STAFF REPORT
Emily Coxe, the applicant and property owner, is requesting a variance to the setback
requirement for an existing owner identification sign located at 2665 Broadway in the Oaks
Historic District.,
Section 30-21.,2 of the Zoning Ordinance requires that all structures and parking lots (except
for main and accessory structures and fences) come into compliance with the regulations within
four years. The amortization period has now expired.
Ms. Coxe says the sign was constructed over 5 years ago - before the property was in the Oaks
Historic District. Considering that the sign was built 5 or 6 years ago, it did not meet the
setback requirements from the street right-of-way at the time of construction.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary
for a variance have been met.

Ladies and Gentlemen:
Enclosed are Application for a Certificate of Appropriateness, Variance
Supplemental Application Form - Beaumont, Texas, Board of Adjustment Application
Form - City of Beaumont, and a hand drawn sketch of the sign at 2665 Broadway.
I am not sure which of these forms are needed since I found the instructions rather
confusing but decided to be safe and fill out all of them.
I would really appreciate your allowing us to keep the sign that is installed on our
property. The sign was placed there over 5 years ago at which time we had no idea that we
were under any restrictions as to what kind of sign we were allowed. Therefore, we had the
sign specially designed and installed to be as tasteful and unobtrusive as possible. The
bank has never complained about the -sign in any way nok has any other person or entity.
