Commissioner Craig seconded the motion. Motion to approve carried 6:0. Planning Commission December 15, 2008 REGULAR MEETING 1) Preliminary Plat- Jehovah Jireh Village, Phase II: Consider a Preliminary Plat of Jehovah Jireh Village, Phase II; Lots 1-9, Block 3 and Lots 1-9, Block 4; 4.9836 acres out of the J. W. Bullock Survey, Abstract No. 7 Applicant: Mark Whiteley & Associates, Inc. Mr. Richardson presented the staff report. The subject property is located on the south side of Sarah Street, cast of Jehovah Jireh Village, Phase One. Jehovah Jireh Village Phase II is an 18 lot single family residential subdivision. The 4.98 acre subdivision will be accessed by Rohi, a local street with a 50' wide right-of-way and a 27' pavement width. Water and sewer will be installed to meet City specifications. This item was sent to all interested parties. A number of conditions were received from several departments. Mr. Richardson recommended approval subject to the following conditions: 1) Provide the necessary fire hydrants to meet city code. (Fire Marshal) 2) Street lights are required at 200' spacing and at the intersection of Rohi and Sarah. (Traffic Engineering) 3) Developer responsible for installation of traffic signs as required for subdivision acceptance. (Traffic Engineering) 4) Refer to the City of Beaumont Water Utilities standard detail sheet, typical long and short side water and sanitary sewer service connection standard detail, for the correct location of the water and sanitary sewer service lines. (Water Utilities) 5) The 3" Schedule 80 PVC conduit should be located within the 10' utility easement and not within the right-of-way. (Water Utilities) 6) Show the location of the sanitary sewer service line for Lot 6, Block 3. (Water Utilities) 7) Relocate curb stop and flush out to just past the water service for Lot 6, Block 3 and show water service. (Water Utilities) 8) Water service lines are to be 1 '/2". Size of the 2" water line around cul-de- sac may need to be increased to accommodate the materials needed. (Water Utilities) 9) Water Utilities will review the water and sewer design in detail when the preliminary construction plans are submitted for the subdivision only and will address their comments at that time. (Water Utilities) 10) Show the existing right-of-way and pavement widths of Sarah St. (Engineering) 11) Show starting point of centerline of Rohi Street at centerline of Sarah. (Engineering) 12) Show flow arrows for gutter. (Engineering) 13) Radius of Rohi Street at Sarah must be 20'. (Engineering) N Planning Commission December 15, 2008 14) Label 10' utility casement on east side o£Rohi Street. (Engineering) 15) Make tie-in to junction box at an angle less than 90 degrees. (Engineering) 16) The radius of the cul-de-sac is 33.5' from the centerline of the street. (Engineering) 17) Add Note #5 - "All lots shall be graded to drain to the street. No lot shall drain onto adjacent lots before or after structures are built." Chairman Makin asked for the applicant's comments. Mark Whiteley addressed the Commission and asked them to condition their approval with exception to the design details that could be worked out. Mr. Richardson suggested that the Commission approve with exception to conditions 8, 13 and 16. Commissioner Reed made a motion to approve a Preliminary Plat of Jehovah Jirelt Village, Phase 11; Lots 1-9, Block 3 and Lots 1-9, Block 4; 4.9836 acres out of the J. W. Bullock Survey, Abstract No. 7 subject to the conditions listed in the staff report with the exception of conditions 8, 13 and 16 which are to be reached after a review of the design detail plan. Commissioner Bodwin seconded the motion. Motion to approve carried 6:0. 2) File 740-OB: Consider a request to abandon Taft Street from the east right-of-way line of Ridgeland Avenue, east 100 feet. Location: 4500 block of Taft Street Applicant: Michael and Diane Zambardino and Paul and Ruthie Robinson Mr. Richardson presented the staff report. The applicants, Mr. and Mrs. Michael Zambardino and Mr. and Mrs. Paul Robinson, have applied for an abandonment of that 100' long portion of Taft. The applicants state that they have maintained the unimproved right-of-way for the past twenty years. This maintenance includes mowing, hauling dirt to improve the drainage and sodding when needed. The City has no plans to improve this portion of Taft. Taft deadends at the rear fence of the property at 4385 Brownstone. Three notices were mailed to