Pate, Jr.' At -Large BECKY AMES, MAYOR Randy Feldschau, Mayor Pro TernTaylor Neild, Ward I CITY COUNCIL MEETING Michael Getz, Ward II Audwin Samuel, Ward III DECEMBER 8, 2020 Robin Mouton, Ward IV Tyrone Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on December 8, 2020, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call * Presentation and Recognition * Public Comment: Persons may speak on scheduled agenda items 1 & 2/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Edison Colbert with Paradise Missionary Baptist Church gave the invocation. MayorAmes led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were MayorAmes;. Mayor Pro TernFeldschau, Councilmembers Neild, Pate, Samuel and Mouton. Absent: Councilmember Neild and City Attorney Tyrone Cooper. Also present were Kyle'Hayes, City Manager; Sharae Reed, 1st Assistant City Attorney; Tina Broussard, City Clerk. William "Boy" Brown Public Comment: Persons may speak on scheduled agenda items 1 & 2/Consent Agenda Addie Allen 9695 Gross Beaumont TX Commented on Items 1 and 2 of the Agenda; in regards to Item #1, asked about the Franchise Agreement with WM-D's Equipment Rentals, LLC, and section (5) five the indemnity, insurance and bond, in regards to Item #2, asked that Council consider having an evening meeting, thinks that parking would be better and to consider a better location due to COVID Minutes — December 8, 2020 CONSENT AGENDA Approval of minutes — November 24, 2020 Confirmation of committee appointments — None A) Approve the renewal of an annual maintenance agreement with CentralSquare for software used by Police, Fire and EMS — Resolution 20-268 B) Approve the purchase of Chest Compression Systems for use n the EMS Division — Resolution 20-269 C) Approve a resolution providing for the reimbursement of a capital expenditure incurred prior to the closing of financing — Resolution 20-270 Councilmember Getz moved to approve the Consent Agenda. Councilmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider an ordinance granting a new solid waste franchise agreement to WM-D's Equipment Rentals, LLC. According to City Ordinance 22.05.101, no person shall engage in the business of collecting, hauling or transporting, in the city, any garbage, waste or refuse, without first having obtained. a franchise from the City. Ten entities currently have nonexclusive franchise agreements with the City. WM-D's Equipment Rentals, LLC has requested that the City Council grant the company such franchise agreement. WM-D's Equipment Rentals is a small locally owned business renting roll off boxes with its Beaumont office located at 8605 Broussard Road. The franchise agreement would provide for a term of one year from its effective date and a franchise fee of seven percent (7%) of gross revenues received for service. It also requires the entity to indemnify the City of Beaumont and provide insurance which names the City of Beaumont as a named insured. According to the City Charter, franchise ordinances require readings at three separate Council meetings, with the third not less than thirty (30) days from the first reading. The ordinance does not take effect until sixty (60) days after its adoption on the third and final reading. After passage, the ordinance must be published for four consecutive weeks in a newspaper of general circulation in the City. All publication costs are paid by the applicant. Attached is a copy of the proposed agreement. This is the first reading. Minutes — December 8, 2020 A franchise fee of seven percent (7%) of gross receipts will be paid to the City. Approval of the ordinance. Mayor Pro Tern Feldschau moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE GRANTING A FRANCHISE FOR SOLID WASTE COLLECTION AND TRANSPORTATION SERVICES TO WM-D'S EQUIPMENT RENTALS, LLC. