Commissioner Bodwin seconded the motion. Motion to approve carried 7:0. REGULAR MEETING 1) Preliminary Plat - Gentry Estates: Consider the Preliminary Plat of Gentry Estates; Block 1, Lots 1-36; 26.67 acres out of the E. Raines Survey, Abstract 44 Applicant: Fittz and Shipman, Inc. Mr. Richardson presented the staff report. The subject preliminary plat is a 32 lot single family residential subdivision. The property is located on Gentry Road in the City of Beaumont ETJ. Gentry Estates will be served by three streets that are being built to urban standards. Motion to ; prove darried 6:1 (Bodwin). 2) Keliminary Plat - Willowi CreckParkway Right -of Wax: Consider the Preliminary Flat of Willow Creek Parkway Right -of -Way; 4.249 acres out of the S. Stivers League, Ab. 51. Applicant: Fittz & Shipman, Inc. Mx. Richardson presented the stiffreport. This item is a request for prelirninary plat approval of the right -of way for. Willow Creek Parkway. The property is located north of Ford Park. This street Will serve thenowBISD Multi Purpose Facility. The street right-of-way will be 80 feet wide with a 37' wide concrete pavement. Mx. pichardson recommended approval subject to the following conditions: Provide a new street name that is not a duplicate of an existing street. (911) A traffic impact reportshall be submitted for review and approved by the City of Beaumont prior to construction of the street. (Transportation Engineering) Add a statement to the plat that clearly states that BISD will construct all N Planning Commission March 16, 2009 of the drainage infrastructure outside of the road right-of-way and maintain in it perpetuity. The statement must ensure that the adjacent properties along the northwest and southwest sides of the BISD project, up to IH-10, and up to the canal on the southwest will be accommodated with respect to drainage, and will be allowed to drain through the culverts, ditches and detention pond on the BISD property. (DD#6) Show the size of the proposed sanitary sewer line. (Planning) Mr. Richardson added that the third condition had already been addressed by the applicant. Chairman Makin asked for the applicant's comments. Michelle Falgout with Fittz & Shipman, Inc., the applicant, addressed the Commission. Commissioner Kyles made a motion to approve the Preliminary Plat of Willow Creek Parkway Right -of -Way subject to the following conditions: Provide a new street name that is not a duplicate of an existing street. (911) A traffic impact report shall be submitted for review and approved by the City of Beaumont prior to construction of the street. Motion to approve carried 7:0. 3) Preliminary Plat - Doguet's Diamond D Ranch, Phase. Two: Consider the Preliminary Plat of Douget's Diamond D Ranch, Phase Two; 33.04 acres out of the James Gerish, Sr. League, A-25 and the James Gerish, Jr. League, A-25. Applicant: Fittz & Shipman, Inc. . Mr. Richardson presented the staff report. The subject property is located on the south side of Highway 90, approximately 1.1 mules west of Meeker Road and in the City's ETJ. Phase 11 consists of 35 single family residential lots. The property will be served by an extension of Diamond D Drive, a collector street and two residential streets. Diamond D will have an 80' wide right-of-way and 24' pavement width and open ditches to match that portion in Phase 1. The two residential streets will have to be built to urban standards with 28' pavement widths and underground storm sewer. The Diamond D Ranch Master Plan shows that approximately 503 lots will be platted overall. The Subdivision Regulations state that collector streets serving more than 450 lots should have a pavement width of 45'. Phase I was approved with a pavement width of 24'. It is the desire of the developer to continue with a 24' pavement width. Planning Commission March 16, 2009 Mr. Richardson recommended approval subject to the following conditions: • Verify that the scale is 1" = 80' • Diamond D Drive shall have a minimum pavement Width of 36' • Street lights shall be required as per City of Beaumont requirements • A sidewalk shall be required along one side of Diamond D Drive. with variances to the maximum cul-de-sac length requirement form 800 feet to approximately 1,276 fee and 1,050 feet, to the temporary cul-de-sac requirement, to the driveway access requirement and to the maximum block length requirement from 1,200 feet to approximately 1,276 feet. Commissioner Reed made a motion to approve the Preliminary Plat of Douget's Diamond D Ranch, Phase Two subject to the following conditions: • Verify that the scale is V = 80' • Diamond D Drive shall have a minimum pavement width of 36' • Street lights shall be required as per City of Beaumont requirements • A sidewalk shall be required along one side of Diamond D Drive. with variances to the maximum cul-de-sac length requirement form 800 feet to approximately 1,276 fee and 1,050 feet, to the temporary cul-de-sac requirement, to the driveway access requirement and to the maximum block length requirement from 1,200 feet to approximately 1,276 feet. Commissioner Kyles seconded the motion. Motion to approve carried 7:0. 4) File 744-OD: Request to abandon a 30' x 70.52' portion of an unnamed 30' street and drainage. easement. Location: 120' east of dead-end of Kipling Applicant: Harry Fuller Mr. Richardson presented the staff report. This item is a request for the abandonment of a 30' x 70.52' portion of an unnamed street and drainage easement. The property is located approximately 118' east of the dead-end of Kipling Drive. Harry Fuller, the applicant, owns the lot directly adjacent to the easement as well as the two contiguous lots. His lots all front on Kipling. Mr. Fuller states that the adjacent lots on Littlewood are higher than the adjacent lots on Kipling. He says that this creates a flooding and water log condition on the Kipling lots. He would like to lower part of the easement and place a drainage 4 Planning Commission March 16, 2009 conduit to the DDA drainage ditch near the property. Mr. Fuller wishes to build on the lot immediately adjacent to the subject property. The City of Beaumont Engineering Division and Time Warner Cable object to the abandonment. The City Engineer states that the easement might be used for a ditch improvement proj ect for drainage. Time Warner Cable states that it has strand and coax cable on existing aerial power poles within the easement. While Entergy did not object to the abandonment, it does have aerial power lines within the easement. Mr. Richardson recommended denial of the request. Three notices were mailed to adjacent property owners. A response in favor was returned by the applicant. Chairman Makin asked for the applicant's comments. Mr. Fuller addressed the Commission. Discussion followed between Mr. Fuller, the Commission and staff. Commissioner Nejad made a motion to table a request to abandon a 30' x 70.52' portion of an unnamed 30' street and drainage easement located 120' east of dead- end of Kipling as requested in File 744-OB. Conunissioner Reed seconded the motion. Motion to table carried 7:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:54 P. M.
