REGULAR MEETING AND JOINT PUBLIC HEARINGS PLANNING COMMISSION CITY COUNCIL July 17, 2006 City Council Chambers ARegular Meeting and Joint Public Hearings of the Planning Commission and City Council were held on July 17, 2006 with the following members present: Commission members present: Commissioner Laurie Leister Commissioner Sina Nejad Commissioner Marty Craig Commissioner Walter Kyles Commissioner Greg Dykeman Alternate Commissioner Steven Johnson Commission members absent: Chairman Glenn Bodwin Vice Chairman Lynda Kay Makin Commissioner Dale Hallmark Alternate Commissioner Ted Moor Councilmembers present: Mayor Guy Goodson Councilmember-at-Large Becky Ames Councilmember Lulu Smith Councilmember Audwin Samuel Councilmember Bobbie Patterson Councilmembers absent: Councilmember-at-Large Andrew Cokinos Mayor Pro-Tem Nancy Beaulieu Also present: Stephen Richardson, Planning Manager; Adina Abshire, Planner; Tyrone Cooper, City Attorney; Joe Sanders, First Assistant City Attorney; Carla Gighotta, Recording Secretary APPROVAL OF THE MINUTES Commissioner Craig made a motion to approve the minutes of the Regular Meeting and Joint Public Hearings held June 19, 2006. Commissioner Nejad seconded the motion. Motion to approve carried 6:0. Planning Commission July 17, 2006 3) File 695-OB: Request for the abandonment of a 30' drainage and utility easement. Location: 4230 Pierre Drive Applicant: James Carter Mr. Richardson presented the staff report. Mr. and Mrs. Carter, the applicants, want to install a swimming pool and abandoning the easement will allow them to do that. The request was sent to all interested parties. Water Utilities stated that there is an 8" sanitary sewer line in the easement. Because there are homes to the west of the subject property that are served by this line, the entire sewer line would have to be moved. Therefore, Water Utilities recommended denial of the request. AT&T and Time Warner also have facilities in the easement and object to the abandonment. Mr. Richardson recommended denial of the request. A lternate Commissioner Johnson seconded the motion. Motion to deny carried 5:0. JOINT PUBLIC HEARINGS Mayor Goodson called the Joint Public Hearings of July 17, 2006 to order and explained the purpose of the joint hearing process and then turned the meeting over to Commissioner Leister. She explained the policies and procedures for the hearing process. 1) File 1828-Z: Request for a zone change from RM-H (Residential Multiple Family Dwelling -Highest Density) to PD (Port Development) District or more restrictive district. Location. Blocks bordered by Buford to the north, Carroll to the east, Stewart to the south and Leiper to the west. Applicant: Port of Beaumont Commissioner Dykeman arrived. Mr. Richardson presented the staff report. The Port of Beaumont owns the subject property and states that it plans to use the property for the parking of vehicles and/or staging of equipment and such activities that are comparable to light industrial activities. T he subject property is surrounded by vacant properties and is located in an area that is not conducive to residential uses. 3 Planning Commission July 17, 2006 Mr. Richardson recommended approval of the request. Twenty five notices were mailed to property owners within 200 feet of the subject property. No responses in favor or in opposition were returned. Slides of the subject property were shown. Discussion followed between the Commission, City Council and staff. Councilman Samuel expressed concerns about the development in the area and the continuing encroachment into the Charlton Pollard neighborhood. When community meetings were held with ExxonMobil and the Port of Beaumont, the neighborhood association was told that there would be a buffer and no further encroachment beyond that buffer. At that time, it was also stated that there would be a green zone or buffer zone to give some aesthetic quality to the neighborhood. He said that because the promises made to the residents of the area have not been fulfilled when they agreed to allow the further development, he can not support the move forward and agree with the process. Commissioner Leister opened the public hearing and asked for the applicant's comments. Lavelle Lemonier, Director of Finance Administration for the Port of Beaumont, addressed the Commission. Mr. Lemonier stated that he met with the neighborhood association to discuss the Port's plans. Chris Fisher, Executive Director of the Port of Beaumont, addressed the Commission. Commissioner Leister asked for comments in favor or in opposition. Helen Piert, 1635 Verone, addressed the Commission. Mrs. Piert had concerns if she were forced to relocate. The public hearing was closed. Commissioner Dykeman made a motion to approve a zone change from RM-H to PD District for the blocks bordered by Buford to the north, Carroll to the east, Stewart to the south and Leiper to the west as requested in File 1828-Z. Alternate Commissioner Johnson seconded the motion. Motion to approve carried 5:1 (Craig). 4 Planning Commission July 17, 2006 2) File 1829-Z: Request for a zone change from RS (Residential Single Family Dwelling) to GC -MD (General Commercial -Multiple Family Dwelling) District or more restrictive district. Location: 2916 E. Lucas Applicant: Brammer Construction Co., Inc. Mr. Richardson presented the staff report. The purpose of the zone change is to allow the construction of a commercial shopping center. The south 150' of the property is already zoned GC -MD. Across Idylwood is an existing convenience store. Proposed plans for the shopping center have it fronting E. Lucas with access to both E. Lucas and Idylwood. Proposed businesses in the center include a washateria, nail shop, beauty shop and barber shop. This development will provide much needed services to the north end of Beaumont. Mr. Richardson recommended approval of the request. Twenty-four notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned. Slides of the subject property were shown, Commissioner Leister opened the public hearing and asked for the applicant's comments. (Commissioner Nejad left the meeting.) Martin Robinson with Bramner Construction, the applicant, addressed the Commission on behalf of the property owner, Charles Lee. Mr. Robinson stated that the hours of business would be 8 a.m. to 10 pan. and that directional lighting would be used. Commissioner Leister asked for comments in favor or in, opposition. No comments were made. The public hearing was closed. Commissioner Leister made a motion to approve a zone change from RS (Residential Single Family Dwelling) to GC-MD-2 (General Commercial -Multiple Family Dwelling-2) District for the property at 2916 E. Lucas as requested in File 1829-Z. Commissioner Craig seconded the motion. Motion to approve carried 5:0. 3) File 1830-P: Request for a specific use permit to allow a church in an RS (Residential Single Family Dwelling) District. Location: 3900 block of Pointe Parkway Applicant: Christian Fellowship Worship Center, Inc. 5 Planning Commission July 17, 2006 Mr. Richardson presented the staff report. Christian Fellowship Worship Center would like to construct a 15,000 sq. ft. sanctuary building with Sunday school classrooms and administrative offices in Phase One. Future phases include the construction of a family life center and a gymnasium. Mr. Richardson recommended approval subject to the providing a adequately landscaped 30' landscape buffer on the south side of the property. The applicant is agreeable to this condition. Five notices were mailed to property owners within 200 feet. One response in favor and none in opposition were returned. Slides of the subject property were shown. Commissioner Leister opened the public hearing and asked for the applicant's comments. Joe Pattie with Carroll and Blackman, Inc. addressed the Commission. Commissioner Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Kyles made a motion to approve a specific use permit to allow a church in an RS District located in the 3900 block of Pointe Parkway subject to providing a 30' landscape strip along the south property side of the property.
