Richardson, Planning Director SUBJECT: Request for a certificate of appropriateness to build a 5 to 6 foot chain link fence on the north and west sides of the residence at 860 N. 3rd St. FILE: CA-159 STAFF REPORT The applicant has made a request for a certificate of appropriateness in order to build a 5 to 6 foot chain link fence on the north and west sides of her residence at 860 N. 3rd St. The fence would extend in front of the house. The applicant states that this fence is needed for protection of her family and property. On August 2, 1996, the Planning Director made an inspection of the property and recommended that this request be forwarded to the Historic Landmark Commission for their review. Sec. 30-21.2(g) of the Zoning Ordinance states that chain link fences are permitted only in back yards and must not be visible from abutting streets. A solid wall or fence in the front yard shall not exceed 4 feet unless it is required to screen off-street parking or incompatible land uses. Then it may not exceed 6 feet. A fence that is 80% open may be erected to a maximum height of 6 feet. The ordinance also states that the Planning Director may approve a fence not in compliance if the applicant establishes that the fence is historically sensitive or unless the absence of said fence poses a significant hazard to life or property. There have been some back yard chain link fences approved for corner lots. This house is not listed in SPARE BEAUMONT. While the house is not of historical significance, it is well -maintained and is an asset to the neighborhood. Therefore, the Planning Director felt this certificate of appropriateness justified review by the Historic Landmark Commission. i W, 9
