REQUESTED ACTION: Council consider a resolution authorizing the City Manager to
execute Change Order No. 1 to the contract with Chief Solutions,
Inc.
BACKGROUND
On January 15, 2019, by Resolution No. 19-019, City Council awarded a contract to Chief
Solutions, Inc., of Houston, in the amount of $499,926.95 for the Sewer Evaluation Work Order
Contract — Phase II.
Proposed Change Order No. 1, in the amount of $50,000.29, would allow for smoke testing,
would adjust the quantities for cleaning and televising, and would add 64 calendar days for
accumulated rain days. If approved, the new contract amount will be $549,927.24 with 794
total calendar days to complete the project making the new estimated substantial completion date
April 25, 2021.

Approval of the resolution.
RESOLUTION NO.
WHEREAS, on January 15, 2019, the City Council of the City of Beaumont, Texas
passed Resolution No. 19-019 awarding a contract in the amount of $499,926.95 to Chief
Solutions, Inc., of Houston, Texas, forthe Sewer Evaluation Work Order Contract— Phase
II; and,
WHEREAS, Change Order No. 1, in the amount of $50,000.29, is required to
document the addition of smoke testing on the contract, adjust the quantities for the
contracts quantities that have exceeded 20% of its original quantity, and to add 64 (sixty-
four) calendar days for accumulated rain days, thereby increasing the total contract
amount to $549,927.24;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are
hereby, in all things, approved and adopted; and,
THAT the City Manager be and he is hereby authorized to execute Change Order
No. 1, in the amount of $50,000.29 for additional work described above, thereby
increasing the total contract amount to $549,927.24 for the Sewer Evaluation Work Order
Contract — Phase II; and,
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.

REQUESTED ACTION: Council consider a request for a Specific Use Permit to allow a
commercial construction and renovation business in the CBD
(Central Business District) District located at 747 College Street.
BACKGROUND
Gerald Condon is requesting permission for a commercial construction and renovation business at
747 College Street. This property is the previous location of Fire Station #1. Mr. Condon has
plans to renovate the existing building and use the property as the new headquarters, offices and
distribution center for his commercial construction and renovation company, Gerald Condon
Properties, Ltd. No changes are proposed for the layout of the property and all utilities are
existing and in place. There is no exterior storage planned.
At a Joint Public Hearing held on January 25, 2021, the Planning Commission recommended 5:0
to approve the request for a Specific Use Permit to allow a commercial construction and
renovation business in the CBD (Central Business District) District.

BUSINESS DISTRICT (CBD) FOR PROPERTY LOCATED AT
747 COLLEGE STREET IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS.
WHEREAS, Gerald Condon, on behalf of Gerald Condon Properties, Ltd. has
applied for a specific use permit to allow a construction and renovation business in Central
Business District (CBD) for property located at 747 College Street, being Lots 487-495,
Block 64, Original Townsite of Beaumont, Beaumont, Jefferson County, Texas, containing
0.316 acres, more or less, as shown on Exhibit "A," attached hereto; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request and is recommending approval of a specific use permit to allow a
a construction and renovation business in Central Business District (CBD) for property
located at 747 College Street; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific
use permit to allow construction and renovation business is in the best interest of the City
of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby,
in all things, approved and adopted; and,
Section 1.
That a specific use permit to allow a construction and renovation business in
Central Business District (CBD) for property located at 747 College Street, being Lots
487-495, Block 64, Original Townsite of Beaumont, Beaumont, Jefferson County, Texas,
containing 0.316 acres, more or less, as shown on Exhibit "A," is hereby granted to Gerald
Condon Properties, Ltd., its legal representatives, successors and assigns, as shown on
Exhibit "B," attached hereto and made a part hereof for all purposes.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended,
as well as comply with any and all federal, state and local statutes, regulations or
ordinances which may apply.

