REQUESTED Request to consider an application for the designation of
ACTION: Historic -Cultural Landmark (HC-L). The property is
located at 1792 Broadway, Lots 4-6, Block 11, McFaddin
Second Addition to the City of Beaumont, Jefferson
County, Texas. The property is .448 acres, more or less.

STAFF RECOMMENDATION

Staff recommends approval of this request because the subject
property meets the established standards as outlined in Section 30-39,
Subsection (C), Paragraph (3), regarding historical significance of a
landmark quality property.
PROJECT INFORMATION
The applicant, Mr. Rette Browning, is the owner of the Garden Shop
on Calder and a former member of the Landmark Commission. Mr.
Browning is renovating the subject property and is interested in
obtaining the landmark designation in order to qualify for historic
preservation tax relief available through the Historic Tax Abatement
program.
The site is known as the Stewart Smith House and was constructed
circa 1902 shortly after the second SpindIetop Boom by one of
Beaumont's most prominent businessmen. The structure is a Colonial
Revival with a two-story structure with most, if not all of its
architectural detail still intact. The house is structurally sound and
generally well maintained. Interior architectural details are reportedly
intact and the house is a very good example of its architectural style.

The structure, listed multiple times in the SPARE Beaumont survey,
is described in detail by the following excerpt taken from the 1989
SPARE Beaumont survey:
"[The structure is a] two-story gable end front
with asphalt shingle roof [and] corbelled brick
exterior end chimneys. [It has] two symmetrically
spaced pedimented dormers with rounded arch,
[and] multi -pane sash windows. [It has a] central
pedimented portico supported by four massive
Doric columns [and] two Doric pilasters. [The
structure has a] fanlight [though boarded] in [the]
pediment. [It has a central wood door with
twelve -light sidelights [and a], fanlight (boarded),
and a paneled wood surround. One either side of
the portico on the first story is one set of three
windows in a Palladian motif [and] one nine -over -
nine sash with fanlight between two six -over -six
sash. {The structure has a] quadruple six -over -six
sash on [the] second story above the entry [and]
two symmetrically spaced nine -over -nine sash
on ... either side of [the] portico."
The structure has been well documented. In addition to two entries in
the SPARE Beaumont survey, the structure has been documented in
the Beaumont Journal and the Beaumont Enterprise over the past sixty
years. According to those accounts, the structure was constructed by
the Staurt Smiths at the turn of the century. Mr. Smith was a
prominent Beaumont attorney and politician. Mrs. Smith, a renowned
naturalist, designed the house and landscaped the grounds with plants
native to East Texas. All of the fireplace mantels were designed by a
Norwegian cabinet maker.
Current restorations are within the specifications of state guidelines.
The applicant is now seeking designation of historical significance
according to Sec 25-28 of the zoning ordinance. The subject property
is south of the Oaks Historic District and is within a potential district
in and of itself. The home is projected to provide living space for the
applicant (See attached applicant's letter, Exhibit A).

There are 36" storm sewers on both

The Historic Landmark Commission, the Planning Commission and the City
Council shall consider, but not be limited to, one or more of the following
criteria in establishing an HC-L, Historic -Cultural Landmark Preservation
Overlay:
a. Existing or proposed recognition as a National Historic
Landmark, or Texas Historic Landmark, or entry or proposed
entry into the National Register of Historic Places;
b. Existence of distinguishing characteristics of an architectural
type or specimen, or of the social, economic, or political
heritage of the City;
c. Identification as the work of a designer, architect, or builder
whose work has influenced the growth or development of the
City;

d. Embodiment of elements of architectural design, detail,
materials, or craftsmanship which represent a significant
architectural innovation or an outstanding example of a
particular historical, architectural or other cultural style or
period;
e. Relationship to other buildings, structures, or places which are
eligible for preservation as historic places;
f. Exemplification of the cultural, economic, social, ethnic, or
historical heritage of the City, County, State or Nation;
g. Location as the site of a significant historical event;
h. Listing in the S.P.A.R.E. Beaumont Survey;
i. Identification with a person or persons who significantly
contributed to the culture or development of the City, County,
State or Nation; and
j. A building, structure, or place that because of its location has
become of historic or cultural value to a neighborhood or
community.
The site in question meets many of the aforementioned criteria.
Criteria A, E and J are satisfied in that the structure contributes
to the historic character of the immediate area. In addition,
many historic structures are nearby, thus augmenting the historic
value of the subject property. The Oaks Historic District, The
McFaddin-Ward House, The Garth House and the nearby
Mildred Building are all either listed or eligible for Iisting in the
National Register of Historic Places.
Criteria B, D and F are satisfied because the structure embodies
architectural features which illustrate the character of American
residential development typical of the Colonial Revival period.
The structure, by the nature of its detailing, was a significant
addition to the City's form and represents craftsmanship of
superior quality.

As mentioned earlier in this report, the structure has been well
documented in the SPARE Beaumont survey (1977 and 1989, Sites D-
11 and 435 respectively) and was inhabited by a prominent Beaumont
attorney and politician who had a significant impact upon the
development of Beaumont. These facts qualify the structure for
compliance with criteria H and I.
