Commissioner Makin seconded the motion. The motion to approve the minutes carried 6:0. REGULAR MEETING 1) PZ2020-166 (Replat- Mildred Addition Lots 1-4, Block 5): Request for a Replat of Lots 1-4 into Lots IA & 2A, Block 5, Mildred Addition, Beaumont, Jefferson County, Texas. Applicant: Bob Sims of Access Surveyors, L.L.C. Location: 4455 & 4465 Bob Street Mr. Boone presented the staff report. Bob Sims of Access Surveyors, L.L.C., has requested approval of a Replat of Lots 1-4 into Lots 1A & 2A, Block 5, Mildred Addition, Beaumont, Jefferson County, Texas. The intention of the plat is to combine four (4) lots, reconfiguring their direction and create two (2) larger lots. This plat meets all ordinance requirements for residential lots. City water and sewer are present near the property and appear to be adequate for the new projects. Slides of the subject property and site plan were shown. Fifteen (15) notices were mailed to property owners within two hundred (200) feet of the subject property. Three (3) responses were received in opposition and zero were received in favor. Mr. Boone read the letters received in opposition and indicated their property locations on the map. In response to concerns raised in the letters of opposition, Mr. Boone stated that the replat would not preclude access to their properties and does not preclude future development. Brief discussion followed about the responsibility of any future developers to build to the City standard and the process to make Mildred Street public. There was also discussion concerning possible future easement issues, Staff recommended approval with the following condition: 1. Placement of a note on the final plat stating: Mildred Street shall not be used for vehicular access until such time as it is improved and accepted as public by the City of Beaumont. The public hearing was opened on the item. Linda Young, 9390 Riggs Street, addressed the Commission. She stated that she and her father own property near the proposed replat and she indicated their properties on the map. She expressed concerns about how Mildred Street will be developed and whose responsibility it will be to develop it. Staff clarified that Mildred Street had been platted but never developed and that a private developer could develop it and make it public but that it is not the City's responsibility Planning Commission December 21, 2020 to do so. Ms. Young expressed her opposition to the replat until Mildred Street is developed, She stated she also opposes the replat due to increased mud and distraction. The applicant was present. Colby Brackin, representing Access Surveyors, 11025 Old Voth Road, addressed the Commission. He stated that they intend to change four (4) lots into two (2) with road frontage facing Bob Street, He added that this will be a beneficial layout of the land for his client and that they are not trying to acquire any right-of-way or any additional Iand. The public hearing was closed. Commissioner Quraishi moved to approve the request for a for a Replat of Lots 1-4 into Lots IA & 2A, Block 5, Mildred Addition, Beaumont, Jefferson County, Texas, as requested in file PZ2020-166, with the following condition: 1. JOINT PUBLIC HEARINGS Mayor Ames called the Joint Public Hearings of December 21, 2020 to order at 3:32 p.m. and explained the purpose of the Joint Public Hearing process. Mayor Ames then turned the meeting over to Chairman Nej ad to conduct the Joint Public Hearings. 2) PZ2020-154 (2431-P): Request for a Specific Use Permit to allow a Banquet Hall in an RCR (Residential Conservation Revitalization) District. Applicant: Calvin Lovely Location: 590 Royal Street Mr. Boone presented the staff report. Calvin Lovely is requesting permission for a Banquet Hall at 590 Royal Street. He states that most of the former Banquet Halls in this neighborhood have closed, leaving a void. No alcohol will be allowed at this Banquet Hall. Mr. Lovely states he intends to install an eight (8) foot tall wooden fence along the north and east property lines. As he intends to expand the parking lot, there will not be sufficient room along the east property line for the required ten (10) foot wide Iandscaped buffer. Mr. Lovely is requesting a waiver to this buffer to allow more off street parking with crushed limestone. The existing driveway exceeds the maximum width per city standards. The driveway should match the width of the parking lot aisle. In addition, the parking layout will need to be revised with 9 foot wide parking spaces. On -street parking may present a hazard to the fire station. Reasonable efforts should be made to prevent guests from blocking the roads. The applicant states that he plans to install shrubbery around the front and left side of the property. However, the City Ordinance requires a six (6) foot wide landscaped strip between parking areas and the right-of-way including trees and shrubs. 3 Planning Commission December 21, 2020 To avoid future drainage issues, the proposed crushed limestone will need to be graded to drain towards the exterior property lines then flow towards the street via a grassy swale. However, it is recotru-vended that asphalt or concrete be used to widen the parking lot, which can drain to the existing surface inlet and avoid having to construct ditches along the perimeter. SIides of the subject property, site plan and surrounding area were shown. Twenty-five (25) notices were mailed to property owners within two hundred (200) feet of the subject property. One response was received in opposition and zero were received in favor. Mr. Boone read the letter received in opposition, which expressed concern about parking and potential noise in the residential area. Discussion followed about potential parking conflicts with the fire station across the street. Mr. Boone stated that the owner can encourage his visitors not to park on Royal Street and if it does become an issue, the City could install "No Parking" signs. Staff recommended approval of the request with the following condition: 1. A revised site plan be submitted demonstrating required perimeter landscaping and parking that meets current regulations. The applicant was present. Calvin Lovely, 5485 Ada Avenue, addressed the Commission. He stated that the subject property was used as a union hall in the past. He added that he is a member of the union which merged with another chapter, leaving this property for sale. He stated that he would like to open a location for weddings, repasts, baby showers, and other family friendly parties. He added that the neighbors he has spoken to are in favor of the request. Mr. Lovely stated that he would keep the noise down and will expand the parking lot in order to prevent parking conflict with the fire station. Finally, he added that the south end of town does not currently have a good location for events and that this will be an affordable option to benefit the neighborhood. Chairman Nejad asked if the applicant understood the proposed condition to the request and Mr. Lovely confirmed his understanding. The public hearing on this request was opened and closed without comment. Commissioner Senigaur moved to approve the request for a Specific Use Permit to allow a Banquet Hall in an RCR (Residential Conservation Revitalization) District, as requested in file PZ2020-154 (2431-P) with the following condition: 1.
