APPROVAL OF THE MINUTES
Chairman Tracy Richardson asked if there were any changes or additions to the September 13,
1999 minutes. Corrections were noted that Commissioner Broussard was present at the
September 13, 1999, meeting and Commissioner Bodin was absent at the September 13, 1999,
meeting.

PUBLIC HEARING
1) Endorsement of FY 2000 Application
Mr. Steve Richardson, Planning Manager, presented the CLG Application to the
Commission.
Mr. Richardson stated that the CLG sub -committee met to discuss various ideas on
which to base the program theme. The synopsis of the committee was a heritage
tourism theme because of the Spindletop celebration taking place. Monies for the
convention will be obtained from the Texas Historic Commission and registration fees.
The deadline for the application is October 27, 1999.
Chairman Richardson asked if there were any questions for Mr. Richardson There
being none, he asked for a motion. Commissioner Broussard made a motion to approve
the application for funds for the CLG Conference. Commissioner Credle seconded the
motion. The motion to approve the application for CLG funds carried 10:0.
REGULAR MEETING
2) CAA28: Request for approval of a certificate of appropriateness to install a metal roof
on a house.
Location: 2620 Hazel
Applicant: Grover Morris
The Planning Manager, Stephen Richardson, presented the staff report and
recommended denial of this request.
The 1991 SPARE Beaumont states that this house was built c.1928 and is of the
Craftsman style. SPARE states that the house is a common example of houses built
in Beaumont during the 1920's. SPARE also states that at the time of the survey, the
house was in fair condition with moisture problems evident.
Section 30-21.2 of the Zoning Ordinance states that metal roofing is a permitted
roofing material. The ordinance also states the roof materials and colors must
compliment the style and overall color scheme of the building or structure.
Slides were presented of the subject property.
Mr. Richardson stated that Mr. Grover Morris was in the audience to answer questions.
Chairman Richardson asked if there were any questions for Mr. Richardson.
Commissioner O'Rear asked Mr. Richardson if his reason for denial was that the roof
would not compliment the house. Mr. Richardson stated yes.
Mr. Grover Moms addressed the Commission. Mr. Morris presented pictures of
structures that have metal roofs on them.

Discussion followed between the Commission and Mr. Moms regarding the advantages
of metal roofing. Commissioner Broussard asked Mr. Morris what color he wanted to
paint his house and what color roof he would like to have. Mr. Morris replied that he
wanted a light color. Commissioner O'Rear asked Mr. Morris if he would be willing
to work with the Planning and Zoning Division regarding a suitable color for the roof.
Mr. Morris replied that he would. Commissioner Farah asked Mr. Morris what style
he wanted, He replied that he would like the ridges on the roof close together.
Additional discussion followed regarding the exact type of roof and color scheme that
would be appropriate. Commissioner O'Rear made a motion to approve CA-428 with
the stipulations that:
L) The color and type of metal roof be matched as close as possible to a
photograph furnished by Mr. Morris, which will be placed in the file and,
2) Mr. Morris be required to work with Planning and Zoning in selecting an
appropriate color as long as the color is in the acceptable color range. If this
is not acceptable to Mr. Morris, he will be required to appear before the
Commission to apply for another color.
Commissioner Shelton seconded the motion. The motion to approve CA-428 carried
10:0.
3) CA432: Request for approval of a certificate of appropriateness to relocate an existing
residential structure to another location within the Oaks Historic District and to build
a new warehouse loading dock.
Location: 25 N 4th Street
Applicant: Coastal Welding Supply
Mr. Steve Richardson presented the staff report and recommended approval of this
request.
Coastal Welding Supply is requesting a certificate of appropriateness to build a
warehouse/loading dock on Lot A, Blocks 22 and 24. On this lot sits an exiting house.
Coastal Welding is also requesting a certificate of appropriateness to relocate this
house to another location in the Oaks Historic District.
The new structure will be a pre-engineered metal building with metal wal Is and roof.
The structure will be similar to the existing Coastal Welding Supply Building. Also
included in the expansion will be a solid wood screening fence with decorative
landscaping along the west property line of Lot 4 and the southern property lines of
Lots 5 and 6.
Coastal Welding Supply is an existing business that has been at this location for a
number of years. The entire block is zoned HI (Heavy Industrial). Mr. Richardson also
recommended that some thought be given to removing this property from the historic
district.
Slides were presented of the subject property.

