Vice -Chairman Makin seconded the motion. Motion to approve carried 8:0. Planning Commission April 16, 2007 REGULAR MEETING 1) Prelimina Plat -Ronald Domoneck Subdivision: Consider the Preliminary Plat of Ronald Domoneck Subdivision, Section 2; a 1.4 acre tract out of Lot 54 of the Beaumont Improvement Subdivision. Applicant: Faust Engineering & Surveying, Inc. Mr. Richardson presented the staff report. Faust Engineering and Surveying has applied for preliminary plat approval of a six lot, single family residential subdivision. The property is located south of Bennett Road and west of Signora Lane. A preliminary plat was previously approved in 2003. Public improvements were constructed but no final plat was submitted and the preliminary plat expired. Mr. Richardson recommended approval subject to the following conditions as well as an additional condition received on Friday from Water Utilities - have the engineer verify the exact locations of the water and sanitarysewer installations and show as-builts on the preliminary plat: Provide proof of payment for street lights and poles. (Transportation) Label the name of the cul-de-sac. (Planning) Provide the owner's signature on the plat. (Planning) Chairman Bodwin asked for the applicant's comments. Richard Faust with Faust Engineering and Surveying, Inc., the applicant, addressed the Commission. Commissioner Leister made a motion to approve the Preliminary Plat of Ronald Domoneck Subdivision, Section 2 subject to the following conditions: • Have the engineer verify the exact locations of the water and sanitary sewer installations and show as-builts on the preliminary plat. • Provide proof of payment for street lights and poles. • Label the name of the cul-de-sac. • Provide the owner's signature on the plat. Commissioner Kyles seconded the motion. Motion to approve carried 8:0. 2) Preliminary Plat - Willow Creek Country Club Estates, Section X-C: Consider the Preliminary Plat of Willow Creek Country Club Estates, Section X-C; Lots 1-15, Block l; Lots 1-8, Block 2; 5.1808 acres of land out of the S. Stivers League, Ab. No. 51. Applicant: Fittz & Shipman, Inc. 2 Planning Commission �1 April 16, 2007 Mr. Richardson presented the staff report. Fittz and Shipman has applied for preliminary plat approval of a 23 lot, single family residential subdivision. The property is north of Walden and west of Willow Bend. Mr. Richardson recommended approval subject to the following conditions: • Minimum drainage pipe size under Quail Hollow Drive shall be 18". (Engineering) • Drainage casements between Lots 2 and 3 and Lots 8 and 9 shall be 15' wide. (Engineering) • Provide proof of payment for street lights and poles. (Transportation) • Label size of proposed sanitary sewer lines. (Planning) • Show the size of the proposed sanitary sewer main. (Water Utilities) • Maintain separation distance between the sanitary sewer service and the water service for Lot 8. (Water Utilities) • The proposed water main will need to be looped and the future right-of-way retained as a right-of-way and access easement. (Water Utilities) • Provide the existing street name and the existing water main within this right-of-way. (Water Utilities) Move the water meter over for Lot 2 in order for the service to be perpendicular to the main. (Water Utilities) • Provide a chamfer across the southwest corner of Lot 12, Block 1. (DD#6) Storm sewers need to be constructed with DD#6's erosion control detail. (DD#6) Chairman Bodwin asked for the applicant's comments. John Holm with Fittz & Shipman, Inc. addressed the Commission. Applicant: Leap Engineering Mr. Richardson presented the staff report. Leap Engineering has applied for preliminary plat approval of Metropolitan Park, Phase Two, a 13 lot single family residential subdivision. The property is located west of Dowlen Road and north of Barrington Heights. Since the estate lots are located in A-R zoning, the garden homes will be the only portion platted this month. Mr. Richardson recommended approval subject to the following conditions and with a waiver of the temporary cul-de-sac requirement at the end of Metropolitan Drive: Revise the plat to reflect the platting of the garden homes only. • Label the size of the water and sewer lines and show their location within the garden homes section. • If zero lot line development is proposed, the appropriate building lines, necessary structural restrictions, five foot maintenance access easement and a maximum three foot roof overhang easement must be shown on the plat. • Water main will need to be looped. • All of the drainage pipe will need to adhere to DD#6's standard concrete erosion detail, • All the runoff from all the lots will need to be directed towards the proposed street and not be allowed to run across the DD46 berm and basin slope. Chairman Bodwin asked for the applicant's comments. Amelia Villareal with Leap Engineering addressed the Commission. Commissioner Craig made a motion to approve the Preliminary Plat ofMetropolitan Park, Phase II subject to the following conditions and with a waiver of the temporary cul-de-sac requirement at the end of Metropolitan Drive: • Revise the plat to reflect the platting of the garden homes only. Applicant: Shiner Investments, Inc. Mr. Richardson presented the staff report. Joe