A Regular Meeting and Joint Public Hearings of the Planning Commission and City Council
were held on January 26, 2009 with the following members present:

APPROVAL OF THE MINUTES
Commissioner Craig made a motion to approve the minutes of the Regular Meeting
and Joint Public Hearings held December 15, 2008. Commissioner Reed seconded
the motion. Motion to approve carried 5:0.

REGULAR MEETING
1) Replat - B. Maricle Subdivision; Consider a Replat of a portion of Lot 1, Block 9,
Wescalder Fig Acres into B. Maricle Subdivision.
Location: 2590 Wescalder Road
Applicant: Mark Whiteley & Associates, Inc.
Mr. Richardson presented the staff report. Tom Rowe, representing Mark W.
Whiteley & Assoc., has applied for a replat of a portion of Lot 1, Block 9,
Wescalder Fig Acres into Lots 1-3, B. Maricle Addition.
Mr. Rowe states that there are existing structures on Lots 1 and 3. As part of the
replat, he is requesting a variance to the side yard building setback on Lot 1. The
normal building setback requirement for an exterior side yard is 15'. The existing
residence on Lot 1 is approximately 3 5 years old and was constructed 13' from the
side property line.
In addition, Wescalder is classified as a major collector. As such, a minimum 60'
wide right-of-way is required: Wescalder currently has a 50' wide right-of-way.
While the City has no plans to widen Wescalder at this time, providing a 30' front
yard building setback would accommodate additional widening if it were to occur
in the future. The existing house is located approximately 3 8' back from the front
property line.
Mr. Richardson recommended approval subject to providing a 30' front building
setback along Wescalder and the variance to the side yard building setback from 15'
to 13'.
Twenty notices were mailed to property owners within 200 feet. No responses in
favor or in opposition were returned.
Commissioner Bodwin, acting as Chairman, opened the public hearing and asked
for the applicant's comments.
Tom Rowe with Mark Whiteley and Associates addressed the Commission.
Chairman Bodwin asked for comments in favor or in opposition. No continents
were made. The public hearing was closed.
Commissioner Craig made a motion to approve a Replat of a portion of Lot 1, Block
9, Wescalder Fig Acres into B. Maricle Subdivision located at 2590 Wescalder
Road subject to providing a 30' front building setback along Wescalder and the
variance to the side yard building setback from 15' to 13'. Commissioner Kyles
seconded the motion. Motion to approve carried 6:0.

2) File 741-OB: Consider a request to abandon the 20 foot alley in Block 1.1, Calder
Addition.
Location: Calder Avenue at M. L. King Parkway .
Applicant: Ronald J. Blount
Mr. Richardson presented the staff report. Ronald Blount, representing the
purchasers of 1515 Calder and 1585 Calder, has applied for the abandonmentof the
20' alley.
The purchasers intend to construct a store and service station on the site. The
purchasers' intent for the old Pig Stand Restaurant is unknown.
The purpose of the abandonment is to allow the closure of the alley's curb cut on
Martin Luther King Parkway. TxDOT is requiring the developers to close the curb
cut on Calder, closest to the intersection with MLK, and alley's curb cut. The
developers will then be allowed a curb cut on MLK, north of the alley.
This item was sent to all interested parties. No negative responses were received.
However, there are overhead utility lines in the alley.
Mr. Richardson recommended approval subject to retaining a 20' wide general
utility easement.
Commissioner Craig made a motion to approve a request to abandon the 20 foot
alley in Block 11, Calder Addition located at Calder Avenue at M. L. King Parkway
as requested in File 741-OB, subject to subj ect to retaining a 20' wide general utility
easement. Commissioner Kyles seconded the motion. Motion to approve carried
6:0.

JOINT PUBLIC BEARINGS
Mayor Ames called the Joint Public Hearings of January 26, 2009 to order and explained
the purpose of the joint hearing process and then turned the meeting over to Commissioner
Bodwin. He explained the policies and procedures for the hearing process.
1) File 1974-P: Request for a specific use permit to allow for temporary parking and
hookup to 6 RV's in an RM-H (Residential Multiple Family Dwelling -Highest
Density) District.
Location: 2350 North Major Drive
Applicant: Joe D. Self
Mr. Richardson presented the staff report. Joe Self, representing the Jehovah's
Witness Church, states that the Beaumont Relief Center Oversight Group of the

Jehovah's Witness Church is a temporary relief effort working under the direction
of the Texas Disaster Relief Committee of the church. That group has determined
that there is an immediate need to assist church members with repairs to their
homes.
The church would like to provide space for up to ten RV's. While most of the
volunteers will come from the Triangle area, there will be some from out of town.
Most of the activity will occur on weekends and take place at the back of the
church. In addition to the parking of the RV's, cooking for the volunteers, religious
services and coordinating the repair work will occur at thin site. The temporary
staging of building materials will be located off -site. Materials needed for the day
will be picked up and then distributed to the construction site.
While the parking of the RV's will be temporary, the church would like to
permanently install the water, sanitary sewer and electrical lines for the RV's. I
have informed he church that a specific use permit would be required again if there
is ever a need to temporarily park RV's for hurricane repairs.
Mr. Richardson recommended approval subject to the following conditions:
• A 30' wide landscape strip or an 8' tall wood screening fence and a 10' wide
landscape strip shall be installed along the east (rear) property line.
• The temporary parking -and hookup ofrecreational vehicles shall not extend
beyond June 30, 2009.
• No storage of building materials on site.
• All food trailers and storage shall be subject to the approval of the Health
Department.
• All fuel tanks shall be subject to approval of the Fire Marshall.
Thirty-two notices were mailed to property owners within 200 feet. One response
in favor and three in opposition were returned.
Slides of the subject property were shown.
Commissioner Bodwin opened the public hearing and asked for the applicant's
comments.
Joe Self, the applicant, addressed the Commission.
Bill Thomas with the Texas Disaster Relief Committee addressed the Commission.
Commissioner Bodwin asked for comments in favor or in opposition.
Sharlene St. Julien, 2365 Sunflower, addressed the Commission in opposition.
Sue Kelly, 2395 Sunflower, addressed the Commission in opposition to the request.

Rebuttal by Mr. Self and Mr. Thomas.
Commissioner Reed made a motion to approve a specific use permit to allow for
temporary parking and hookup to 6 RV's in an RM-H District at 2350 North Major
Drive as requested in File 1974-P, subject to the following conditions:
• A 30' wide landscape strip or an S' tall wood screening fence and a 10'
wide landscape strip shall be installed along the east (rear) property
line.
• The temporary parking and hookup of recreational vehicles shall be
limited to emergency relief efforts and shall not extend beyond June
30, 2009.
• No storage of building materials.
• All food trailers and storage subject to approval of the Health
Department.
• All fuel tanks subject to approval of Fire Marshal.
• No tents will be allowed.
• No more than 10 recreational vehicles will be allowed.
Commissioner Moor seconded the motion. The vote on the motion to approve
carried 3:3.
OTHER BUSINESS
Workshop - Regulation of the use of manufactured and modular building.
