Adjustment was held on June 1, 1995 with the following members
present:
Chairman Jayne Eisen
Board Member Bob Harris
Board Member Bruce Irvine
Board Member Kevin Fuller
Board Member Mary Jowers
Board Member Chuck Mason
Board Members Absent: Board Member Dohn LaBiche
Also present: Stephen C. Richardson, Planning Director; Murray Duren, Senior
Planner; Tyrone Cooper, First Assistant City Attorney; Bonnie
Semien, Planning Technician; and Jill Cole, Recording Secretary.
APPROVAL OF MINUTES
Board Member Fuller made a motion to approve the minutes of the May 18, 1995
Board of Adjustment Special Hearing. Board Member Harris seconded the motion.
Motion to approve carried 6:0.

PUBLIC HEARING
1) File #375-BA: Consider a request for a variance from the front yard building setback
requirement fora proposed structure to be located in a GC -MD District.
Location: K-Mart parking lot - 5845 Eastex Freeway
Applicant: Texas Commerce Bank - National Association

Public Hearing
Mr. Richardson explained that the request for the variance was from 20 feet to 8 feet.
Texas Commerce Bank wishes to build an automatic teller machine at the front of the
K-Mart Shopping Center parking lot and would place the street side of the building
8' from the right-of-way line of Eastex Freeway.
The site plan that was submitted for the facility was reviewed and approved by the
City Traffic Engineer. The site was picked as the most practical location due to the
layout of the existing parking lots, access drives and internal circulation of cars. The
actual site to be leased from the shopping center is 25' x 100'.
The distance back from the curb of the service road to the street side of the building
is approximately 23 feet. On the south side, the distance from the building to the
existing driveway would be 40 feet. On the north side, the distance from the building
to the existing driveway on the north would be 112 feet.
Mr. Richardson recommended approval of the request.
Sixteen notices were mailed to property owners within 200 feet. No responses in
favor or in opposition were returned.
Chairman Eisen opened the public hearing and asked for the applicant's comments.
John Rainey with Texas Commerce Bank addressed the Board.
In response to a question from Board Member Harris, Mr. Rainey said that the height
of the ATM building would be 9'8".
Referring to Condition B of the variance requirements, Board Member Fuller asked
Mr. Rainey what was so exceptional about the subject property that would cause
unnecessary hardship if the variance was denied.
Mr. Rainey explained that the site was chosen because of the easy access to the
machine. Because of the easy access from the entrance -off the service road, it would
be safer for the customer and would provide high visibility.
Chairman Eisen -asked for comments in favor or in opposition. No comments were
made.
Chairman Eisen closed the public hearing.

Board Member Harris confirmed that the applicant met with the Traffic Engineer.
Chairman Eisen re -opened the public hearing.
In response to a question from Board Member Fuller, Mr. Rainey said the property
was being leased.
Mr. Jack Koshkin addressed the Board. His company manages the shopping center
property.
Chairman Eisen closed the public hearing.
Board Member Fuller made a motion to approve the variance request as stated in
File 375-BA as that it meets Condition A and C and that the safety of the site and
the traffic pattern meets the exceptional physical situation element of Condition B.
Board Member Harris seconded the motion. Motion to approve carried 5:0. (Board
Member Jowers abstained from voting.)
Chairman Eisen, referring to the Special Meeting of May 18, 1995, requested that a
letter be sent from the Board suggesting that all Sirmon's homes be monitored closely.