Dougharty, representing Shiner Investments, has requested the abandonment of a 20' x 50' portion of an unimproved alley in Block-29, Calder Addition. AT&T and City of Beaumont Water Utilities have facilities in the alley. Mr. Richardson recommended approval subject to retaining a 20' wide easement, prohibiting structures within the easement and not holding Water Utilities responsible for any surface restoration when sanitary sewer main repairs are necessary. Chairman Bodwin asked for the applicant's comments. Joe Dougharty with Shiner Investments addressed the Commission. Choate League, Ab. No. I Applicant: Faust Engineering & Surveying, Inc. Mr. Richardson presented the staff report. This item was denied last month by the Planning Commission. r—� t—� Planning Commission April I6, 2007 After the meeting, the developers met with Chris Boone and Mr. Richardson and they were told that either the number of lots must be reduced to 24 or the streets must be built to urban street standards and a variance requested for the additional two lots. Mr. Richardson recommended approval subject to the following conditions and recommends waivers to the maximum number of lots from 32 to 34 and to the minimum one acre lot size: • Revise the preliminary plat to reflect a minimum 50' wide right-of-way and a 26' pavement width (face to face of curb) with underground drainage for all streets. (Planning) • Construct a sidewalk along the west side of Reins Road. (Planning) • Satisfy DD#6's drainage concerns on Reins Road. (DD#6) • Construct headwalls on all drainage pipe crossings. (Engineering) • Provide proof of payment for all strectlights and poles. (Transportation) Chairman Bodwin asked for the applicant's comments. Richard Faust with Faust. Engineering & Surveying addressed the Commission. Jerome Cope, developer of River Ranch, addressed the Commission. Commissioner Leister made a motion to deny the Preliminary Plat of River Ranch as requested. Commissioner Moor seconded the motion. Motion to deny carried 8:0. ROLL CALL JOINT PUBLIC HEARINGS Mayor Goodson called the Joint Public Hearings of April 16, 2007 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Bodwin. He explained the policies and procedures for the hearing process. 1) File 1878-P: Request for a zone change from RS (Residential Single Family Dwelling) District to GC=MD (General Commercial -Multiple Family Dwelling) District or more restrictive district. Location: 7750 Highway 105 Applicant: Dwain Adcock for Northwest Church of Christ Mr. Richardson presented the staff report. This item is a request for a zone change from RS to GC -MD or more restrictive district for the purpose of allowing a larger �. owner identification sign than is currently permitted. no Planning Commission April 16, 2007 Northwest Church of Christ wants a sign that it 26' in height and a total of 150 sq. ft. in area. He states that a sign this size is necessary to be seen a quarter of a mile away when someone is driving 55 mph. Currently, RS zoning allows a church to have a sign 50 sq. ft. in area and 15' tall. GC -MD zoning allows a SO'sign with unlimited square footage. Mr. Richardson recommended denial because RS zoning allows a sign more in keeping with what is allowed for gas stations approximately 300' to the east. When those regulations were written, highway speed along Highway 105 was taken into consideration. Ten notices were mailed to property owners within 200 feet. One response in favor and none in opposition were returned. Slides of the subject property were shown. Chairman Bodwin opened the public hearing and asked for the applicant's comments. Dwain Adcock, the applicant, addressed the Commission. Chairman Bodwin asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Leister made a motion to deny a zone change from RS (Residential Single Family Dwelling) District to GC -MD (General Commercial -Multiple Family Dwelling) District or more restrictive district for the property at 7750 Highway 105 as requested in File 1878-P. Commissioner Hallmark seconded the motion. Motion to deny carried 8:0. 2) File 1880 P: Request for a specific use permit to allow a data communications tower in an LI (Light Industrial) District. Location: 1775 W. Cardinal Drive Applicant: Peter Bedard for Matrix Engineering Mr. Richardson presented the staff report. Peter Bedard, representing Matrix Engineering, states that the tower will be 70 feet tall and will be anchored by guy wires. An 8 foot tall chain link fence will surround the tower. Mr. Richardson recommended approval of the request. Six notices were mailed to property owners within 200'. No responses in favor or in opposition were returned. h .� Planning Commission April 16, 2007 Slides of the subject property were shown. Chairman Bodwin opened the public hearing and asked for the applicant's comments. Mr. Bedard, the applicant, addressed the Commission. Discussion followed between Mr. Bedard and staff followed. Chairman Bodwin asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Leister made a motion to approve a specific use permit to allow a data communications tower in an LI District at 1775 W. Cardinal Drive as requested in File 1880-P, subject to the removal of the tower if it becomes abandoned. Commissioner Craig seconded the motion. Motion to approve carried 8:0.
