SUBJECT: Request for a variance to the sign regulations in the Oaks Historic District for an
antique s ' hop located at 26,94 Hazel Avenue. The property is zoned GC -MD (General
Commercial -Multiple Family Dwelling) District.

STAFF REPORT
Mr. Jeff McManus is the applicant and owner of the subject 5�0' x 150' lot situated east of
Eleventh Street. His existing owner identification sign is illuminated which is not allowed
in the historic district, The sip is 7 feet in height.
The ordinance allows a maximum height 'of 6 feet. The sip is located 2 feet from the
property line. The ordinance (30-21.2 as amended in March, 2001) requires that signs be set
back at least 5 feet from any property fine,
Mr. McManus owns several lots along Hazel and Eleventh where his various businesses are
located.
The applicant has the burden of proof to demonstrate that all three of the conditions
necessary for a variance have been met.

McManus, Lamplighter has been in business 45 years in Beaumont, TX- In the 27 years
in this location, we added the "Select Antique!' shop 7 years ago. At that time, the City
of Beaumont and the Oaks Historic District both thought the sign was in keeping with the
look of the neighborhood. The sign is Victorian,, tall and thin, discretely lighted, and cost
about $450.00 at that time. The property our store owns in this neighborhood is

significant and well kept. We live in the neighborhood and only have the best interest at
heart.
We feel our sign is esthetically pleasing within the neighborhood. If the position were
moved back, we feel it would have to be larger and bolder colors to be noticed. In our
opinion it would be less tasteful and would not blend with the surroundings. Thus, we
ask for a variance.