adjacent property owners. The applicants returned two responses in favor. One response in opposition, submitted by the property owner at 4385 Brownstone, was returned. Chairman Makin opened the public hearing and asked for the applicant's comments. Ruthic Robinson, an applicant, addressed the Commission. Mike Zambardino, an applicant, addressed the Commission. Planning Commission December 15, 2008 Chairman Makin asked for comments in favor or in opposition. Chip Ferguson, 4385 Brownstone, addressed the Commission. Mr. Cooper stated that if City Council approves the abandonment, it does not necessarily mean the property will go to the applicant. Rebuttal by Mr. Zambardino and Mrs. Robinson. Commissioner Reed made a motion to approve a request to abandon that 100' long portion of Taft Street, east of Ridgeland Avenue as requested in File 740-OB. Commissioner Bodwin seconded the motion. Motion to approve carried 4:2 (Nejad, Kyles). ROT,L CALL JOINT PUBLIC HEARINGS Mayor Pro-Tem Samuel called the Joint Public Hearings of December 15, 2008 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Makin. She explained the policies and procedures for the hearing process. 1) File 1970-P: Request for a specific use permit to allow a church and a community outreach center in an RS (Residential Single Family Dwelling) District. Location: Northwest corner of Best and Broussard Applicant: Pastor Henry F. Brown, Jr. For Colossians Christian Center Church Mr. Richardson presented the staff report. Pastors Henry and Tquita Brown, representing Colossians Christian Center Church, would like to construct a new church on the subject property. Pastors Brown state that the church will serve the community through a variety of ministries. In addition to two Sunday services, the church will provide a variety of activities throughout the week. The initial phase of construction will consist of a 9,500 sq. ft. sanctuary and the necessary parking. A future phase will consist of a 6,719 sq. ft. community fitness and outreach center and related parking. The church will accommodate a maximum attendance of 500 persons. Mr. Richardson recommend approval subject to the following conditions: • The site plan must comply with City drainage requirements. • Off-street parking lot and driveway dimensions and number of off-street parking spaces must comply with City standards. • The parking lot must meet landscaping requirements both within the interior of the parking lot and along all street frontages. A sidewalk will be required along Broussard. 4 Planning Commission December 15, 2008 Sixteen notices were mailed to property owners within 200 feet. No responses in favor and one in opposition were returned. Slides of the subject property were shown. Chairman Makin opened the public hearing and asked for the applicant's comments. Pastor Henry Brown addressed the Commission. Chairman Makin asked for comments in favor or in opposition. David Fountain, 1135 Best Road, addressed the Commission. Mr. Fountain expressed concerns that developments other than residential would have a negative impact on his property value. Rebuttal by Pastor Brown. Commissioner Kyles made a motion to approve a specific use permit to allow a church and a community outreach center in an RS District at the northwest corner of Best and Broussard as requested in File 1970-P, subject to the following conditions: • The site plan must comply with City drainage requirements. • Off-street parking lot and driveway dimensions and number of off-street parking spaces must comply with City standards. • The parking lot must meet landscaping requirements both within the interior of the parking lot and along all street frontages. • A sidewalk will be required along Broussard. • An.8' fence and 10' wide landscape strip will be required along the north and west property lines. Commissioner Craig seconded the motion. Motion to approve carried 6:0. 2) File 1971-P: Request for a specific use permit to allow pre -owned auto sales in an NSC (Neighborhood Shopping Center) District and GC-MD-2 (General Commercial -Multiple Family Dwelling-2) District. Location: W. Lucas at Arthur Applicant: Tony and Dana Archibald Mr. Richardson presented the staff report. Tony and Dana Archibald state that the majority of the activity will take place on a paved area between the car wash and the storage facility. The office for the storage facility will be used as the office for the car sales. The vehicles will be displayed during the day and then moved behind the fenced area during the night. No more than six cars will be for sale at any one time. Mr. Richardson recommended approval of the request. 