Gerald Condon Properties;.Ltd are pleased to announce.our purchase of the old Beaumont Fire
Station #1, at 747 College St, Beaumont Our plans will renovate and restore the facility and
site for use as our new Headquarters, offices and. distribution center for -our Commercial
Construction and Renovation company.. This will allow our service trucks indoor staging and
loading for. the various projects we serve, whiler providing a new Design Center for. new and
existing projects. And.provide an assembly/holding area for case goods,. flooring, fighting and.
typical material usage associated to each projects.
The renovation at our new Headquarter will include fresh landscaping, cleaning and painting
the entire building inside and. out. Improvements'will include but not limited. to new flooring,.
ceiling -tiles,: light fixtures., cabinets and roofing -typically required due to vandalism, weather
deterioration or general life span. My company -will submit and purchase the required,
construction permits for segment as -necessary with ourvarious subcontractors or ourself,
depending on the scope of work.

BACKGROUND
Fittz and Shipman, Inc., on behalf of Munro's Cleaners, is requesting abandonment of the utility
easement located within Block 12, Calder Addition. In 1985, the alley was abandoned with the
retention of this easement. There is an existing sewer line in the alley that serves Munro's. If
the easement is abandoned, the sewer line will become private.
Munro's owns buildings on either side of this easement and would like to combine the two (2)
structures.
At a Joint Public Hearing held on January 25, 2021, the Planning Commission recommended
5:0 to approve the request to abandon the utility easement located at 301 N. Martin Luther King
Parkway.

BEAUMONT, JEFFERSON COUNTY, TEXAS.

REQUESTED ACTION: Council consider a resolution acknowledging that Beaumont offers

Commitment of Development Funding by the City in the form of a
fee waiver and the proposed development is located in Downtown
Beaumont and contributes more than any other HTC project to the
City's revitalization efforts.
BACKGROUND
Provident Realty Advisors, Inc. is applying to the Texas Department of Housing and Community
Affairs (TDHCA) for funding to develop Edson Lofts, a proposed one hundred -ten (110) unit
housing development, located at the northeast corner of Pearl and Liberty Streets (285 Liberty
and 341 Pearl). Offering exclusive support of this project will greatly increase the chances that
this project is awarded tax credits by TDHCA and is developed. In addition, offering .
development funding in the form of a fee waiver of at least $500 would result in additional
points during the HTC scoring process. In addition, the proposed development is located in the
redeveloping downtown. This area of Downtown' Beaumont has been designated as a
Neighborhood Empowerment Zone, designated as an Opportunity Zone and has been designated
for redevelopment in several City plans over the years.

RESOLUTION NO.
WHEREAS, Provident Realty Advisors, Inc. has proposed a development for rental
housing located at the Northeast corner of Pearl and Liberty Streets (285 Liberty and 341
Pearl) named Edson Lofts in the City of Beaumont; and,
WHEREAS, Provident Realty Advisors, Inc. has communicated that it intends to
submit an application to the Texas Department of Housing and Community Affairs
(TDHCA) for Housing Tax Credits for Edson Lofts; and,
WHEREAS, the City Council has considered the application and is of the opinion
that the development is in the best interest of the City and should be supported solely and
exclusively;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are
hereby, in all things, approved and adopted; and,
THAT as provided for in 10 TAC §11.9(d)(1) of the Qualified Allocation Plan and in
accordance with Texas Government Code §2306.6710(b) that the City of Beaumont,
acting through its governing body, hereby confirms that it Supports the proposed Edson
Lofts located at the Northeast corner of Peal and Liberty Streets (285 Liberty and 341
Pearl) and that this formal action is being taken to put on record the opinion expressed
herein by the City of Beaumont on February 2, 2021, and,
THAT as provided in 10 TAC §11.9(d)(7)(A)(iv)(II) the City of Beaumont finds the
proposed Edson Lofts project would contribute more than any other application to
revitalization efforts within Downtown Beaumont, considered to be a Concerted
Revitalization Plan (CRP) area, as reflected in the Downtown Beaumont Neighborhood
Empowerment Zone Number Five as well as the Downtown Development Plan, 1985 and
City in Motion Plan, 1987, and,
BE IT FURTHER RESOLVED THAT the City of Beaumont hereby supports solely
and exclusively the proposed Edson Lofts, and confirms that the City Council has voted
specifically to approve the construction of the Development and will commit to provide
development funding in the form of a fee waiver of at least five hundred ($500) dollars;
and,
BE IT ALSO RESOLVED THAT, the City Manager is hereby authorized,
empowered, and directed to certify this resolution to the Texas Department of Housing
and Community Affairs.