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS PATE; SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 20-068 2. Consider a resolution endorsing a plan to have a City Council meeting in the evening once a quarter. This item was requested to be placed on the agenda by Councilmembers Neild and Getz. Councilmember Getz requested this item be tabled for a week. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM FELDSCHAU, COUNCILMEMBERS PATE, SAMUEL AND MOUTON NAYS: NONE ITEM TABLED COMMENTS Public Comments (Persons are limited to three minutes) Addie Allen 9695 Gross Beaumont TX Stated that on last year for MILK Day she didn't know that the trash was going to be picked up, stated. that she spoke with the men that pick up the trash and told them that she was going to speak with the Council and ask for consideration which they are considered essential workers, asking Council to consider when everyone else is having a long weekend for MLK day that they have the same consideration as well Councilmembers/City Manager/City Attorney comments on various matters Minutes — December 8, 2020 COUNCILMEMBER COMMENTS COUNCILMEMBER NEILD - ABSENT COUNCILMEMBER GETZ - COMMENTED ON AN EVENT THAT TOOK PLACEAT PIPKIN PARK WHERE THE TEMPLE TO THE BRAVE IS, ENCOURAGED EVERYONE TO GO BY AND VISIT MAYOR PRO TEM FELDSCHAU - STATED THAT THURSDAY, NOVEMBER 19, 2020, HE TESTED POSITIVE FOR COVID-19, HE WENT THROUGH THE PROCESS OF THE TEN DAY QUARANTINE, STATED THAT HE ONLY HAD ONE DAY. THAT HE CONSIDERED TO BE BAD, IN COMPARISON TO MOST PEOPLE HE HAD A MILD CASE, APPRECIATES EVERYONE'S PRAYERS AND CONCERNS, ENCOURAGED EVERYONE TO CONTINUE PRAYING FOR THOSE THAT ARE FIGHTING COVID-19 AS WELL AS EVERYONE MOVING FORWARD IN THE COMMUNITY IN A SAFE AND RESPONSIBLE MANNER COUNCILMEMBER PATE - COMMENTED ON THE BOMBING OF PEARL HARBOR, AS WELL AS COVID AND SEVERAL OF HIS FAMILY MEMBERS THAT HAVE HAD IT, ALSO HIS GREAT FRIEND DR. THOMAS WHO HE WILL KEEP ON THE PRAYER LIST AS HE'S GETTING BETTER, STATED THAT HE ATTENDED CALVARY TABERNACLE FOR A PROGRAM HONORING FIRST RESPONDERS, THANKED COUNCILMEMBERS SAMUEL AND MOUTON WHO LED THE BANNER FOR THE WILLIAM "BOY" BROWN PROCLAMATION, THANKED THE MAYOR FOR ACKNOWLEDGING IT COUNCILMEMBER SAMUEL - REQUESTED A WORKSHOP AFTER THE FIRST OF THE YEAR RELATING TO WATER AND SEWER ISSUES, STATED THAT HE'S SEEING INCREASED CALLS IN WARD III PARTICULARLY WITH PROBLEMS OF SEWAGE BACKING UP INTO HOMES AS WELL AS THE DRAINS ON THE OUTSIDE, ALSO AS A PART OF THAT WORKSHOP HE WOULD LIKE FOR COUNCIL TO DISCUSS THE MANNER IN WHICH THEY DEAL WITH SOME OF THESE ISSUES THAT ARISE, ALSO COMMENTED ON SOME OTHER ISSUE THAT HE WOULD LIKE TO DISCUSS DEALING WITH PROTOCOL AMONG COUNCIL COUNCILMEMBER MOUTON - CONGRATULATED THE BROWN FAMILY ON THE PROCLAMATION FOR THE "BOY" BROWN DAY, THANKED THE MAYOR FOR WORKING SO HARD WITH THE BROWN FAMILY, HERSELF AND HALLIE, STATED THAT SHE RECEIVED SEVERAL CALLS REGARDING THE INTERSECTION OF COLLEGE AND 23RD STREET, ASKED THE CITY MANAGER IF HE COULD CHECK WITH TXDOT BECAUSE COLLEGE STREET IS PART OF TXDOT'S JURISDICTION, THERE HAS BEEN FOUR MAJOR ACCIDENTS AT THAT INTERSECTION WITH THE ONE TURN SIGNAL, NEEDS TO SEE WHAT CAN BE DONE, THANKED CALVARY CHURCH AND Minutes — December 8, 2020 PASTOR VICKERY FOR THE PROGRAM HONORING FIRST RESPONDERS, GAVE CONDOLENCES TO THE FAMILIES OF BEN WHEELER, GARY BABINEAUX AND LEE HARRINGTON AS WELL AS THE TWINE FAMILY CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - STATED THAT SHE SEES A LOT OF NAMES -OF CITIZENS THAT HAVE COVID BECAUSE OF THE REPORT SHE RECEIVES, WANTED TO REMIND EVERYONE THAT IT'S A (HIPAA)-HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT VIOLATION TO REVEAL PEOPLES NAME TO THE PUBLIC, KNOWS FOR CERTAIN THAT ONE OF THE NAMES THAT WAS MENTIONED TODAY DIDN'T.