Commissioner Broussard asked if, when the district was created, were all businesses
that faced 4th Street, exempt from being included in the Historic District. Mr.
Richardson replied yes. He further stated that apparently because of a house sitting on
the property, it was considered residential and included in the district.
Chairman Richardson then asked if there were any questions for Mr. Richardson.
There being none, Mr. John Hoim,Fittz & Shipman, addressed the Commission. He
introduced Mr. Al Mazock and Mr. Chuck Mazock, father and son owner of Coastal
Welding Supply. Mr. Holm also introduced Mr. Ronnie Jones, Architect.
Mr. Holm stated that Coastal Welding Supply employs about fifty people and wish to
expand their facilities. Upon completion of the expansion, the facility will enhance the
area by providing proper storage space and decorative landscaping along the property
line. Proper landscaping will include an appropriate fence and shrubbery.
Chairman Richardson asked if there were any questions for Mr. Holm or suggestions
forthcoming. There being none, Chairman Richardson asked for a motion.
Commissioner Farah made a motion to approve CA-432 as provided for the
appropriate greenbelt working in conjunction with the Planning Commission.
Commissioner Long seconded the motion. The motion to approve CA-432 carried
10:0.
Chairman Richardson asked for a motion for Mr. Richardson to proceed with
appropriate measures to remove the houses currently on property owned by Coastal
Welding Supply from the Historic District.
Discussion followed regarding the removal of the structures. Commissioner O'Rear
made a motion to remove Lot A from the Historic District. Commissioner Broussard
seconded the motion and the motion carried 10:0.
4) CA 434: Request for approval of a certificate of appropriateness for placing tin on the
bottom third of a pre-existing wood screening fence in the front yard of a residential
structure.
Location: 2525 south
Applicant: Bobby Armitage
Mr. Richardson presented the staff report.
The owner of the house has replaced the bottom third of a pre-existing wood fence with
tin. This was done without a certificate of appropriateness. The fence was constructed
entirely of wood.
See. 30-21.2 of the Zoning Ordinance states that a fence in a front or comer side yard
must be constructed of wrought iron, wood or brick
The Planning Manager recommends denial of this request.

Slides were presented of the subject property.
One complaint was received by the Planning and Zoning Department.
Chairman Richardson asked if there were any questions for Mr. Richardson. There
being none, the applicant was asked to address the Commission. Mrs. Robin Armitage
stated that the work was done about a month ago. She also stated that she was not
aware of the Historic District regulations that govern fences. Chairman Richardson
asked Mrs. Armitage is she had investigated any other types of fences and she replied
that she had.
Discussion centered around the overall appearance of the fence and measures that could
be taken in order for thb Commission to approve the request.
Chairman Richardson asked for a motion. Commissioner O'Rear made a motion to
approve the request with the following condition
1) The fence be darkened and lattice work installed over the tin so a neutral effect
will be presented.
Commissioner Holmes seconded the motion and the motion to approve CA- 434 with
the above stated condition carried 10:0.
OTHER BUSINESS
5) Demolition of structures - Mr. Stephen Bonczek, City Manager addressed the
Commission.
Commissioner Farah asked what could be done about persons deliberately letting
property decline and weeds growing out of control with the City bearing the cost of
maintenance. Mr. Bonczek replied that the policy has been changed and reimbursement
of the costs will be recovered by legal means, if necessary. Any contractual costs
incurred by the City will also be included. A status report will be provided to the
Commission by the legal department.
Commissioner Long asked if property changes hands and a lien becomes due and
payable, can permits be withheld to prevent any type of work being performed until the
City has been compensated. Mr. Bonczek replied that permits cannot be denied. Mr.
Bonczek also stated that the City is in the process of improving and raising the level
of code enforcement on lots that need cutting.
Chairman Richardson thanked Mr. Bonczek for speaking to the Commission.

6) Appeal to City Council - 2425 Angelina
Mr. Richardson stated that Ms. Rhonda McMullen appealed the Historic Landmark
Commission's decision to deny her request for a chain link fence and that the City
Council had upheld the Commission's decision.
Commissioner Shelton asked how the decision would be enforced. Mr. Richardson
replied that a certified letter had been sent to Ms. McMullen stating that the fence
would have to be taken down.
7) Mr. Richardson stated that Ms. Peggy Pierre was in the audience to address the
Commission concerning the property at 1695 Milam.
Ms.' Pierre stated that she would like to have the house designated as a Historic
Landmark in order to develop a cultural and heritage center.
Chairman Richardson stated that in order for a historic designation to be put on the
home, a plan would need to be presented.
Dr. Smith, City Council Member, stated that before anything can be done, possession
has to be gained from the owner.
Commissioner Holmes left at 3:45 p.m.
Chairman Richardson asked if there were any more questions. Commissioner
Broussard made a motion for Mr. Richardson to initiate the proper procedures to obtain
a Historic Landmark designation for 1695 Milam. Commissioner Shelton seconded the
motion and the motion carried 9:0