REQUESTED ACTION: Council consider a resolution approving video surveillance at the
parking lots of the Gulf Terrace Hike and Bike Trail and the
Folsom Hike and Bike Trail.
BACKGROUND
The City has a parking lot at both the Gulf Terrace Hike and Bike Trail and the Folsom Hike and
Bike Trail. Each of the parking lots has experienced multiple burglaries of parked cars. During
2020 there were 16 at Folsom and 13 at Gulf Terrace. The last burglary at either location was
December 16, 2020.
Installing permanent video surveillance at each of the lots will require Entergy to provide power
to the -site and then City personnel would install a pole and the contractor would install the video
equipment on that pole.
After evaluating the sites, City staff would use an Axis P3717-PLE multi -directional camera at
each location. This camera incorporates 4 lenses within the housing that allows for a 360 degree
range. By this approach, we can cover a lot of area while keeping camera costs lower. For
storage and communications, an Eagle Eye bridge with a Cradlepoint Cellular Router would be
installed. Estimated installation costs per location are:
Folsom:
• Video Hardware: $3,899
• Networking Equipment: $1,060
• Entergy power to the site: $3,000-4,000
• Pole to hang equipment: $500
• .Total: $8,459-9,459
Gulf Terrace:
• Video Hardware: $3,899
• Networking Equipment: $1,060
• Entergy power to the site: $7,000-8,500
• Pole to hang equipment: $500
• Total: $12,459-$13,959
There will be $1,055 in yearly costs per location for cellular and licensing fees.
FUNDING SOURCE
Capital Reserve Fund if approved. Funds are not budgeted for this project.
RECOMMENDATION
This item was placed on the agenda for consideration by Councilmember Getz and
Mayor Pro -Tern Feldschau.

BACKGROUND
Councilmembers Getz and Neild have requested a vote by the City Council to construct.a dog park
at Rogers Park. If approved, the Facilities Maintenance Department will move forward to develop
specifications for the project and go out for bids for construction. The dog park would have similar
amenities as the one located at Ida Reed Park.
FUNDING SOURCE
This project is not funded.. If approved, funds would be paid for out of the Capital Reserve Fund.
Because -the specific amenities have not been finalized, the cost estimate is between $75,000 to
$100,000.

I am requesting an agenda item to construct a dog park at Rogers Park be placed on the agenda next week for an up or
down vote. Councilmember Neild is my second. A budget estimate has been previously prepared by Keith Folsom of
$116,980 with a concrete apron running under the fence.
I personally think the apron is unnecessary as it adds $37,800,to the price. Without the concrete apron, the cost is
reduced to $79,180.00. But I am good either way.
A parking lot off of Gladys would be nice but at an additional cost of an additional $98,000.00, 1 am not sure it is
necessary at this time. It may want to be considered to construct the dog park with an eye towards construction of the
parking lot in the future.
While I realize this is not a budgeted item, you noted this past week the extremely healthy position of our fund balance.
We have also been the beneficiary of the proceeds of the sale'of the Melton facility and the former Fire Station Number
One as well as the associate relief from the financial burden of maintaining these facilities.
This is a quality of life item that is relatively inexpensive. It will provide a good return on investment because the cost of
the project relative to the likely use of the dog park is low. Nearly 2,500 people have signed a petition requesting this Dog
Park be constructed and I think that it is time to move forward on it.

I added the construction of three possible dog parks, at three locations to be determined by the City Council, in the FY
2020 Capital Program under "Projects for Consideration." I removed it from the FY 2021 Capital Program because while
these improvements would be nice amenities to have, they are; not a priority due to the financial challenges we face. We
basically streamlined the entire list of projects listed in the Capital Program.
Councilman Getz requested that an estimate be provided for 4 possible dog park at Rogers Park. He would like to have a
work session on this subject. At this time, I do not have a Councilmember who has seconded this request in writing.
Please do not respond to this group e-mail. I simply wanted all of you to have the same information being provided to
him.
If this request gets a second, I will let all of you know and schedule it as a discussion item. The project is not listed in the
Capital Program or the Capital Reserve (where we budget for equipment and vehicle purchases as well as some facility
improvements). If the Council were to approve a new dog park, funds would need to be approved out of the fund balance
in the General Fund or the Capital Reserve Fund.