5 Planning Commission December 15, 2008 Thirty notices were mailed to property owners within 200 feet. One response in favor and two responses in opposition were returned. Slides of the subject property were shown. Chairman Makin opened the public hearing and asked for the applicant's comments. Tony Archibald addressed the Commission. Chairman Makin asked for comments in favor or in opposition. No continents were made. The public hearing was closed. Commissioner Craig made a motion to approve a specific use permit to allow pre- owned auto sales in anNSC (Neighborhood Shopping Center) District and GC-MD- 2 (General Commercial -Multiple Family Dwelling-2) District at W. Lucas at Arthur as requested in File 1971-P. Commissioner Nei ad seconded the motion. Motion to approve carried 6:0. 3) File 1972-P: Request for a specific use permit to allow church parking in an RS (Residential Single Family Dwelling) District. Location: 1135 Chamberlin Applicant: Calvary Tabernacle Ministries Mr. Richardson presented the staff report. Pastor Carl Vickery of Calvary Tabernacle states that the church has seen recent growth and the church is in dire need of additional parking. hi May, 2008, the church bought this property to the north so that it could build additional parking. Mr. Richardson recommended approval subject to the following conditions: The parking lot must be in compliance with the City's drainage requirements. The driveway and parking lot must be in compliance with the City's parking lot and driveway standards. hi particular, the new driveway must be located a minimum of 10' from the north property line. A six foot wide landscape strip must be installed along the street frontage of the new parking lot. Sixteen notices were mailed to property owners within 200 feet of the subject property. No responses in favor or in opposition were returned. Slides of the subject property were shown. Chairman Makin opened the public hearing and asked for the applicant's continents. Pastor Vickery, the applicant, addressed the Commission. 0 Planning Commission Dewniber 15, 2008 Chairman Makin asked for continents in favor or in opposition. No comments were made. Commissioner Nejad made a motion to approve a request for a specific use permit to allow church parking in an RS (Residential Single Family Dwelling) District at 1135 Chamberlin as requested in File 1972-P, subject to the following conditions: The parking lot must be in compliance with the City's drainage requirements. The driveway and parking lot must be in compliance with the City's parking lot and driveway standards. In particular, the new driveway must be located a minimum of 10' from the north property line. A six foot wide landscape strip must be installed along the street frontage of the new parking lot. Commissioner Kyles seconded the motion. Motion to approve carried 6:0. 4) File 1973-P: Request for an amended specific use permit to allow for expansion of a medical building in a GC-MD-2 (General Commercial -Multiple Family Dwelling- 2) District. Location: Northeast corner of Folsom and Pointe' Parkway Applicant: Clifton Thomason Mr. Richardson presented the staff report. In June, 2008, a specific use permit was approved for a 25,400 sq. ft. medical office building. Since then, the developer has potential commitments for additional space. Therefore, he would like to enlarge the proposed building by another 3,373 sq. feet. Mr. Richardson recommended approval subject to the following conditions: • Drainage of the proj ect must comply with the City's drainage requirements (Engineering); • The driveways and parking lots must comply with the City's driveway and parking lot standards (Traffic Engineering); • The perimeter and interior of the. parking lots must meet the City's landscaping requirements (Planning); • Provide an 8' tall wood screening fence along the north end of the subject property (Planning) • Sidewalks will be required along Folsom and Pointe' Parkway. (Planning) and with a waiver of the 10' wide landscape strip along the north property line. Nineteen notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned. Amalie Villareal with Leap Engineering addressed the Commission. Chairman Makin asked for comments in favor or in opposition. No comments were made. The public hearing was closed.
